WHEREAS, FOR MANY YEARS, THE LES DEMERLE AMELIA ISLAND JAZZ FESTIVAL HAS BROUGHT EXCITING WORLD CLASS JAZZ ENTERTAINMENT TO FERNANDINA BEACH IN STYLE INCLUDING CONTEMPORARY, BIG BAND, LATIN, SWING, DIXIELAND, BLUES AND MORE.

AND WHEREAS, DUE TO THE COVID-19 PANDEMIC, THIS YEAR AMELIA ISLAND JAZZ FESTIVAL IS PRESENTING A VIRTUAL, ONLINE, LIVE-STREAMED-PERFORMANCES IN TRIBUTE TO JAZZ LEGENDS AND THE MUSIC OF LOUIE ARMSTRONG FEATURING RENOWNED TEMPORARY ETER AND VOCALS LONG KNEW PARSONS.

>> WHEREAS, THE MAIMED JAZZ FESTIVAL IS ENDORSED BY JAZZ ICONS. AND WHEREAS, IN AN EFFORTS TO REACH OUT TO AS MANY CONCERTGOERS AS POSSIBLE, THE AMELIA ISLAND JAZZ FESTIVAL IS OFFERING VIRTUAL, TICKETED SHOWS FROM THE ELIZABETH POINT LODGE AND STORY AND SONG BOOK STORE BIT ERROR. WHEREAS, THE AMELIA ISLAND JAZZ FESTIVAL PRESENTS MANY EDUCATIONAL PROGRAMS INCLUDING JAZZ IN SCHOOLS, JAZZ FOR KIDS, JAZZ FOR SENIORS, AS WELL AS A SCHOLARSHIP PROGRAM WHICH SUPPORTS CONTINUING MUSIC EDUCATION FOR HIGH SCHOOL STOOL MUSICIANS.

NOW, THEREFORE, I, JOHN A. MILLER, BY VIRTUE OF THE AUTHORITY VESTED IN ME AS MAYOR OF THE CITY OF M.V.P., DO HEREBY ENCOURAGE THE CITIZEN OF FERNANDINA BEACH TO PARTICIPATE IN THE AMELIA ISLAND JAZZ FESTIVAL CELEBRATIONS AND FURTHER PROCLAIM THE WEEK OF OCTOBER 5 THROUGH OCTOBER 11, 2020 AS LES DEMERLE AMELIA ISLAND JAS FESTIVAL WEEK.

MANY PEOPLE ARE TOUCHED BY YOUR SCHOLARSHIPS.

SEVERAL ARE CONTRACTED TO BE HERE. WE HAVE HAD FOR 2021.

I SAID LET'S DO SOMETHING ON A LEVEL, SO OUR BAND IS A TRIBUTE TO DUKE ELLINGTON, THE LIFE OF LOUIS ARMSTRONG ON BROADWAY.

WE'LL LIVE STREAM IT FROM STORY AND SONG.

YOU CAN GO THERE AS A STUDIO. IT'S CAMERAS AND LIGHTING AND SOUND MAN AND THE SOUND IS THE BEST AS WE CAN.

WE HAVE THE JAZZ FESTIVAL AND BRING MUSIC, ESPECIALLY IN THIS TIME OF OUR LIVES TO THE ISLAND AND TO THE WORLD.

WE ALL RECEIVED AN E-MAIL FROM THE CITY MANAGER OF THE UPDATE THE ES CANDIA SLOUGH. THE CITY MANAGER WILL COME UP AND JUST I'LL RELATE TO THE PUBLIC THE EAT DETAILS OF THE

WE PROVIDE ADD LIST OF PROPERTIES IN THAT AREA WHICH ARE NOT CONNECTED TO THE CITY STURE SYSTEM.

THE COUNTY HEALTH DEPARTMENT WENT OUT AND INSPECTED THOSE AND FOUND ONE PROPERTY THAT HAD IDENTIFIED AS HAVING A SEPTIC

SYSTEM FAILURE. THOUGH FOUND THREE OTHER PROPERTIES WITH A SEPTEMBER TICK NUISANCE WITH AN IMPROPER CONNECTION FROM THEIR MASHER TO THEIR SEPTIC TANK.

THERE WAS ONE PROPERTY THAT HAD A SEPTIC SYSTEM FAILURE.

THEY WILL REVIEW THE COST OR THE PLANS, THE DEFINITION OF THAT THE CITY ATTORNEY HAS PROVIDED TO DETERMINE HOW TO POSSIBLY PROVIDE THAT SANITARY SEWER CONNECTION TO THAT ONE UNIT.

THOSE ARE THE ONGOING PLANNING OVER THE COURSE OF THE NEXT

MONTH. >> THOSE FOUR PROPERTY OWNERS WILL RECEIVE CORRESPONDENCE FROM THE COUNTY HEALTH DEPARTMENT.

AND THEY MUST CORRECT THEIR NUISANCE.

SEVERAL WEEKS AGO, THERE WAS A PERSON ON FACEBOOK ABOUT A CONTRACTING, IN WHICH THEY LOOKED FOR SUB CONTRACTS.

THE ADVERTISEMENT WAS FROM THE -- THE ADVERTISEMENT LIST ADD FIVE-STORY HOTEL. ON THE PROPERTY NEXT TO SLIDER'S. ASKING FOR CONTRACTORS TO BE INVOLVED WITH THE CONSTRUCTION. THAT POSTING TOOK A LOT OF PEOPLE BY SURPRISE, WHO WERE UNAWARE OF THIS PROJECT.

I WANTED TO TALK ABOUT THIS IT SO THE PUBLIC KNOWS THE STATUS, OR THE BACKGROUND OF THIS PROJECT AND THE CURRENT STATUS OF IT. AND I WANT TO PREFACE THE COMMENTS BY STAYING THIS COMMISSION IS NOT VOTING ON ANY -- THIS IS A DISCUSSION ABOUT THE PROJECT AND WHERE IT STANDS AS OF TODAY. AND THE CITY ATTORNEY WILL TAKE

IT'S BEEN FOUR YEARS, CLOSER TO FIVE, WHERE THE OWNERS JUST CAME TO ASK THE PLANNING DEPARTMENT SOME QUESTIONS ABOUT THE PARCELS, COMBINING THE PARCELS, WHICH WE CANNOT DO ON BEACH. WE ARE TALKING ABOUT TWO 50-FOOT, 100-FOOT PARCELS ON THE OCEAN SIDE OF FLETCHER AVENUE, JUST NORTH OF WHAT WE KNOW AS SLIDER'S.

THEN A FEW APARTMENTS. JUST NORTH OF TWO VACANT PARCELS. BECAUSE THE CITY COMMISSION A FEW YEARS AGO DENIED ANY BUILDING FOR PROPERTY OWNERS TO COMBINE LOTS. YOU CANNOT COMBINE FOR THAN 50 FEET TOGETHER. THIS IS TWO 50-FOOT LOTS.

YOU CANNOT COMBINE THEM TO MAKE ONE GIANTS 100-FOOT LOT TO PUT HOTELS. THESE ARE ZONED COMMERCIAL UNDER OUR ZONING CODE. AND THIS COMMERCIAL, YOU DO NOT HAVE TO HAVE SETBACKS BETWEEN TWO COMMERCIAL USES.

THEY CALL THAT NO SETBACKS, WE CALL THAT ZERO LOT LINE.

IT MEANS ZERO LOT LINES. THERE IS NO REQUIREMENT FOR A NUMBER OF INCHES OR ANYTHING. CAN YOU LITERALLY PUT TWO BUILDINGS NEXT TO EACH OTHER AND THEY DON'T HAVE TO BE SEPARATED OTHER THAN BE COMPLETED BUILDINGS.

IF IT'S BUILT, THERE IS NO SEPARATION.

BUT THAT IS ALLOWED UNDER THE CODE.

THE PROPERTY ADDRESSES ARE 1962 AND 1974 SOUTH FLETCHER AVENUE.

AND PROPOSED ARE TWO SIDE BY SIDE INDEPENDENT HOTELS BY INDEPENDENT -- WE DON'T MEAN IT'S NOT THE SAME BRAND BECAUSE WE DON'T KNOW. IT'S TWO SEPARATE INDEPENDENT BUILDINGS WITH UNDERGROUND VALET PARKING, THREE FLOORS OF CONDITIONED SPACE, AND ROOF TOP ELEMENT.

I THINK THAT IS WHERE THE FIVE STORIES CAME IN.

YOU HAVE ONE STORY OF PARKING. YOU HAVE THREE STORIES PO

YOU CAN HAVE A RAILING. THINGS LIKE THAT ON TOP AFTER COMMERCIAL ESTABLISHMENT. THE TOP OF THE ROOF, NOT INCLUDING THE ROOF TOP ELEMENTS, WILL BE 35 FEET.

THAT'S THE MAX. BOTH PROJECTS HAVE TO BE COMPLIANT WITH ALL OF THE CITY'S CURRENT CODES WHEN THEY COME IN FOR BUILDING PERMITS. IT'S BEEN ASKED OF ME WHETHER OR NOT THE CITY'S NEW FLOOD ORDINANCE, AND ALSO -- AND WITH THE FLOOD ORDINANCE, THERE THE CITY COMMISSION PROVIDED STANDARDS THAT YOU CANNOT BRING AS MUCH FILL IN TO MAKE IT SIMPLE, AS COULD YOU BEFORE. YOU CAN'T BRING VERY MUCH FILL AT ALL. ANOTHER IMPORTANT ASPECT OF THE NEW REQUIREMENTS, NOT UNDER FLOOD, BUT UNDER LAND DEVELOPMENT CODE IS HOW TO MEASURE HEIGHT.

WE USED TO MEASURE FROM THE FINISHED GRADE, WHICH IS ESSENTIALLY A SLAB, THEN YOU PRESSURE 35 FEET.

CONDITIONAL AREVOLVE FROM THE TRC MEANS THERE ARE CONDITIONS ATTACHED TO THAT APPROVAL. THE CONDITIONS WOULD APPLY.

IF THEY CAN MEET ALL OF THOSE CONDITIONS AND NOT MUCH HAS CHANGED ABOUT THEIR SITE PLAN, THEY DON'T HAVE TO GO BACK TO THE TECHNICAL REVIEW COMMITTEE. THAT WOULD END ANY TYPE OF -- IF YOU WOULD, PUBLIC VIEWING OF THE APPROVAL APROCESSES.

THE NEXT PROCESS IS THE BUILDING PERMIT PROCESS.

THAT WOULD GO THROUGH THE BUILDING DEPARTMENT.

STAFF INFORMED THE PROPERTY OWNERS, THEIR SITE PLAN APPROVALS EXPIRED IN JULY OF 2019, FOR FAILUR TO PROVIDE A WRITTEN REQUEST TO EXTEND. THE LOCAL DEVELOPMENT ORDER IS WHAT WE KNOW AS VESTED RIGHTS. IT'S BASED ON APPROVAL FROM THE TRC. THAT EXPIRED JULY OF 2019.

THE PROPERTY OWNERS THOUGHT THEY KEPT THE CITY ON NOTICE, ALTHOUGH HAD NOT FORMALLY REQUESTED AN EXTENSION.

THEY APPEALED THAT TO THE BOARD OF ADJUSTMENT IN OCTOBER OF 2019, THE BOARD OF ADJUSTMENT OVERRULED THE STAR DECISION AND EXTENDED THE DEVELOPMENT ORDER FOR THE PROPERTY OWNERS.

THAT DEVELOP ORDER IS STILL VALID AND GOOD BASED ON THAT EXTENSION FROM 2019. IT GOES ABOUT SIX MONTHS AT A TIME SIX MONTHS AFTER OCTOBER OF 2019, WE ARE MARCH 2019, AND WE GET HIT WITH THE COVID PANDEMIC.

THAT CAUSED THE GOVERNOR OF FLORIDA TO EXTEND ALL LOCAL DEVELOPMENT ORDERS UNTIL THEY ARE NOT EXTENDED ANY MORE THROUGH EXECUTIVE ORDER. THE LAST EXECUTVE ORDER EXTENDED, FOR EXAMPLE, THIS DEVELOPMENT ORDER TO EXPIRE ON NOVEMBER 4. THE GOVERNOR COULD EXTEND THAT AGAIN. AND MAY NOT.

IF THE GOVERNOR DOES NOT EXTEND IT, THE PROPERTY OWNER IS UNDER OUR CODE HAVE THE ABILITY TO ASK FOR AN EXTENSION FOR ANOTHER SIX MONTHS. WHICH WE EXPECT THEY WILL DO, SINCE WE DON'T HAVE ANY PLANS FOR BUILDING PERMITS YET.

NOVEMBER 4 IS THE NEXT EXPIRATION DATE WE EXPECT TO ASK FOR AN EXTENSION FROM THERE. ARE THERE ANY SPECIFIC

AND THAT THE CITY INFORM THE APPLICANTS THEY WILL NEED TO PROVIDE AND COMPLETE ARCHITECTURAL PLAN BEFORE ISSUING DEP COMPLIANCE REVIEW LETTERS.

I SENT A VERY SIMPLE, BUT DIRECT E-MAIL THAT SAYS, JUST SO YOU UNDERSTAND, BETWEEN THE BUILDINGS, THERE IS ZERO SEPARATION. ON EITHER SIDE, THAT MEANS ON THE NORTH AND ON THE SOUTH OF ALL OF THESE LOTS.

WE HAVE RAILROAD CROSSINGS DECLARED UNSAFE FOR F DOT FOR CARS AND PEEL. CARS COME DOWN CENTRE STREET AND TURN AND WALK THE RAILROAD TRACK.

I HAVE SEEN IT MYSELF ON SEVERAL OCCASIONS.

IT'S NOT SAFE TO WALK ON FRONT STREET.

YOU WALK ON FRONT STREET, YOU ARE TAKING YOUR LIFE IN YOUR HANDS, IF YOU RIDE A BICYCLE ON FRONT STREET.

IT'S NOT VERY SAFE. I DO THAT EVERY DAY.
