>> DO A BRIEF PRESENTATION FOR YOU.

AND THEN ALSO I SAW I ONLY READ PART OF YOUR AGENDA BEFORE I CAME. BUT I SEE YOU ARE GOING TO HAVE A LIABILITY DISCUSSION SO I'LL STANNARY TOO.

>> THANK YOU. >> AND I CAN CHANGE THESE WITH THE UP AND DOWN ARROWS. NO.

IF NOT, I'LL JUST PUT IT INTO -- >> SHE CAN DO IT.

>> I CAN CHANGE IT BUT I THINK YOU HAVE TO SET IT UP FROM YOURS

IF YOU ARE GOING TO CHANGE IT. >> IT'S 17 SLIDES WE'RE GOING TO GO THROUGH QUICK. DO YOU MIND.

NEXT SLIDE PLEASE. >> SUNSHINE LAW AND JUST IGNORE THE ETHICS. I DO ETHICS TRAINING WHICH I MENTIONED IT IS REQUIRED FOR ELECTED OFFICIALS.

AND IT'S FOUR HOURS OF TRAINING. I ALWAYS INVITE CITY EMPLOYEES AND ADVISORY BOARD MEMBERS. THURSDAY APRIL 1.

IT WILL BE IN THE AFTERNOON 1:30 TO 5:00 AND OR 1:00 TO 5:00 AND ON FRIDAY ANOTHER SESSION OF THE SAME THING FROM 8:00 UNTIL NOON.

WE TALK ABOUT ETHICS AND THE SUNSHINE LAW.

SO WE HAVE A SECTION THAT IS AS I SAID REQUIRES ALL ELECTED MUNICIPAL US OFFICERS TO TAKE ETHICAL SUNSHINE LAW TRAINING.

WHAT IS THE SUNSHINE LAW? ORIGINALLY IT WAS MEANT TO COVER WE HAVE OUR MEETINGS IN THE OPEN WITH PUBLIC ACCESS AND WE'RE IN THE SUNSHINE. IT ENCOMPASSES THE RECORDS ACT NOW. IT'S DERIVED FROM THE FLORIDA CONSTITUTION. MEETINGS OF PUBLIC BOARDS, COUNCILS, COMMISSIONS MUST BE OPEN TO THE PUBLIC, OPEN TO THE PUBLIC, REASONABLE NOTICE WE POST AGENDAS AND MINUTES OF THE MEETINGS MUST BE TAKEN. AUDIO AND VIDEO RECORDINGS DO NOT COUNT AS MINUTES. YOU HAVE TO AT LEAST DERIVE FROM THE AUDIO AND VIDEO RECORDING SOMETHING IN WRITING THAT YOU EVENTUALLY APPROVE AS MINUTES WHERE YOU TAKE SUMMARY NOTES OF

THE MEETING. >> PUBLIC BOARDS, COUNCILS AND COMMISSIONS. WE ARE A COMMITTEE.

COMMITTEE AND BOARDS ARE DIFFERENT.

>> MAY BE BUT NOT FOR PURPOSES OF SUNSHINE LAW.

THIS BOARD IS SUBJECT TO THE SUNSHINE LAW.

NEXT SLIDE. UNLESS THOSE THREE REQUIREMENTS ARE MET, REASONABLE NOTICE, PUBLIC ACCESS AND IT'S OPEN AND THERE ARE MINUTES TAKEN, IT IS THE SUNSHINE LAW NOT MET AND IT COULD BE A VIOLATION. TWO OR MORE BOARD MEMBERS GET TOGETHER AND CONDUCT BUSINESS OR DISCUSS SOMETHING THAT FORCIBLY WILL COME BEFORE THE BOARD WHEN YOU ARE OUT WALKING AROUND OR BUMP INTO EACH OTHER. THAT IS VIOLATION OF THE SUNSHINE LAW. THAT SHOULD BE DONE IN OPEN MEETING WHERE WE TAKE MINUTES AND HAVE A REASONABLE NOTICE.

WHO IS COVERED? I DON'T HAVE COMMITTEES, BUT BEFORE APRIL 1 I WILL CORRECT THAT.

COUNCILS, BOARD, COMMISSIONS, COUNTIES, MUNICIPALITIES, POLITICAL SUBDIVISIONS ELECTED OR APPOINTED AND PRIVATE COMPANIES THAT DO BUSINESS ON BEHALF OF A CITY.

SO WE HAVE CONTRACTORS ARE SUBJECT TO IN SOME CASES.

NOT THEIR BOARD MEMBERS, THEY ARE NOT MEMBERS OF THE BOARD.

THEY ARE COVERED UNDER THE SUNSHINE LAW.

WEST REC IS A PRIVATE COMPANY THAT MANAGES OUR MARINA.

THE RECORDS ARE OPEN FOR PUBLIC INSPECTION.

AND ONE PERSON THAT ACTS ON BEHALF OF A BOARD OR COMMISSION.

THAT HAS TO BE DELEGATED AUTHORITY.

IT CAN'T BE THAT ONE PERSON IN THEIR OWN RIGHT THAT GOES OUT AND SAYS I REPRESENT THE BOARD. THAT WOULD NOT BAY VIOLATION OF SUNSHINE. THIS BOARD OR THE CITY COMMISSION SAID I'LL PICK ON YOU COMMISSIONER ROSS WE WANT TO YOU GO AND NEGOTIATE THIS CONTRACT AND COME BACK WITH A RECOMMENDATION, THAT IS A VIOLATION OF THE SUNSHINE LAW.

DOES OPEN MEETINGS LAW APPLY THE MEMBERS ELECT OR MEMBERS THAT ARE APPOINTED BUT HAVEN'T SERVED YOUR PURPOSES.

IT DOES BUT NOT UNTIL THAT ELECTION OR APPOINTMENT HAPPENS.

FOR ELECTED CITY COMMISSIONERS , THE DAY AFTER THE ELECTION IF WE ACTUALLY HAVE THE CANVASSING BOARD CERTIFY THE ELECTION, SAY THIS COMMISSIONER HAS BEEN ELECTED, THAT PERSON IS THEN SUBJECT. UP TO THAT POINT THEY ARE NOT SUBJECT N. YOUR CASE AS AN APPOINTED BOARD MEMBER, AFTER

[00:05:03]

THE CITY COMMISSION APPOINTS YOU AND BEFORE YOU START YOUR FIRST MEETING YOU CAN'T TALK TO THE OTHER BOARD MEMBERS.

BEFORE THAT YOU COULD SAY I'M THINKING ABOUT OR I'VE PUT MY NAME TO BE AN APPOINTED BOARD MEMBER.

THEN YOU COULD TALK TO OTHER BOARD MEMBERS.

TWO MEMBERS OF THE SAME PUBLIC BOARD APPOINTED, ELECTED OR COMMITTEE CAN THEY SOCIALIZE? CAN YOU DO GOLDE GO TO A PARTY K TO EACH OTHER? YES.

FUR TALKING ABOUT BUSINESS THAT WILL COME BEFORE THE BOARD OR FORCIBLY WILL COME BEFORE THE BOARD, THEN YOU CAN'T.

BUT YOU CAN TALK ABOUT ANYTHING ELSE.

YOU CAN EVEN TALK ABOUT CAN I TALK ABOUT SOMETHING THAT THE CITY COMMISSION IS GOING TO SEE HAVING NOTHING TO DO WITH PARKS AND RECREATION. YES, YOU CAN TALK WITH CITY COMMISSIONERS ABOUT THAT TOO. WHAT ARE THE SANCTIONS? WHAT HAPPENS IF THERE IS A VIOLATION OF THE SUNSHINE LAW AND SOME DECISION MADE OR BUSINESS DISCUSSED, WHAT ARE THE PENALTIES POTENTIALLY? IF IT'S UNINTENTIONAL YOU CAN BE FINED UP TO $500. ALL OF THIS THOUGH IS DONE THROUGH THE STATE ATTORNEY'S OFFICE.

NONE OF IT IS HANDLED ON THE CITY LEVEL.

THE CITY COMMISSION DOESN'T DECIDE ABOUT ADVISORY BOARD MEMBERS OR OTHER SUNSHINE LAW. IF YOU INTEND TO DO IT YOU CAN BE SUBJECT TO CRIMINAL PENALTIES UP TO $500 AND UP TO 60 DAYS IN JAIL. YOU CAN BE SUSPENDED OR REMOVED FROM OFFICE BUT BY THE GOVERNOR, NOT BY THE CITY COMMISSION.

THAT'S AT WILL. AND YOU COULD BE SUBJECT TO ATTORNEY'S FEES AND COURT COSTS. IF SOMEBODY BROUGHT SUIT AGAINST A PERSON OR BOARD OR THE CITY OR CITY COMMISSION, THE CITY COMMISSION IF THERE WAS A VIOLATION COULD BE SUBJECT TO THAT PERSON WHO SUED PAYING FOR THEIR ATTORNEYS AND COST.

NO MORE QUESTIONS ON OPEN MEETINGS?

ANYTHING. >> THE QUESTION I HAVE AND I'VE TALKED TO YOU ABOUT IT, I JUST WANT TO GET IT ON THE RECORD, ARE WE COVERED BY ERRORS AND OMISSION POLICY?

>> YES. WHAT I DID WAS I THOUGHT I KNEW THE ANSWER BUT JUST TO MAKE SURE I CHECKED WITH THE CITY'S INSURANCE COMPANY. INDEED ADVISORY BOARD MEMBERS ARE COVERED BY ERRORS AND OMISSIONS INSURANCE.

>> THANK YOU. >> ANY OTHERS?

>> PUBLIC RECORDS. FLORIDA CONSTITUTION AGAIN TELLS US THAT OUR RECORDS ARE PUBLIC. PRETTY MUCH EVERYTHING.

THERE IS LOTS OF EXCEPTIONS. EVERYTHING WE DO REGARDING BOARD BUSINESS IS PUBLIC RECORD. NEXT SLIDE.

WHAT IS A PUBLIC RECORD? TEXT MESSAGES, VOICE MAILS, PHOTOGRAPHS, FILMS, EMAILS, AUDIO RECORDINGS, ALL OF IT IS PUBLIC RECORD IF IT HAS TO DO WITH IN YOUR CASES SOMETHING TO DO WITH PARKS AND RECREATION. DOESN'T HAVE TO DO WITH ALWAYS JUST SOMETHING THAT WAS ON YOUR AGENDA OR WILL COME, ANYTHING HAVING TO DO WITH PARKS AND RECREATION I WOULD BE BROAD AND ASSUME THAT IS A PUBLIC RECORD. DO NOT DELETE TEXT MESSAGES THAT YOU GET WITH REGARD TO BECAUSE IF YOU DELETE THEM, YOU CAN'T GET THEM BACK WITHOUT A COURT ORDER I.

AND JUDGES I CAN TELL YOU WHETHER L PRESUME THAT IT WAS NOT JUST AN OOPS I DID LEAGUES, THAT YOU DID IT ON PURPOSE.

YOU'LL HAVE TO PROVE THAT YOU DIDN'T.

NOT FUN. >> I HAVE A QUESTION RELATED TO THAT. OCCASIONALLY BECAUSE OUR MEMBERS ARE ON THE CITY WEBSITE. OCCASIONALLY I GET A PHONE CALL ABOUT AN ISSUE ON THE AGENDA. IS THERE SOMETHING I SHOULD DO

WITH THAT? >> YOU NEED TO BE KEEPING THEM SOMEWHERE. I'M NOT THAT TECHNICALLY SAVVY.

I HAVE I DON'T KNOW HOW MANY DOZENS OF SAVED VOICE MAILS ON MY PHONE AT WORK AT MY DESK PHONE ON MY PERSONAL PHONE.

I WAS GOING THROUGH TODAY. I HAD VOICE MAILS SOME PERSONAL CALLS AND SOME CITY CALLS. AND I WENT THROUGH AND DELETED THE PERSONAL ONES AND KEPT THE VOICE MAILS.

TO TURN IT INTO ANOTHER TYPE OF FILE SO YOUR VOICE MAILBOX DOESN'T GET FILLED UP ON YOUR CELL PHONE.

YOU COULD PROBABLY JUST E MAIL OUR I.T. PEOPLE AND SEE HOW IT

COULD BE CONVERTED. >> YOU HAVE TO SAVE IT IN SOME

WAY. >> WHAT ABOUT IF I HAVE A

[00:10:02]

CONVERSATION, DO I NEED TO DOCUMENT THAT?

>> NEXT SLIDE PLEASE. GUIDELINES FOR EMAILS.

THIS IS IMPORTANT. I THINK YOU ALL KNOW IT.

YOU DON'T HAVE CITY ISSUED COMPUTERS.

IF YOU DID THOSE OBVIOUSLY, THOSE EMAILS ARE PUBLIC RECORDS.

IT DOESN'T MATTER THE DEVICE IT'S ON.

IT COULD BE ON YOUR PERSONAL PHONE, YOUR PERSONAL COMPUTER, IF IT HAS SOMETHING TO DO WITH OUR PARKS AND RECREATION ADVISORY DUTIES OR JUST PARKS AND RECREATION THEN IT IS A PUBLIC RECORD NO MATTER WHERE IT'S STORED.

IT COULD BE STORED ON A DISTANT COUSIN'S COMPUTER.

IF IT'S ASKED FOR WE NEED TO GET IT.

WHAT ABOUT FACEBOOK POST SCIENCE THERE IS SOFTWARE THE CITY CAN HELP YOU WITH THAT'S WILL HELP TO ARCHIVE ANY OF YOUR FACEBOOK CONVERSATIONS, POSTS, WHETHER YOU ASK FOR THEM OR NOT, WHETHER YOU POST SOMETHING OR NOT, IF SOMETHING COMES IN AS PART OF YOUR DUTY ON THIS BOARD, CONTACT THE CITY CLERK'S OFFICE THERE IS A WAY YOU CAN KEEP THOSE PAGES AND MUCH BETTER THAN THIS MUCH.

SCREEN SHOT AND SAVE IT. THIS IS A QUESTION I'M ALWAYS ASKED. ARE MY NOTES PUBLIC RECORDS? THE DISTINGUISHING FACTOR IS ARE YOU MAKING THOSE NOTES FOR YOURSELF JUST TO KIND OF JOG YOUR OWN MEMORY OR WILL THOSE NOTES EVENTUALLY BE COMMUNICATED AS A MESSAGE TO SOMEBODY? SO AN EASY EXAMPLE. ASK AFTER THE MEETING.

THAT'S PUBLIC RECORD. PICK UP MILK ON THE WAY HOME NOT A PUBLIC RECORD. REVIEW PARKS AND REC MASTER PLAN TO REMIND MYSELF OF SOMETHING. NOT A PUBLIC RECORD.

THESE ARE MY OPINIONS NOW. DOES THAT MAKE SENSE? ANY QUESTIONS ABOUT THIS. DRAFTS.

I HAVE CITY EMPLOYEES 20 PLUS YEAR EMPLOYS BEEN DOING THIS A LONG TIME. THEY SAID THIS IS JUST A DRAFT.

I'M JUST GOING TO THROW IT AWAY. IF THEY ARE CAUGHT THERE IS TROUBLE. DRAFTS ARE NOT -- ARE PUBLIC RECORD AND ARE NOT TO BE THROWN AWAY.

OPEN MEETINGS AND PUBLIC RECORDS.

ANY OF THESE SLIDES OR INFORMATION I HAVE IF YOU WANT A COPY YOU CAN EMAIL ME AND I'M HAPPY TO GIVE AWE A COPY.

THIS IS OUR SUNSHINE LAW. ARE THERE ANY QUESTIONS?

>> I HAVE A QUESTION. SUPPOSE WE'RE AT ANOTHER VENUE, LET'S SAY IT WAS THE TREE CONSERVE SI AT THE RESTAURANT OVER THERE AND THERE IS MULTIPLE INDIVIDUALS THERE AND NO MINUTES BEING TAKEN. BUT IT'S JUST A GENERAL MEETING OPEN TO THE PUBLIC AND HAPPENS TO BE TWO OR MORE COUNCIL MEMBERS IN THERE DISCUSSING THINGSTA MAY COME ACROSS IN THIS

FORUM, IS THAT A VIOLATION? >> WOULD BE.

IT'S VERY FACT SPECIFIC. IF I UNDERSTAND YOUR QUESTION.

IS TWO CITY COMMISSIONERS ATTEND A MEETING OF SOME OTHER BOARD OR ORGANIZATION, AND THOSE TWO COMMISSIONERS ARE DISCUSSING WHETHER IT'S OVERHEARD BY EVERYBODY OR WHISPERING?

>> IN GENERAL. THE WHOLE MEETING MAY COME

BEFORE THE BOARD. >> THAT'S RIGHT.

>> AND I'M JUST SAYING -- BUT BASICALLY THAT PERSON THE COUNCIL MEMBERS CAN'T COMMUNICATE WITH EACH OTHER.

WE CAN STILL PARTICIPATE IN THE MEETING.

>> YEAH. >> WE JUST CAN'T CONVERSE WITH EACH OTHER ON THAT PARTICULAR SUBJECT WHICH MAY COME BEFORE THE BOARD. I WILL GO ONE STEP FURTHER BECAUSE THIS HAS COME UP BEFORE. IS TWO OF THE SAME BOARD MEMBERS ARE THERE. ONE OF THEM IS ASKED TO SPEAK OR FEELS LIKE THEY WANT TO SPEAK AND ADDRESS THE GROUP.

AND IN SAYING THAT YOU REVEAL A POSITION THAT YOU HAVE ON A TOPIC THAT IS GOING TO COME BEFORE YOUR BOARD.

THE SECOND MEMBER SHOULD NOT SAY WHAT THEIR POSITION IS OR RESPONSE TO THE POSITION OF THE FIRST MEMBER.

AND THAT HAS HAPPENED BEFORE WHERE IT'S LIKE THE FIRST ONE TO GET TO THE PODIUM GETS TO GET THEIR SAY IN.

[00:15:17]

>> ONCE YOU STEP OFF THE FLOOR NONE OF THIS APPLIES IS THE.

>> NO, IT ALWAYS APPLIES. YOU CAN TALK ABOUT WHERE ALL THE SKELETONS ARE. YOU CAN TALK TO ANYBODY YOU WANT

TO NOW. >> THANK YOU.

>> I WAS WONDERING IF SINCE SHE'S ALREADY HERE AND ON THE AGENDA THERE IS THE DOG PARK LEGAL QUESTIONS, IF SHE SHOULD GO AHEAD AND ANSWER THOSE SO THAT HE'S NOT ANSWERING -- SO STEVE NOT TRYING TO ANSWER THOSE QUESTIONS THAT YOU GUYS HAD LAST

TIME. >> I THINK THAT'S A GOOD PLAN.

MY ONLY CONCERN ABOUT THAT IS IF SOME OTHER LEGAL QUESTIONS COME UP IN THE PRESENTATION. I KNOW THE BIG QUESTION IS ADDRESSED HERE. SO MAYBE IF YOU CAN TAKE A MOMENT TO SPEAK ON THAT. I THINK THE CONCERN IN THE COMMUNITY IS LIABILITY ON A DOG PARK.

SO THIS WAS SENT BY MR. COOK AS A RESPONSE TO THAT CONCERN.

>> THIS IS SENT BY MR. COOK? >> NO.

THE QUESTION IS BEFORE WE SAW THAT IS WHAT LIABILITY COULD THE

CITY HAVE WITH A DOG PARK? >> YES.

>> I DON'T KNOW MR. PHILLIPS. IS THIS A FLORIDA ATTORNEY OR IS

IT FROM ANOTHER STATE? >> I HAVE NO IDEA.

>> THAT MATTERS A LOT. LIABILITY IN FLORIDA IS DIFFERENT THAN LIABILITY IN ALASKA AND OTHER STATES.

I WILL SAY THIS. LET ME JUST TAKE A MINUTE TO LOOK AT THIS. I AGREE IT.

THAT'S BASICALLY THE -- DOG PARK, NO DOG PARK , THE CITY HAS LIABILITY FOR ANY FAST FACILITYT IT HAS.

WITH DOGS BEING THERE AND IT NOT BEING A FACILITY THAT THE CITY STAFFS, MY UNDERSTANDING IS THIS PROPOSAL IS NOT TO HAVE CITY STAFF THERE, THEN THERE IS THE CITY WOULD HAVE IMMUNITY.

YOU'D HAVE TO PROVE IF YOU DID GET BITTEN BY A DOG -- LET'S DEAL WITH THE PEOPLE. IF YOUR DOG GETS INJURED, I'M GOING TO SAY THIS AND FUR A DOG OWNER I'M SORRY, I AM ALSO.

DOGS AND OTHER PETS ARE CONSIDERED PERSONAL PROPERTY.

THEY DON'T HAVE THE MEANING IN LAW THAT THEY DO TO US THAT OWN THEM. IF ANOTHER ANIMAL GETS HURT THE DAMAGES ARE REALLY SMALL. THEY ARE NOMINAL.

IF YOU PAID $3,000 FOR A SHOW DOG AND MAKING ALL THIS MONEY FOR YOU THE DAMAGES MIGHT BE GREATER.

BUT FOR MOST OF US IT'S NOT. I'M NOT GOING TO ADDRESS THE LIABILITY IF A DOG GETS BIT. WE'LL HANDLE IT.

I'M NOT WORRIED ABOUT I AT ALL. IF A PERSON GETS BIT THE ANSWER IS IT DEPENDS. I'LL GIVE YOU A LESSON ON TORTS AND LIABILITY. SO THERE IS DUTY, BREACH, CAUSATION, DAMAGES. IS THERE A DUTY FOR THE CITY TO HAVE PROTECTED SOMEBODY AGAINST THAT DOG BITE? THE ANSWER I THINK WITH DOG PARK THEY ARE EVERYWHERE THESE DOG PARKS SO PROBABLY NOT. THERE IS A DUTY TO MAINTAIN THE FACILITY. IF THERE IS SOMETHING WRONG WITH THE FACILITY, FORGET THE DOG JUST BITING, IS THERE A BREACH OF THAT DUTY? WAS IT CAUSED BY SOMETHING THE CITY DID OR DIDN'T DO AND WERE THERE DAMAGES CAUSED BY IT.

THOSE ARE THE ELEMENTS OF A LAWSUIT FOR LIABILITY.

AND SO THERE IS MORE THAN JUST DOES THE CITY HAVE LIABILITY? OF COURSE WE DO. IS SOMEBODY GOING TO STEW CITY IF A DOG BITES ANOTHER PERSON. YES, THEY ARE GOING TO SUE THE CITY. THE CITY HAS INSURANCE THAT COVERS IT. WE DON'T WORRY ABOUT THOSE KIND OF LAWSUITS. BECAUSE WE HAVE INSURANCE AND BECAUSE WE DON'T HAVE THAT MANY, I DON'T KNOW IF ANY OF YOU, I

[00:20:01]

KNOW YOU'VE BEEN LOOKING AT THIS ISSUE, I HAVEN'T LOOKED AT IT, HOW MANY OF THESE LAWSUITS THERE ARE THAT HAVE THAT HAVE PREVAILED BECAUSE A DOG BIT A PERSON AT A DOG PARK.

I WOULD VENTURE TO GUESS THERE AREN'T MACHINE M AND IF THERE ARE PERSON GETS A MILLION DOLLARS FOR GETTING BIT AT A DOG PARK SOMETHING AGREGOUS HAPPENED.

IF THE ENTITY THAT SPONSORED THE DOG PARK THAT OWNED IT WAS THE ONE PAYING DAMAGES, A SOMETHING HAPPENED.

WE HAVE PARKS WITH KIDS RIDING BICYCLES.

NO STAFFING AND WE'RE IMMUNE FROM LIABILITY.

WE HAVEN'T-A LAWSUIT OUT OF THE STATE PARK.

WE'VE HAD BROKEN BONES AND DISLOCATED THIS AND THAT AND LOTS OF STITCHES AND CUTS AND EVERYTHING.

NO LAWSUITS. IN FACT, WE USED TO HAVE STAFF THERE AND IT TURNED OUT TO BE A COST WE DIDN'T NEED TO HAVE.

ONE THING I KNOW ABOUT OUR PARKS AND WE DOMINICAN MAZE SOME OF OUR LIABILITY IS WE OPEN OUR PARKS AAT DAWN AND CLOSE THEM ATTASK. THERE IS NOT A LOCK WITH A BIG CHAIN. IF YOU WALK INTO A PARK AND IT SAYS DAWN TO DUSK AND YOU ARE THERE AFTER DUSK ASSUME SOME OF THAT LIABILITY YOURSELF. ARE THERE QUESTIONS ABOUT THAT?

>> AND I'M GOING STAY AND WAIT FOR MR. COOK TO FINISH IN CASE

YOU HAVE MORE QUESTIONS. >> OK MR. COOK.

[Item 5.2]

>> IT'S NICE TO SEE EVERYBODY HERE AGAIN.

GO OVER WHAT WE DID LAST TIME. I THOUGHT MAYBE I'D TAKE A FEW MINUTES TO GO OVER WHAT THE NEED IS.

WE KIND OF HAVE A TENDENCY TO GET INTO THE WEEDS AND BUSHES ON DIFFERENT THINGS. BASICALLY THERE IS LEASH LAWS IN EFFECT ALL OVER THE ISLAND. IF YOU HAVE A DOG, THAT DOG SHALL BE ON LEASH NOT MORE THAN 16 FEET AS A MATTER OF FACT.

ANYWHERE ON THE ISLAND. WHEREVER YOU TAKE HIM HE'S GOING TO BE ON A LEASH. WHAT THAT MEANS IS DOGS NATURALLY LIKE TO RUN AND PLAY AND DO THEIR THING.

DIFFICULT IF YOU'VE TRIED TO PLAY WITH ANYBODY ON A LEASH.

SO A LOT OF COMMUNITIES AROUND THE COUNTRY HAVE OFF LEASH DOG PARKS. IT'S NOT UNUSUAL.

I THINK JACKSONVILLE HAS FOUR OR FIVE OF THEM.

THEY ARE IN EVERY COMMUNITY. WE CAME FROM ORLANDO.

THEY HAD FOUR OR FIVE THERE. BASICALLY THEY TEND TO BE SELF-GOVERNING. I WAS NOT GOING TO GET INTO THE WEEDS ON RULES AND REGULATIONS TONIGHT.

YOU WILL FIND IF YOU HAVE EVER BEEN TO ONE OF THOSE KIND OF FACILITIES THAT THE PEOPLE THAT ARE IN THERE, THEY MAINTAIN THAT FACILITY, THEY MAINTAIN THE PEOPLE THAT ARE IN THERE.

IN OTHER WORDS IF SOMEBODY IS IN THERE AND THEIR DOG POOPS, THEY GO TO THAT PERSON AND SAY PICK UP YOUR POOP, NOBODY LIKES TO STEP IN IT. IF THEY HAVE AN AGGRESSIVE DOG AND THE DOG STARTS ATTACKING. PEOPLE SAY YOUR DOG OBVIOUSLY IS NOT SUITED HERE. GET HIM UNDER CONTROL OR YOU DON'T NEED TO BE HERE. NOT ALL DOGS ARE FIT TO GO OR SUITED TO GO TO AN OFF LEASH DOG PARK.

THERE ARE SOME REAL TIMID, SOME THAT ARE REAL AGGRESSIVE.

IT NOT FOR EVERYBODY. IT'S A GOOD MEANS TO SOCIALIZE.

BASICALLY ON THE ISLAND WE HAVE ONLY ONE OTHER ALTERNATIVE FOR AN OFF LEASH PARK AND THAT IS HUMANE SOCIETY.

THEY DO A VERY GOOD JOB DOWN THERE.

BUT IT IS A PAID FACILITY. AND THEY HAVE THEIR RULES AND REGULATIONS. PERSIST MT. IT IS IN THE SOUTH E ISLAND. WE'RE NOT TRYING TO COMPETE WITH THE HUMANE SOCIETY. THIS BEING SAID, I THOUGHT THERE WAS A NEED TO HAVE AN OFF LEASH DOG PARK.

[00:25:16]

I WANTED TO SEE WHAT IS AVAILABLE FOR A DOG PARK.

WHAT DO WE NEED. WHAT DO WE HAVE AVAILABLE.

>> THEY DON'T HAVE TO BE EVALUATED ON THEIR MERITS.

WE'RE GOING TO HAVE TO GO THROUGH THE SAME HOOPS THAT EVERYBODY ELSE DOES IN THE CITY. WE'RE GOING TO HAVE TO GO THROUGH TECHNICAL REVIEW COMMITTEE MEETING.

WE'RE GOING TO HAVE TO FIND OUT WHAT THE CITY WANTS AND NEEDS.

HOW WE FIT WITH ALL THE ORDINANCES.

>> I LOOKED AT SOME OF THE NATIONAL STANDARDS FOR DOG PARKS. ONE OF THOSE PLANS HAS GOTTEN CIRCULATED. THERE ARE CERTAIN THINGS YOU WANT TO DO WHEN YOU HAVE A DOG PARK AND IT GOES BACK TO THE LIABILITY ISSUE THAT SOMEBODY IS BRINGING UP.

YOU ARE GOING TO GO TO SOME SORT OF STANDARDS.

YOU HAVE FENCED IN FACILITY. YOU TRY AND KEEP THE BIG DOGS AWAY FROM THE LITTLE DOGS. YOU BASICALLY HAVE BASICALLY I WAS NOT LOOKING AT ALL THE FUTURE AMENITIES YOU CAN PUT IN THERE. BUT YOU ARE GOING TO HAVE BENCHES. I PUT A PLACE FOR ADA IF SOMEBODY THAT COULD NOT GET IN THERE, IF THEY WANT TO SIT AND WATCH ANIMALS, WE'LL NEED TO DO THAT.

WE NEED TO HAVE A BENCH OF SOME SORT, MAKE SURE IT'S COMPATIBLE FOR OUR HANDICAP CITIZENS. KEEP IN MIND THAT WHAT WE'RE ASKING IS JUST APPROVAL TO PROCEED WITH THE CONCEPT OF A DOG PARK. IT WILL BE COMING UP BEFORE THE CITY COMMISSION NEXT MONTH. IT'S ON THE AGENDA.

I'M SURE THAT DIFFERENT COMMISSIONERS ARE GOING TO HAVE THEIR SAY ON WHAT THEY THINK AND HOW THEY THINK.

WE'RE GOING TO HAVE TO MEET THAT.

QUESTION NOW IS WHAT ARE OKAYS THAT PEOPLE WOULD HAVE TO THAT? AND LAST TIME WE GOT INTO THE WEEDS A LITTLE BIT FOR THIS, THAT AND THE OTHER AS FAR AS SOME OF THE ITEMS THAT YOU WERE CONCERNED ABOUT. AND THEY ARE VALID CONCERNS.

LIABILITY IS ONE OF THEM. I CHECKED WITH TAMI AND I SAID THIS IS AN AREA PEOPLE ARE CONCERNED WITH.

SHE SAID I THINK WE GOT THAT COVERED WITH CITY PARKS.

WE HAVE CITY PARKS ALL OVER THE PLACE, WE HAVE DOGS ON LEASHES IN CITY PARKS ALL OVER THE PLACE.

WE HAVE SOMETIMES OBJECTIONABLE SIDES IN CITY PARKS.

IT'S A GROUP OF PEOPLE. AND SO WHAT ARE THE BENEFITS? WHY AM I PUSHING ON THIS? BECAUSE IT DOES SEVERAL THINGS.

IT ENHANCES THE COMMUNITY SAFETY BECAUSE YOU ARE PUTTING DOGS IN A PLACE AND LETTING THEM RUN, YOU ARE GETTING RID OF THEIR ENERGY. YOU ARE ENCOURAGING ADHERENCE TO THE LAW. BECAUSE THIS F THEY TAKE THE DOG OFF THE LEASH SOMEWHERE ELSE THEY ARE SUBJECT TO FINES AND CITATIONS. IT LESSONS COMPLAINTS.

HE'S RUNNING AROUND AND PARKING AND HAVING A GOOD TIME.

HE'S NOT AS FRUSTRATED AS HE WOULD BE AT HOME WALKING AROUND A NEIGHBORHOOD. IT'S A SOCIAL OPPORTUNITY.

PEOPLE WATCH EACH OTHER AND WATCH OUT FOR THE DOGS.

>> I SAW ONE OF THE THINGS WHEN I WAS DOING RESEARCH AND IT ENHANCES CONSERVATION EFFORTS BECAUSE THE DOGS DON'T HAVE ENERGY TO GO OUT AND CHASE WILD ANIMALS BECAUSE THEY GOT A CHANCE TO PLAY WITH OTHER DOGS THERE.

IT'S ALSO A DRAW FOR THIS TOWN. I TALKED WITH PEOPLE DOWNTOWN.

IF YOU NOTICE YOU GO OUT IN THE NEIGHBORHOOD, PEOPLE ARE WALKING

[00:30:05]

THEIR DOGS DOWNTOWN, THEY ARE WALKING THEIR DOGS, IT GIVES PEOPLE IN THE COMMUNITY A PLACE TO HAVE THEIR DOG OFF LEASH FOR A LITTLE BIT, GET RID OF THAT ENERGY AND THEY CAN WALK THEM DOWNTOWN TO VISIT THE DIFFERENT RESTAURANT AND STORES WE HAVE.

IT HAS A LOT OF BENEFITS LIKE A COUPLE OTHER PROBLEMS THAT WERE BROUGHT UP AND I WOULD BRING YOUR ATTENTION TO YOUR EXISTING ORDINANCES SECTION 90.45 SAYS IT SHOULD BE DUTY OF EACH PERSON IN THE COMPANY OR RESPONSIBLE FOR A DOG IN AREAS OTHER THAN THE PROPERTY OF SUCH PERSON TO REMOVE ANY FECES LEFT BY THE DOG IN ANY SIDEWALK, GUTTER OR STREET.

IT SHALL BE THE PERSON WITH A DOG TO HAVE IN HIS OR HER POSSESSION A POOPER SCOOPER OR OTHER SIMILAR DEVICE.

ANY PERSON VIOLATE THIS IS SECTION CAN RECEIVE A CITATION AND A PENALTY. SO YOUR ORDINANCE COVERS THAT ASPECT. AND SECTION 18.4 UNDER OWNER EXERCISE CARE. IT HALL INTEREST UNLAWFUL FOR THE OWNER OF AN ANIMAL TO MAKE SOUNDS PERSISTLY OR CONTINUOUSLY. THAT IS ONE OF YOUR ORDINANCE

ITEMS. >> ANIMAL WASTE WE'VE TALKED ABOUT THAT. THE OWNER OF EVERY ANIMAL SHALL BE RESPONSIBLE FOR THE REMOVAL OF SECRETION DEPOSITED BY THAT ANIMAL. ONE OF THE QUESTIONS WAS OK WE'VE GOT ALL THESE -- DID YOU KNOW THAT? THEY POOP IN PUBLIC AND THEY HAVE BEEN KNOWN TO PEE ON TREES AND STUFF. WE NEED TO WATCH THESE ANIMALS.

AND WE NEED TO MAKE SURE THAT THEY ARE PROPERLY VACCINATED AND THEY ARE TAKEN CARE OF. NOW ANYBODY THAT HAS GOT A DOG THAT CARES AND THESE ARE THE KIND OF PEOPLE THAT WOULD TAKE THEIR DOG TO AN OFF LEASH DOG PARK, THEY MAKE SURE THEY ARE VACCINATED. THEY MAKE SURE IT'S TAKEN CARE OF. FIRST THING THAT HAPPENS WHEN YOUR DOG GETS SICK, YOU GO RUNNING TO THE VET.

YOU ARE GOING TO TAKE CARE OF THEM.

ARTICLE TWO LICENSING AND BITING.

LICENSE REQUIREMENTS. NO PERSON SHALL OWN OR HARBOR ANY CAT OR DOG UNDER FOUR MONTHS OF AGE UNLESS SUCH DOG OR CAT IS VACCINATED. IT'S ALREADY IN YOUR ORDINANCE.

I'M NOT A BIG PROPONENT OF MAKING MORE LAWS OR REGULATIONS WHEN YOU ALREADY HAVE ITEMS TAKEN CARE OF AND ARE HANDLED.

ALL SUCH ANIMALS SHALL HAVE PROOF OF A RABIES VACCINATION MEETING THE STANDARDS OF THE CHAPTER.

SECTION 18.23 FINES. UNRESTRAINED DOGS AND NUISANCE ANIMALS SHALL BE TAKEN BY A POLICE OFFICER OR HUMANE CONTROL OFFICE. THERE IS FINES, THERE IS PENALTIES. YOU ALREADY HAVE IN YOUR CITY ORDINANCE WAYS TO HANDLE THE SITUATION THAT PEOPLE BROUGHT UP. SO I WOULD URGE YOU AS A BOARD TO BASICALLY PRESENT A MOTION TO ENDORSE THE CONCEPT OF AN OFF LEASH DOG PARK FOR THE CITY OF FERNANDINA BEACH.

I'LL BE GLAD TO ANSWER ANY QUESTIONS THAT YOU MAY HAVE NOW.

>> I WAS NOT AT THE LAST MEETING BUT I DID WATCH THE VIDEO.

I WANT TO MAKE SOME POINT. >> YOU ESTIMATE THIS WOULD REQUIRE A $42,000 INVESTMENT FROM THE CITY?

>> I DID A BUDGET BASED UPON THAT ONE SITE PLAN WE DID.

BASICALLY THAT WAS THE NUMBERS ON THAT.

IT CAN VARY. HASN'T BEEN THROUGH TRC OR ANY OF THOSE THINGS. BASICALLY THAT WAS GETTING YOUR FENCES, GETTING YOUR BENCHES AND WATERING STATIONS, THAT SORT OF THING. THAT SHOULD BE A GOOD ESTIMATE.

I DIDN'T WANT TO PRESENT SOMETHING AND THEN HAVE IT COME IN WAY OVER BUDGET OR SOMETHING LIKE.

THAT I WANTED MY NUMBERS TO BE ACCURATE.

MY BACKGROUND IS GENERAL CONTRACTOR SO I DID A PRETTY

DETAILED STUDY. >> THE OTHER QUESTION THE DISCUSSION GOT A LITTLE BIT CONVOLUTED IN MY OPINION TOWARD THE END. I'M NOT CLEAR WHO YOU SEE AS THE

[00:35:03]

USERS OF THIS PARK. I'M NOT CLEAR IF YOU ARE LOOKING AT RESIDENTS, THE COMMUNITY, VISITORS, I'M NOT CLEAR.

>> USERS ARE THE RESIDENTS OF THE COMMUNITY.

>> OF THE COMMUNITY OR OF THE CITY.

>> CITY. >> THOSE ARE TWO DIFFERENT

THINGS. >> CITY.

>> VISITORS WOULD NOT BE PERMITTED TO USE THE PARK?

>> THAT'S SOMETHING THAT SOMEBODY ELSE -- I THINK IT'S SOMETHING THAT MAYBE PARKS AND RECREATION NEEDS TO COME INTO WHETHER YOU LET OTHER PEOPLE GO. IF THEY DO, ONE OF THE THINGS I HAD PRESENTED BEFORE THERE IS RULES AND REGULATIONS SAYING ALL DOGS MUST BE PROPERLY VACCINATE AND MUST BE PROPERLY GIVEN THEIR SHOTS AND EVERYTHING. SO THAT WOULD BE THE ISSUE I WOULD HAVE WITH DOGS FROM THE COMMUNITY IS JUST MAKE SURE THEY

ARE LICENSED. >> IT'S JUST A PUBLIC TYPE OF

OBLIGATION. >> AND THE OTHER QUESTION I HAVE IS WE DO HAVE ORDINANCES BUT ONLY THE CITY OR CITY STAFF CAN ENFORCE ORDINANCES. IF THERE WAS SOME ISSUE THERE IT WOULD REQUIRE POLICE OR RECREATION STAFF MEMBER TO GET INVOLVED TO ENFORCE THE ORDINANCE.

>> CORRECT. JUST THE SAME AS ANYBODY ELSE OR

WALKING DRUNK ON THE STREETS. >> ALL OF THE ORDINANCES ARE UNDER CHAPTER 18 OF THE CODE. WE DIDN'T SPEAK ABOUT THIS.

GOOD JOB FINDING ALL THE APPLICABLE ORDINANCES.

CHAPTER 18 IS WE ENFORCE THAT SO THAT IS NOT PICKING UP AFTER YOUR DOG, DOGS NOT BEING ON A LEASH, SAME THING WITH WHETHER IT'S ON THE BEACH OR WALKING DOWN THE STREET.

THOSE ARE ENFORCED THROUGH CITATIONS AND THEY ARE $100 CITATIONS TO START. AND ANY --

. >> AN EMPLOYEE HAS TO ENFORCE IT. A VOLUNTEER CAN'T ENFORCE THAT?

>> NO. NOT UNLESS WE HAVE BEACH RANGERS THAT YES WE PAY A LITTLE BIT TOO.

BUT AT FIRST THEY WERE VOLUNTEERS.

THE CITY CAN DEPUTIZE VOLUNTEERS AND TRAIN THEM TO DO THAT TYPE OF THING. THEY ARE COVERED BY THE CITY'S INSURANCE. THEY ARE COVERED BY WORKERS COMPENSATION. AND WE WOULD HAVE TO WRITE IT IN THE ORDINANCE WHERE WE DEFINE CODE ENFORCEMENT OFFICER.

>> YOU MENTIONED THAT THERE WERE OTHER SITES IN THE CITY FOR A

DOG PARK. >> THERE IS ONE OTHER OFF LEASH FACILITY THAT IS THE HUMANE SOCIETY RUNS I.

>> I THINK YOU MENTIONED ABOUT OTHER SITES BEING EVALUATED FOR

A DOG PARK. >> YES.

>> SO THIS PARTICULAR DOG PARK THAT YOU ARE ASKING FOR IS AT

THIS PARTICULAR PROPERTY? >> I'M NOT ASKING FOR A PARTICULAR SITE. I'M ASKING THE BOARD IN GENERAL TO APPROVE THE CONCEPT OF AN OFF LEASH DOG PARK SUBJECT TO MEETING ZONING, MEETING TECHNICAL REVIEW COMMITTEE.

MEETING SITE PLANS AND COUNCIL. IT'S NOT SPECIFIC.

>> SO THE $42,000 MAY BE SOME OTHER NUMBER IF IT'S AT ANOTHER

SITE. >> CORRECT.

>> SPEAKING OF THE 42,000, I'M WONDERING IF YOU DID DIFFERENT FINANCIAL MODELING TO HIGH LEVEL DONATIONS AND IF THE CITY HAD A LOWER BUDGET, WOULD THERE BE FLEXIBILITY THERE WHERE A GREATER PERCENTAGE OF THE TOTAL COST WOULD BE COVERED BY THE

PARTICIPANTS? >> AND THAT'S AN OPTION, DEFINITELY AN OPTION. I THINK NOT TO BRING UP A SORE SUBJECT, BUT I SEE ON SIMMONS PARK THAT 8 FLAGS IS SELLING BENCHES AND BRICKS DOWN THERE THAT ASSUME IS GOING TOWARDS COVERING THE COST OF THAT. SO I WOULD THINK THAT WE COULD GET -- I'VE HAD OFFERS FROM SOME OF THE OWNERS OF DIFFERENT BUSINESSES TO OFFER TO PITCH IN ONCE WE GET AN APPROVAL AND ONCE WE GET A SITE. SO I WAS TRYING TO SET AN UPPER LIMIT AND THEN SAY THAT'S THE LIMIT YOU ARE ALLOWED $42,000 FOR THIS AND THAT HAVE TO BE THAT SPECIFIC SITE SO THAT WE HAD A NUMBER. BECAUSE IT DRIVES ME NUTS TO SEE GOVERNMENT GO HAVE A PROJECT AND IT GOES OUT OF WHACK ALL THE TIME BECAUSE THEY DON'T HAVE A PROJECT MANAGER OR ANYBODY

WATCHING OVER THE NUMBERS. >> HAVE YOU EVER CONSIDERED HAVING A KEY CARD AND THEN HAVING PEOPLE PERHAPS PURCHASE

[00:40:04]

THE KEY CARD AT SOME MODEST COST SO THERE IS ADDITIONAL REVENUE

FROM THE PARTICIPANTS? >> THAT IS AN OPTION.

THAT WOULD HAVE TO BE THROUGH PARKS AND RECOMMEND NATION.

I UNDERSTAND YOU HAVE A NEED. I UNDERSTAND WE HAVE LIMITED STAFF. WE'VE ALSO BEEN ASKED TO PROVIDE A LOT OF EQUIPMENT TO BE ADA COMPLIANT IN OUR PARKS WHICH IS A VERY EXPENSIVE ENDEAVOR. IS IT POSSIBLE THERE A WAY TO WORK IT OUT WHERE THE CITY COULD THREE'S PROPERTY TO A NONPROFIT ORGANIZATION WHICH RUNS THE DOG PARK FOR $1 AND THEREFORE THE STAFF -- NO STAFF FROM THE CITY INVOLVED? I LIKE YOUR IDEA OF SELF-GOVERNING SO YOU WOULD BE COMPLETELY IN CONTROL. WHATEVER THE DOG PARK PERSONS WOULD LIKE TO CONTRIBUTE TO PUTTING THE SITE TOGETHER WOULD BE CERTAINLY SOMETHING THAT COULD BE WORKED TOWARD.

I REALLY WOULD PREFER THAT YOU WANT TO SELF-GOVERN, HAVE YOUR RULES. I THINK IT WOULD BE A MUCH MORE PPAM LATTABLE OPTION IN MY OPINION.

>> TO ANSWER YOUR COMMENT AND COMMISSIONER ROSS SAID SET UP A NONPROFIT AND MAYBE IN TWO OR THREE YEARS WE CAN DO THIS.

I DON'T THINK WE NEED TO DO THAT.

THIS IS NOT A LOT OF EXPENSES COMPARED TO SOME OF THE OTHER THINGS GOING ON. WE CAN ACCOMPLISH AND SHOW THE CITIZENS WE'RE GIVING THEM SOMETHING FOR THEIR MONEY.

THAT IS MY ANSWER. >> CONSERVATION LAND, WE HAVE BEEN FORTUNATE IN HAVING A LOT OF DOLLARS PUT IN THE POT.

WE DO HAVE A FAIR AMOUNT OF CITIZENS HERE WHO ARE MORE THAN HAPPY TO GIVE FUNDS. YOU MAY WANT TO CONSIDER STARTING TO ASK FOR THOSE FUNDS AND SEE IF YOU CAN GET SOME SORT OF CONTRIBUTION MA MAYBE THE CITY MIGHT BE ABLE TO MATCH.

>> I HAVE SOME QUESTIONS. >> YOU PUT A LOT OF WORK INTO THIS AND I APPRECIATE I. I'M ASSUMING IN YOUR RESEARCH YOU REACHED OUT TO THE HUMANE SOCIETY?

>> TO WHO? >> THE HUMANE SOCIETY?

>> I'VE TOUCHED BASE WITH PEOPLE IN THE HUMANE SOCIETY YES.

>> WHAT FEEDBACK DID YOU GET? >> NOT REALLY ANY FEEDBACK PARTICULARLY. THEY GO IN A SEPARATE DIRECTION WE DO. THIS WOULDN'T AFFECT THEIR OPERATION. THEIR OFF LEASH PARK IS JUST AN ADJUNCT TO THEIR OPERATION WHICH IS RESCUE.

THEIR BIG MISSION IS RESCUE. THEY ARE COUNTY WIDE.

THEY GO OVER THE WHOLE COUNTY. IT'S ALMOST A SERVICE TO THEIR PEOPLE TO HAVE A DOG PARK. THEIR GOING PARK IS VERY NICE.

THEY HAVE WATER FEATURES AND THIS AND THAT.

I HAVE TALKED TO A LOT OF PEOPLE THAT SAY THE $10 FEE A DAY OR $36 A MONTH AND THE SITUATION DOWN THERE IS NOT THEIR PARTICULAR TYPE OF SITUATION. THEY WOULD LIKE THE OPPORTUNITY TO HAVE A CITY SPONSORED DOG PARK.

THEIR MAIN RESCUE IS MISSION. THAT PROVIDE A SIGNIFICANT AMOUNT OF REVENUE HELP THEM FULFILL THAT MISSION.

AND IT SEEMS TO ME THERE MIGHT BE A WAY THAT TO LEVERAGE THE FUNDRAISING THAT YOU FEEL CONFIDENT ABOUT TO IMPROVE THAT DOG PARK OR HELP THE HUMANE SOCIETY INSTEAD OF DUPLICATING OR COMPETING AGAINST THE SERVICES THEY ARE PROVIDING.

THEY HAVE THE CONTRACT AT THIS TIME WITH THE CITY TO PROVIDE ANIMAL CONTROL. NOT ONLY WOULD A DOG PARK IN A DIFFERENT LOCATION TAKE AWAY RESOURCES THEY NEED FOR THEIR SHELTER, BUT IT WOULD ALSO USE SOMETHING IN THE UNFORTUNATE EVENT SOMETHING DOES HAPPEN, IT WOULD BE THEIR RESOURCES THAT WOULD BE CALLED BECAUSE THEY ARE ANIMAL CONTROL FACILITATOR AT

[00:45:01]

THIS TIME. AND THEY ALSO DID SAY THAT THEY ARE EXTENDING THEIR HOURS BECAUSE THEY'VE HEARD FEEDBACK THEIR HOURS AREN'T LONG ENOUGH. AND THEY ARE NOT AT CAPACITY.

THEY HAVE SPACE TO ACCOMMODATE PEOPLE.

YOU'VE MADE A GOOD CASE. I AM THE KIND OF PERSON THAT HAS A DOG I CAN'T TAKE TO A DOG PARK.

I'VE NEVER BEEN TO A DOG PARK. YOU MADE A GREAT CASE FOR A DOG PARK IN GENERAL. BUT OUR COMMUNITY HAS ONEFUL IT'S ON CITY LEASED LAND. AND THE HUMANE SOCIETY DOES DO AN EXCELLENT JOB IN THEIR MISSION.

WE HAVE A NO KILL SHELTER WHICH IS WONDERFUL.

I THINK IT WOULD BE THAT MAYBE THERE ARE SOME OTHER WAYS.

MAYBE YOU CAN FUNDRAISE TO GROW THAT PARK IN A WAY THIS BETTER SUITS THE NEED OF THE COMMUNITY. BUT THERE MIGHT BE SOME WAYS TO DO THAT WITHOUT HURTING AN EXISTING ORGANIZATION HERE DOING

GOOD WORK IN THE COMMUNITY. >> IF I MAY ANSWER SOME OF YOUR OBJECTIONS THERE. I DON'T THINK THEIR DOG PARK IS A SIGNIFICANT PART OF THEIR BUDGET.

I THINK IT'S LIKE 60,000 OUT OF $800,000 BUDGET.

THEY GET $600,000 IN DONATIONS FROM THE COMMUNITY FROM THE COUNTY EACH YEAR PLUS THEY MAKE ABOUT 200,000 IN THEIR STORES.

THAT IS A PRETTY GOOD REVENUE STREAM.

I DON'T THINK THAT THAT PARTICULAR ANOTHER DOG PARK WILL HURT THEIR MISSION AS FAR AS THAT GOES.

IT'S JUST NOT PART OF THAT PROCESS.

AS FAR AS THE TAKING RESOURCE AS WAY.

IT'S MY UNDERSTANDING THAT CITY PROVIDE A CAR AND PAYS FOR THE EXPENSES FOR SOME OF THE DOG CONTROL.

THE CITY ALREADY PICKING UP A PIECE OF THAT VERY WELL RECEIVED AND NEEDED FACILITY. I DON'T THINK WHEN YOU MAKE IT IN TERMS OF THE HUMANE SOCIETY VERSUS PEOPLE THAT WANT AN OFF LEASH DOG PARK, I DON'T THINK THAT IS A FAIR EXAMPLE OF -- I THINK IT'S JUST MORE -- I DON'T THINK WE NEED TO CONFINE EVERYBODY TO SIGNING THREE PAGES OF WITH HOLDING LIABILITY, HAVING THEIR DOG SPADE, GETTING ON THE LIST, AND PAYING THE MONEY JUST TO GO TO A DOG PARK. THAT'S THE SITUATION YOU HAVE.

I HAVE NOTHING AGAINST THE HUMANE SOCIETY.

I THINK THEY DO A GREAT JOB. I THINK THERE SHOULD BE ANOTHER VENUE. WE HAVE THE CITY, WE HAVE ENOUGH PEOPLE INTERESTED IN IT. IT SHOULDN'T BE HUMANE SOCIETY VERSUS A DOG OWNER SITUATION. I DON'T THINK IT SHOULD BE.

>> I DIDN'T INTEND TO MAKE IT THAT WAY.

I WANTED YOU TO KNOW I FEEL LIKE THE HUMANE SOCIETY SHOULD BE BROUGHT TO THE TABLE IN THIS DISCUSSION BECAUSE IT DOES IMPACT THEM. MAYBE NOT SIGNIFICANTLY.

>> I HAD A LADY COME UP TO ME AND SAID YOU ARE GOING TO BANKRUPT THE HUMANE SOCIETY. I'M GOING WHAT.

SO I WENT AND LOOKED AT THE 990'S WHICH ARE THE FORMS THAT THE HUMANE SOCIETY HAS TO FILE. AND I WENT IN THERE TO LOOK AT THE FINANCIALS. THAT'S WHERE THAT CAME FROM.

I DON'T WANT TO TAKE A SIGNIFICANT PORTION OF REVENUE AWAY. WHEN YOU ARE GETTING $600,000 IN DONATIONS FROM BUSINESSES ALL OVER THE COUNTY, I'M CERTAIN THIS LITTLE $42,000 PARK IS NOT GOING TO AFFECT ANYTIME ANY

SIGNIFICANT MANNER. >> MY NEXT QUESTION IS SO YOU DON'T INTEND TO FILE A 501C3 FOR THE FUNDRAISING ASPECT OF THIS.

>> THAT WAS NOT MY INTENTION. IF YOU GO THAT ROUTE AND COMMISSIONER ROSS SUGGESTED IT, THEN IT'S GOING TO TAKE A COME OF YEARS TO GET IT DONE. IF WE COULD JUST GO AHEAD AND GET IT DONE. IT WOULD BE VERY GOOD TO HAVE THINGS HAPPEN IN THIS CITY IN AN EFFICIENT QUICK EXPEDIENT MANNER AND MEET A BUDGET. I THINK WE NEED THAT.

>> AND WHAT PROTECTION WILL YOU HAVE FOR PEOPLE WHO MAKE DONATIONS IF THE PARK DOES NOT GET BUILT IF YOU FUNDRAISE

BEFORE IT'S BEEN DESIGNED? >> WHAT MY THINKING WAS LET'S GET ATE PROVED. LET'S GET THE CONCEPT OF THE DOG PARK APPROVED. LET'S GET A ROUGH BUDGET APPROVED. THEN WE HAVE TO MEET THE DETAILS. ONCE WE GET IT APPROVED, ONCE WE GET A SITE PICKED THAT MEETS THE SITE I CAN'T.

THEN WE COULD GET OUR DONATIONS YOU DON'T EVEN KNOW WE'RE GOING TO GET. YOU GUYS COULD SAY NO, WE DON'T

[00:50:03]

WANT A DOG PARK. FINE.

SO WHY WOULD I GET COMMITMENTS FROM SOMEBODY TO GIVE ME MONEY THERE A PARK IF IT'S NOT APPROVED YET.

>> ABSOLUTELY. SHOULD IT BE APPROVED BY APRIL WITHOUT A 501C3 FOR YOUR FUNDRAISING WHAT PROTECTIONS DO YOU HAVE? THE COMMISSION COULD DECIDE THEY DON'T WANT THE DOG PARK, WHAT PROTECTIONS DO YOU HAVE IF YOU DON'T HAVE A 501C3 , WHAT IS HOLDING YOU?

>> YOUR FUNDRAISING AS A PRIVATE CITIZEN AND NOT AS AN

ORGANIZATION. >> I SAID I DIDN'T WANT TO DO THAT. WHAT ARE WE TALKING ABOUT.

>> YOU WANTED TO FUNDRAISE AS A PRIVATE CITIZEN.

THAT'S HOW YOU FORESEE THE FUNDRAISING FOR THIS?

>> YOU ARE TALKING ABOUT FUNDRAISING.

I'M THINKING IN TERMS OF WE HAVE AN APPROVED DOG PARK.

WE HAVE AAN APPROVED PLAN THE STAFF APPROVED.

THEN THEY HOWEVER IT GETS HANDLED CAN SAY WE WILL PAY FOR EVENTS. AND THEN THAT BENCH IS PAID FOR.

NAN TAKES THIS OUT OF HER BUDGET BECAUSE IT SPOKEN FOR.

DOES THAT MAKE SENSE? >> IT DOES.

HOWEVER YOU BROUGHT UP -- I DID NOT.

>> THEY ARE A NONPROFIT AS WELL IN THIS COMMUNITY THAT'S DONE A NUMBER OF PROJECTS AND THEY ARE A REGISTERED 501C3.

THEY ARE FUNDRAISING ON BEHALF OF THEIR ORGANIZATION.

THEY HAVE COMMITTED THE AMOUNT OF MONEY THEY ARE GOING TO GIVE TO OFFSET THE COST OF THAT PARK. PLAY SKIES COMMITTED TO RAISING

X AMOUNT OF DOLLARS. >> I'M NOT FAMILIAR WITH THE EXACT AMOUNT THAT THEY SAID. AND I'M NOT FAMILIAR --

>> IT'S IRRELEVANT TO THIS. $2,000 FOR A BENCH I THINK IS EXTRAVAGANT IF YOU ARE FUNDRAISING.

>> WHAT I'M SAYING IS THERE WAS A COMMITMENT TO HOW MUCH MONEY THEY WERE WILLING TO RAISE TO OFFSET THE COST.

>> THE CITY COMMISSION CAN SAY WE WILL FUND 75% OF IT OR WE WILL FUND 60% OF IT. THEY CAN DO WHATEVER THEY WANT WHEN IT COMES TO THEM. AND WE'LL HAVE TO DO WHAT WE NEED TO DO TO GET IT FUNDRAISED. I'M NOT SURE.

>> THERE ARE SEVERAL PEOPLE IN THE AUDIENCE WHO WOULD LIKE TO SPEAK. I THINK WE SHOULD LET WHOEVER WANTS TO SPEAK. WE HAVE SPENT 50 MINUTES ON THIS TOPIC. WE HAVE THE WATER FRONT PARK.

>> YOU HAVE REACHED OUT TO THE NEIGHBORS TO THE WEST?

>> TO THE NEIGHBORS TO THE WEST. REACHED OUT TO ONE OF THEM THAT HAD A DOG. THEY ARE IN FAVOR OF IT.

THE OTHER PEOPLE FROM WHAT I UNDERSTAND FROM THE STAFF AND I'M TALKING TO YOU GUYS FROM WHAT I UNDERSTAND FROM CITY STAFF, THERE ARE SOME PEOPLE THIS THOSE HOUSES, THERE ARE FOUR OR FIVE HOUSES RIGHT THERE THAT HAVE COMPLAINED CONTINUOUSLY OVER THE LAST TWO YEARS OF ANYTHING THAT THE CITY HAS DONE OVER THERE. THE CITY HAS HAD COMPLAINTS BECAUSE THEY PARKED EQUIPMENT THERE.

THE CITY HAD COMPLAINTS BECAUSE THEY PUT MATERIALS THERE.

SO NO MATTER WHAT YOU DO, THOSE PEOPLE A TO COMPLAIN.

DID I GO TALK TO THOSE PEOPLE NO, BECAUSE I KNOW WHAT THE ANSWER IS GOING TO BE. THEY DON'T WANT ANYTHING.

[Item 6.1]

>> >> I'M NOT A DOG OWNER.

I DON'T HAVE ANYTHING AGAINST DOGS.

THAT I BELIEVE GOD SAID EVERYTHING HE MADE WAS GOOD AND VERY GOOD. IF YOU DECIDE TO OWN A DOG, THAT I BELIEVE IS YOUR RESPONSIBILITY.

I DIDN'T LIKE THE WAY HE SAID THOSE PEOPLE.

[00:55:09]

CONSIDER THOSE PEOPLE TOO. IF THERE IS CITY WANTS TO TAKE THE MONEY AND DO IT. I THINK IT COULD BE BETTER USED.

I'M NOT THAT -- I'M QUITE SURE OUR POLICE DEPARTMENT IS UNDER PAID. THEY PROTECT US NIGHT AND DAY.

IS. >> I AGREE THAT THE CITY HAS A LOT OF OTHER EXPENSES AND A LOT OF OTHER RESPONSIBILITIES.

AND I JUST DON'T THINK THAT RIGHT NOW THIS IS WHERE WE NEED TO BE PUTTING OUR MONEY. MR. COOK COMPLAINS ABOUT THE REGULATIONS AT THE HUMANE SOCIETY.

THOSE ARE THE REGULATIONS THAT ARE RECOMMENDED FOR ANYBODY HAVING A DOG PARK THAT YOU SHOULD HAVE.

LIMITS ON AGES. YOU SHOULDN'T HAVE YOUNG CHILDREN IN THERE. ALL OF THESE THINGS HE DOESN'T WANT YOU TO HAVE ARE THINGS THAT INCREASE THE RISK OF SOMEBODY GETTING HURT. AND SO I JUST THINK THAT WE NEED TO -- AND I WENT TO THE JOINT SCHOOL BOARD CITY COMMISSION MEETING AND THEY ARE NOT IN FAVOR OF HAVING A DOG PARK RIGHT NEXT DOOR. THEY HAVE CLASSES AND THE NOISE WOULD BE AN ISSUE. MR. BUNCH SAID IF HE WERE FORCED TO COME IN FROM A DIFFERENT DIRECTION THAT WOULD BE AN INCONVENIENCE. MR. COOK MADE IT SOUND LIKE HE WAS ON BOARD WITH MAKING THAT CHANGE.

I THINK A LOCATION IN AN URBAN AREA ACROSS FROM THESE PEOPLE'S HOUSES IS NOT THE RIGHT PLACE FAIR DOG PARK.

THANK YOU. >> I'M PEARL KING.

WE GREW UP PLAYING SOFTBALL, VOLLEYBALL, ANYTHING RIGHT HERE.

I LIVE RIGHT HERE WITH MY FATHER.

I DID NOT ATTEND FIRST MEETING. I DID NOT ATTEND ANY MEETING THAT INVOLVES THIS. I FOUND OUT ABOUT IT TODAY.

SO I AM HERE TO SAY FIND ANOTHER LOCATION WOULD BE A BETTER MOVE IF YOU ARE GOING DO IT AT ALL. IS IT A NECESSARY ANY NO.

IS IT SOMETHING THAT PEOPLE WHO LOVE DOGS LIKE TO HAVE? POSSIBILITY. BUT MY QUESTION RIGHT NOW IS DID ANYBODY MR. COOK, MY NEXT QUESTION DID YOU ASK ANY OF THESE PEOPLE HOW THEY FELT ABOUT IT? YOU SAID EARLIER YOU HAD 200 RESPONSES.

I WOULD LIKE TO SEE THOSE IF THEY ARE AVAILABLE.

>> I DON'T HAVE ANY IN MY POSSESSION.

I DON'T KNOW IF PARKS AND REC DOES.

>> WE DON'T HAVE ANY OUR POSSESSION, PARKS AND REC.

>> I AM A VETERAN IN THE UNITED STATES AIR FORCE, 24 YEARS.

COMING HOME TO THIS PLACE IS A TREASURE.

A DOG PARK ACROSS THE STREET FROM SENIOR CITIZENS WOULD BE A BAD MOVE. THANK YOU.

>> THANK YOU FOR YOUR SERVICE. >> CLARENCE BROWN.

[01:00:01]

>> HELLO EVERYONE. GOOD TO SEE YOU.

>> FIRST THING I'D LIKE TO SAY IS I COMMEND Y'ALL FOR THE QUESTIONS YOU ARE ASKING. IT'S VERY GOOD.

AND I APPRECIATE YOU CONSIDERING US EVEN THOUGH MR. COOK DIDN'T.

WE LIVE RIGHT ACROSS -- RIGHT NEXT DOOR TO IT.

AND WE JUST FOUND OUT TODAY ABOUT TWO OR THREE HOURS AGO.

AND WHEN I FOUND OUT RIGHT AWAY I SAID I HAD TO COME DOWN HERE BECAUSE WE DON'T DESIRE THAT DOG PARK TO BE ACROSS FROM IN FRONT OF OUR HOUSE. AND THERE ARE MANY REASONS WHY BECAUSE THE COMMUNITY IS ALWAYS PEACEFUL AND WE GOT ENOUGH TROUBLE OUT OF RUN AWAY DOGS, STREET DOGS.

AND WE DON'T HAVE WE SHOULDN'T HAVE PROBLEMS OUT OF DOGS YAPPING, BEING WALKED. I FELT DISRESPECTED HE DIDN'T GO TO US. HE NEVER FOUND OUT WHY WE COMPLAINED TO THE CITY. RIGHT ACROSS FROM OUR STREET THEY PUT ALL KIND OF TRASH AND DUMPED TREES AND ALL KIND OF THINGS IN OUR DOORWAY WHEN WE COME OUT, THIS IS WHAT WE SEE.

HE DIDN'T WANT TO FIND THAT OUT SEE.

AND THIS IS WHY WE COMPLAIN. REJUST HOPING Y'ALL DISAPPROVE IT. IF THEY WANT TO PUT THE PARK SOME PLACE ELSE THAT'S FINE WITH ME.

I HAVE NOTHING AGAINST DOGS OR DOG OWNERS.

I HAVE A PROBLEM WITH HIM DISRESPECTING ME AS A HUMAN BEING. THANK YOU.

>> THAT'S THE LAST PUBLIC COMMENT.

MY NAME IS CHIP ROSS. IT'S BEEN A LONG DAY.

I'VE WORKED LAST TWO DAYS IN THE EMERGENCY ROOM.

I APOLOGIZE. I HAD MET WITH MR. COOK AND MANY PEOPLE. I'M ALSO A CITY COMMISSIONER.

I'VE WORKED WITH MR. COOK AND MET WITH HIM SEVERAL TIMES.

I DON'T BELIEVE SO AND IF I DID SAY THIS IF IT WOULD TAKE TWO OR THREE YEARS IN A NONPROFIT. THAT'S THE THIRD LARGEST EXPENSE IN THIS CITY. OF THAT THERE ARE MANY INFRASTRUCTURE NEED THAT NEED TO BE FIXED.

WE'RE TALK ABOUT SOMEWHERE BETWEEN 20 AND $30 MILLION.

WE NEED TO START FOCUSING AS A CITY AND WE CAN'T CONTINUE TO RAISE TAXES. WE CAN'T AFFORD THAT.

IT'S PUSHING PEOPLE OUT OF HERE. WE NEED TO STAY WITHIN OUR MEANS. AND SO ADDING NEW THINGS LIKE A DOG PARK OR OTHER PARKS, I VOTED AGAINST ROAD FOR THAT PURPOSE.

WE CAN'T AFFORD IT. WE NEED TO FIGURE OUT AS A COMMUNITY WHAT WE HAVE THIS IS A GREAT PLACE TO LIVE IT IT'S FANTASTIC. IT'S GOT TO DO WITH WHAT WE GOT.

AND WE CAN'T KEEP ADDING. THERE IS ONLY 12,000 PEOPLE THAT LIVE HERE. AND MY OTHER POINT IS A LOT OF

[01:05:03]

THESE THINGS LIKE DOG PARKS ARE USED BY THE COUNTY RESIDENT.

WE'RE SUBSIDIZED THE COUNTY RESIDENTS.

WE NEED TO DO A WATER FRONT DOWNTOWN.

WE CAN'T KEEP ADDING THINGS. SO IF YOU ARE GOING TO DO A DOG PARK, THEN YOU NEED TO COME UP WITH WHAT ARE YOU GOING TO GET RID OF. THIS IS MY HOME.

I HAVE EVERYBODY ON THIS STREET IS MY FAMILY.

AND I'VE GROWN UP IN THIS AREA. I HAVE SMALL CHILDREN.

I HAVE 28 NIECES AND NEPHEWS. ALL OUR KIDS PLAY UP AND DOWN THE STREETS. AND THE CHILDREN IN THE NEIGHBORHOOD THEY WALK, THERE IS BUS STOPS.

AND EVERYONE IS NOT GOING THE ALWAYS GOVERN THEIR DOGS.

WE ARE ANIMAL LOVERS SO YOUR ANIMALS BECOME YOUR FAMILY MEMBERS. YOU LOOK AT OH THIS IS MY BABY AND MY BABY ISN'T ALWAYS GOING TO BE ON A LEASH.

YOUR BABY DOESN'T KNOW MY CHILD. NOW MY CHILD IS AT RISK FOR BEING BIT OR ATTACKED BECAUSE HE'S RIDING HIS BIKE IN THIS LOCATION WHICH IS A RESIDENTIAL LOCATION.

WE HAVE FAMILY GET TOGETHERS AND I DON'T WANT TO BE OUTSIDE BARBECUING SMELLING DOG POOP. THAT'S NOT WHAT I WANT TO DO.

THAT'S NOT WHY I'M PAYING CITY TAXES.

I ALSO FEEL AS A RESIDENT THAT MR. COOK YOU DID A WONDERFUL JOB ON YOUR PRESENTATION BUT DOING YOUR DUE DILIGENCE EVEN IF YOU DON'T WANT TO HEAR THE CONS, WE DO OUR DUE DILIGENCE AND THE PROS AND THE CONS. THAT IS GOING TO EVERYONE.

YOU SHOULD HAVE FIRST STARTED WITH THE PEOPLE THAT LIVE ON THE STREET. HEY, HOW DO YOU FEEL ABOUT A DOG PARK IN FRONT OF YOUR HOUSE. HOW DO YOU FEEL ABOUT A DOG PARK PERIOD? AND THAT WOULD HAVE TAKEN IT TO A WHOLE OTHER DIRECTION. AND THEN OPEN UP THE CONVERSATION AS TO WHY. AND WHEN YOU ARE HAVING AN OPEN DISCUSSION YOU LISTEN TO BOTH SIDES.

AND THEN YOU COME TO A HAPPY MED.

AM I OTHER O' POSED TO A DOG PARK IN AMELIA I'LL UNDERSTAND I DON'T OWN A DOG. I HAVE FAMILY MEMBERS THAT DO.

I DON'T WANT IT ON THIS STREET. I WOULD ASK TO YOU CONSIDER OTHER LOCATIONS. AS A TEACHER $42,000 WOULD LOOK REAL NICE IN OUR SALARIES. IF YOU WANT TO PUT MONEY ANYWHERE PLEASE PUT IT IN THE SCHOOL SYSTEMS. OR PLEASE HELP OUR AFTER SCHOOL PROGRAMS, WE NEED I.

THERE ARE OTHER THINGS THAT WE COULD DO WITH $42,000 OTHER THAN A DOG PARK. OUR CITY PARKS ARE BEAUTIFUL.

>> THAT'S JUST MY TWO CENTS AND THANK YOU FOR ALLOWING ME TO BE

HERE. >> LET ME SAY SEVERAL THINGS.

I'M GLAD THAT SOMEBODY GOT YOU GUYS ALL STIRRED UP.

BUT I DID NOT EXPECT TO BE CALLED DISRESPECTFUL.

IF YOU TALK TO MY FACE AND THEN I DON'T TALK TO YOU, THAT'S

[01:10:01]

DISRESPECTFUL. IF I CHOOSE NOT TO TALK TO SOMEBODY, THAT IS NOT BEING DISRESPECTFUL.

I THINK YOU NEED TO LOOK AT THE GIVE DEFINITION OF THAT.

I CAME UP HERE THE ASK YOU TO APPROVE A DOG PARK CONCEPT AND THE OPPONENT VERSUS DONE A GOOD JOB OF FOCUSING IN ON THE ONE SITE WE PICKED. THERE ARE SEVERAL OTHER SITES UNDER CONSIDERATION. WE WILL TALK ABOUT THAT IF YOU GUYS APPROVE IT. IF THE CITY COMMISSION APPROVES IT. WE WILL EVALUATE DIFFERENT SITES. NOT JUST FOCUSING ON ONE SITE.

THAT IS NOT WHAT I CAME HERE TODAY ABOUT.

I SAID I WOULD LIKE TO ASK YOU TO APPROVE THE CONCEPT OF THE DOG PARK. YOU CAN APPROVE IT OR NOT APPROVE IT. IRKED NOTE FOR THE RECORD WHAT I SAID TO CHIP IT WAS EXACT TRUTH AND NOTE THAT FOR THE RECORD HE IS RUNNING FOR OFFICE THIS YEAR. THANK YOU.

>> I DO WANT TO AS A REMINDER AS EVERYONE WHO IS HERE FOR THE DOG PARK WE HAD A BOARD MEMBER PREVIOUSLY THAT BROUGHT IT UP FOR DISCUSSION AND WE DID VOTE IN FAVOR FOR THE DEPUTY TO LOOK AT SOME AND BRING FORWARD SOME POTENTIAL LOCATIONS BEING PLURAL FOR A DOG PARK. THIS IS THE FIRST WE'VE SEEN.

THIS IS THE ONLY LOCATION WE'VE SEEN AND IS THE SLIDE BEHIND YOU. THIS BOARD DID I DON'T REMEMBER WE DID VOTE IN FAVOR OF PRESENTATION OF POTENTIAL LOCATIONS FOR A DOG PARK. THAT VOTE STILL STANDS.

JUST SO YOU KNOW. DO WE HAVE ANY MOTION?

>> COULD I MAKE A MOTION? I WOULD MOVE THAT AS AN INITIAL CONSIDERATION WE SAY THAT IF THE DOG PARK IS COMPLETELY SELF-FUNDED AND IF IT IS NOT IN THIS LOCATION THAT WE WOULD RECOMMEND FURTHER CONSIDERATION OF THE CONCEPT.

THAT WOULD REMOVE TWO OBJECTIONS.

ONE THE LOCATION AND THE OTHER THE MONEY.

>> DO WE HAVE A SECOND? >> I WOULD SECOND THAT.

>> MY CONCERN WITH THAT IS MY CONCERN THE SIMMONS ROAD PARK IN THAT I THINK THE CITY NEEDS A BETTER POLICY ON HOW IT WORKS WITH PRIVATE FUNDRAISING AND POLICIES AROUND PRIVATE

FUNDRAISING. >> I HAVE A COUPLE OF COMMENTS.

>> I APPRECIATE YOUR MOTION. I THINK THAT IS ALMOST THERE.

BUT THERE IS ONE OR TWO OTHER ASPECTS THAT IT DOESN'T ADDRESS.

ONE IS THE FACT THAT A FREE DOG PARK UNDERCUTS THE HUMANE SOCIETY. WHAT I KNOW ABOUT THE HUMANE SOCIETY WHICH ISN'T A LOT BUT I KNOW THAT FUNDRAISING AND THEIR COST OF OPERATION IS DIFFICULT. THEY NEED EVERY PENNY THEY CAN GET IN ORDER TO KEEP THAT OPERATION GOING.

SO TO ME THAT IS A CONCERN. WITH ANY DOG PARK ESPECIALLY FREE DOG PARK, THE ISSUE OF MAKING SURE THAT DOGS ARE PROPERLY VACCINATED, THERE IS NO WAY TO GUARANTEE THAT.

IF IT'S A PRIVATE GROUP THAT IS PUTTING THAT ON.

THE COST TO THE CITY, YOU MENTIONED HAVING SELF-FUNDED SO THAT WOULD TAKE CARE OF THAT. THIS PARTICULAR SITE THE NEIGHBORS TO THE WEST ARE NOT IN FAVOR OF IT AND THE NEIGHBORS TO THE EAST , THE SCHOOL BOARD IS NOT IN FAVOR OF IT.

NOISE IN RESIDENTIAL NEIGHBORHOOD IS A NONSTARTER.

BARKING DOGS ACROSS THE STREET FROM A RESIDENTIAL NEIGHBORHOOD, WHO WOULD WANT THAT? THE QUESTION OF THAT THE CITY HAS A LOT OF LAWS ON THE BOOKS TO CONTROL ISSUES THAT HAVE TO DO WITH DOGS IS TRUE. THEY ARE GOING TO BE NOT NECESSARILY ADHERED TO. SO IT'S GOING TO INVOLVE THE POLICE DEPARTMENT AND THIS ADDS A WHOLE OTHER THING WHAT THEY HAVE TO DO. SO THOSE ARE BASICALLY MY

[01:15:01]

OBJECTIONS. >> IF I COULD MAKE A COMMENT.

I THINK WE SHOULD ADDRESS THE PROPOSAL THAT WAS GIVEN TO US.

AND IF WE HAVE ADDITIONAL MOTIONS WE WANT TO ADD.

THE PROPOSAL IS FOR THE CITY TO FUND A DOG PARK.

WE SHOULD ADDRESS THAT ONE INITIALLY AND IF WE WANT TO HAVE ANOTHER MOTION. BUT THE PROPOSAL CAME TO US IN THAT FORM. AND I KNOW WE TALKED ABOUT DIFFERENT SITES. I'M LOOKING AT WHAT CAME TO US.

IT WAS A REQUEST FOR THE CITY AND I THINK THAT'S THE MOTION WE SHOULD I THINK WE SHOULD DEAL WITH THAT FIRST.

IT CAME WITH THAT SITE. BUT I'M JUST SAYING RATHER

THAN -- >> WOULD YOU LIKE THE AMEND YOUR

MOTION? >> I SAY THIS QUITE OFTEN.

WHAT ARE OUR PRIORITIES HERE BECAUSE WE HAVE LIMITED RESOURCES IN TERMS OF FINANCES AND LIMITED RESOURCES IN THINGS WE CAN ADDRESS AS A TEAM. THIS IS NOT A PRIORITY FOR US.

WE STILL HAVE A TON OF OTHER ISSUES WE GOT TO RESOLVE AS THE COUNCILMAN POINTED OUT. I DON'T WANT TO SPEND ANYMORE TIME ON THIS. LET'S MOVE FORWARD AND DO THE THINGS THAT WE ALREADY SAID WE WANTED TO DO AND BE MORE

EFFICIENT AT THAT. >> I'M GOING THE MAKE THE MOTION

SO WE CAN MAKE A VOTE. >> GO AHEAD AND YOU NEED TO VOTE

ON THAT MOTION. >> I'LL RESCIND IT.

WITH REGARD TO WHAT WAS SUGGESTED.

WE STILL HAVE A MOTION BEFORE US.

I WAS OUT OF ORDER I. >> IT WAS YOUR MOTION.

YOU ARE GOOD. IF YOU RESCIND IT WE GO BACK AND

REDO IT OR DO SOMETHING ELSE. >> LET'S MAKE IT EASY.

LET'S VOTE ON THIS MOTION. I'LL AMEND IT SLIGHTLY BY SAYING IN ADDITION TO HAVING NOT THAT LOCATION AND TO BEING ENTIRELY SELF-FUNDING THAT THERE MAY ALSO BE AN OPTION TO HAVE THE COOPERATIVE GROUP DECIDE TO CHARGE A SMALL FEE.

TRYING TO GET THE CITY OUT OF IT AND LOCATION OUT OF IT.

MY MOTION IS THAT WE CONSIDER THE IDEA OF A COOPERATIVE GROUP THAT WOULD HAVE A CHEAP LEASE ON SOME CITY LAND IF THE CITY SO DESIRES THAT WOULD BE ENTIRELY SELF-FUNDING FOR THE PURPOSE OF THIS CITIZEN RUN DOG PARK. THE MOTION CAN FAIL, THAT'S FINE. BUT THAT'S THE MOTION I'M PUTTING ON THE TABLE AND IT WAS SECONDS.

>> TAKE THE ROLL. >> WHAT I HAVE IS THE MOTION IS THAT AS INITIAL CONSIDERATION IF THE DOG PARK IS SELF-FUNDED AND NOT IN THIS LOCATION AND IN ADDITION THERE MAY ALSO BE AN OPTION FOR THE GROUP TO CHARGE A SMALL FEE THAT THIS GROUP WOULD RECOMMEND UNDERSTAND THE CONCEPT BE APPROVED.

>> WOULD THE COMMISSION THEN CONSIDER IT.

>> I DON'T THINK THIS GROUP HAS THE AUTHORITY TO APPROVE IT.

THE COMMISSION. >> THIS GROUP DOES APPROVE.

RECOMMEND THIS WILLB ACCEPTED BY THE COMMISSION.

>> YES. THAT'S THE MOTION.

>> RECOMMEND THE CONCEPT. >> JUST RECOMMEND END IN CONCEPT

TO THE COMMISSION. >> FOR FURTHER CONSIDERATION BY

THE CITY COMMISSION. >> RECOMMND END IN CONCEPT BE

APPROVED BY THE CITY COMMISSION. >> ARE WE SURE?

>> >> INITIAL CONSIDERATION IF THE DOG PARK IS SELF-FUNDED AND NOT IN THIS LOCATION IT WILL RECOMMEND UNDERSTAND THE CONCEPT BE CONSIDERED BY THE CITY COMMISSION IN ADDITION THAT THERE MAY ALSO BE A GROUP TO

[01:20:06]

CHARGE A SMALL FEE, WHAT DO I HEAR?

>> DO YOU WANT TO CALL ROLL? >> YES.

>> NO. >> NO BUT I WANT TO MAKE IT CLEAR THAT I'M NOT VOTING FOR THIS LOCATION.

>> NO. >> NO.

>> NO. >> MOTION FAILED.

>> DO I HAVE ANOTHER MOTION IN REGARD TO THE DOG PARK?

>> I'D LIKE TO MAKE A MOTION THAT THIS COMMITTEE APPROVE THE

CITY FUNDING A DOG PARK. >> SECOND.

>> ANY DISCUSSION? >> CALL THE ROLL.

>> NO. >> NO.

>> NO. >> NO.

>> NO. >> NO.

>> MOVING ON. NEXT ON THE AGENDA IS BY LAWS.

[Item 6.2]

ANYTHING HAPPENING AMENDMENTS TO BY LAWS AS SENT OUT?

>> I ONLY HAVE TWO QUICK COMMENTS BECAUSE I COMPARED THE PREVIOUS DRAFT TO THIS ONE. IT'S ON THE LAST PAGE.

THIS ACTUALLY IT'S ON SECOND PAGE OR C.

IT'S C UNDER RESPONSIBILITIES. AND I'M JUST ASSUMING THAT WAS REMOVED BECAUSE THAT PURVIEW IS NOT THE PURVIEW OF THE COMMISSION. NOT FOR TO US DICTATE IT.

MY ONLY OTHER QUESTION IS ON THE LAST ITEM AGENDAS ON THE NEW VERSION NUMBER 5 WAS OMITTED. I DON'T KNOW IF THAT WAS INTENTIONAL. ALL ITEMS ON THE AGENDA FOR PRESENTATION MUST INCLUDE THE TOPIC OF DISCUSSION AND THE SPEAKER'S NAME AND RELATED MATERIALS.

THAT WAS MISSING. >> IT WAS IN THERE.

>> IT WAS IN THE ONE -- THOSE ARE MY ONLY COMMENTS.

>> SO CAN WE PUT IN AGENDAS. >> SO THE FOR THE BENEFIT AGAIN OF THE OTHER MEMBERS , THE VERBIAGE SHE WANTS ADDED ON THE DRAFT IS ALL ITEMS ON THE AGENDA FOR PRESENTATIONS MUST INCLUDE TOPIC OF DISCUSSION AND SPEAKERS NAME, RELATED MATERIALS SHALL BE PLACED IN THE AGENDA PACKAGE. THAT'S THE VEER PANEL TO BE

ADDED. >> THAT'S ALL I HAVE.

>> THAT'S IT. DO WE HAVE A MOTION?

ANY DISCUSSION? >> I MOVE THAT WEATHER SERVICE PROVE THE BY LAWS WITH THE ADDITION OF THAT ITEM.

>> NECESSARY CORRECTIONS. >> SECONDED.

>> >> APPROVE THE BY LAWS WITH THE CORRECTIONS. YOU WANT TO DO A ROLL CALL?

>> YES. >> YES.

>> YES. >> YES.

>> YES. >> YES MOTION PASSES.

>> NEXT UP. PICKLE BALL.

[Item 6.3]

DO WE HAVE ANYONE TO MAKE A PRESENTATION? I HAVE A REQUEST TO SPEAK. IF THAT'S OK I CAN CALL YOU UP SO YOU CAN GIVE EVERYBODY THE INFORMATION.

DOES HA WORK FOR YOU? OK.

>> I'M DIANE PARKS. I LIVE AT 1103 FUR STREET.

[01:25:04]

ANY OTHER REQUEST THAT I'VE BEEN INVOLVED WITH OVER THE LAST COUPLE OF YEARS IN PICKLE BALL HAS GONE BEFORE THE COMMISSION.

I UNKNOWINGLY WROTE THEM THE LETTER.

I SHOULD HAVE BEEN WRITING YOU THE LETTER SO APOLOGIES.

I UNDERSTAND THAT YOU ALL ARE NOT AWARE OF WHAT WAS IN THE LETTER SO I THOUGHT I WOULD READ IT QUICKLY.

>> DEAR PARKS AND REC. MY DAD ALWAYS TOLD ME EVERYONE CAN STATE THE PROBLEM BUT IF ANYONE NO ONE OFFERS A SOLUTION IT A MOOT POINT. PICKLE BALL HAS GROWN 650% IN THE LAST SIX YEARS IN THE U.S. I WOULD VENTURE TO SAY FERNANDINA BEACH AVERAGES ARE ABOVE THE AVERAGE.

THE COURTS ARE BUSTING AT THE SEEMS FOR A MAJORITY OF DAYLIGHT HOURS AND THEY ARE ONLY GETTING BUSIER.

YOUR NEWLY HIRED CITY DIRECTOR CARD IS FILLING UP CLAIMING 1/3 OF THE COURTS ON A GROWING BASIS CAUSING RESIDENTS HAVE TO LEAVE OR WAIT UNDER YOUR SHADE STRUCTURE FOR AN OPEN COURT.

MEANWHILE THE FOUR TENNIS COURTS A FEW STEPS AWAY LIE DORMANT, LONELY, DISTRAUGHT THEY HAVE BEEN FORGOTTEN.

OCCASIONALLY THERE IS ONE OR TWO LE SONS.

BUT IT IS RARE. THE PICKLE BALL PIRATES OWN FOUR PORTABLE NETS. EACH TENNIS COURT CAN ACCOMMODATE TWO TICKLE BALL COURTS.

THE COMMON PRACTICE OF LINING PICKLE BALL COURTS ON TENNIS COURT IS POPULAR ACROSS THE U.S. THE COST TO CREATE FOUR MORE PICKLE BALL COURTS ON THE TWO SELDOM USED TENNIS COURTS WOULD BE $320 F. THE CITY IS NOT WILLING TO SPRING FOR $320 THE PICKLE BALL PIRATES WILL TAKE UP A COLLECTION AND PAY FOR IT OURSELVES. THE CLINICS AND LESSONS CAN BE TAUGHT ON THE OFFICIAL PORTABLE COURTS LEAVING THE PLAYERS TO SHARE THE SIX PERMANENT COURTS THEY HAVE ALREADY OUT GROWN.

IF IT CAUSES A STIR IN THE TENNIS WORLD PERHAPS AN AGREEMENT COULD BE PUT IN PLACE IF THE COURT ARE NEEDED FOR TENNIS THE STRINGED RACKETS TAKE PRIORITY.

IT TAKES 14 SECONDS TO PICK UP THE NET AND MOVE IT AGAINST THE BACK FENCE AND OUT OF THE WAY. AFTER READING THE FEBRUARY 12 ARTICLE ABOUT THE COMMISSION'S DECISION TO APPROVE AN ALMOST $500,000 EXPENDITURE FOR TOP TRACER GOLFMENT I RESPECTFULLY REQUEST THAT YOU CONSIDER THIS MINIMAL EXPHONES ACCOMMODATE YOUR RESIDENTS MANY AN ALREADY SELF-SUSTAINING WAY.

IT WOULD BE LITTLE TO NO COST TO THE CITY AND YOUR CONSTITUENTS WOULD BE SO HAPPY. COMMISSIONER ROSS SPOKE ABOUT THE INFRASTRUCTURE NEEDED. THE USE WHAT IS BARELY BEING USED RIGHT NOW. I DID SPEAK THIS AFTERNOON TO A TOURNAMENT U.S. APA PICKLE BALL AMBASSADOR IN HACK MOCK BEACH AND PALM COAST AND HE IS THE DIRECTOR OF TOURNAMENTS.

I SAID HOW CO-COMMON ARE TENNIS COURTS LINED RATHER THAN TAPED AND HE REELED OFF COURT AFTER COURT IN DIFFERENT COUNTIES.

I DON'T THINK YOU WANT ME TO GO OVER.

BUT THAT IS OUR REQUEST TO HAVE JUST TWO OF THE COURTS.

THE OTHER TWO COURTS ARE LINED. >> I HAVE A QUESTION.

I WANT TO CLARIFY THAT ASK. THE ASK IS THERE IS A DIFFERENT

WAY OF MARKING THE COURTS OFF? >> IT'S LIKE IN A GYM YOU HAVE BASKETBALL LINES AND VOLLEYBALL LINES AND THEY ARE PAINTED.

IT'S A DIFFERENT COLOR ON THE TENNIS COURTS FOR PICKLE BALL

COURTS. >> DOES ANYBODY ELSE HAVE

QUESTIONS? >> LINING THE COURTS WITH DIFFERENT LINES IS THAT GOING TO CAUSE A PROBLEM FOR THE TENNIS?

>> IT IS A VERY POPULAR AND THAT IS WHAT I WAS TALKING TO THE GENTLEMAN, IT IS MORE AND MORE I CAN SHOW YOU WHAT IT LOOKS LIKE.

IT IS DIFFERENT LINES. IF YOU PLAY TENNIS YOU KNOW WHERE YOUR LINES ARE. IF YOU PLAY POSSIBLY BALL YOU KNOW WHERE THE LINES ARE. THIS IS A PICTURE OF A TENNIS COURT WITH TWO PICKLE BALL COURTS.

THIS IS NOT IDEAL BECAUSE THEY ARE SAME COLOR.

RIGHT NOW ON THE OTHER TWO COURTS THE , JR. LINES ARE DIFFERENT LINES THAN THE FULL SIZE.

>> IF YOU LINE THE COURTS FOR PICKLE BALL, THAT WOULD STAY.

[01:30:01]

THAT IS PERMANENT? >> YES.

>> IS THERE A PROBLEM FOR THE PARKS AND REC DEPARTMENT?

>> STAFF RECOMMENDED NOT ALLOWING PERMANENT LINES PUT ON THE TENNIS COURT. HOWEVER WHEN THERE IS OVERFLOW FOR THEIR TOURNAMENTS THEY WILL HOST, THEN WE CAN PUT THE LINES TEMPORARILY DOWN AND REMOVE THEM.

>> IS THERE SOME SPECIAL KIND OF TAPE OR SOMETHING THAT WILL HOLD

UP FOR SOME PERIOD OF TIME? >> YES , THE TAPE WE PUT DOWN

WILL HOLD UP. >> WHEN YOU THINK BACK OVER THE YEARS, THE REASON WE ONE OF THE REASONS WE BUILT THE PICKLE BALL COURSE IS BECAUSE IT WAS BECOMING SO POPULAR.

AND WE WERE USING THE TENNIS COURTS.

AND THE MULTIPURPOSE COURT DOWN AT THE MAIN BEACH WATER PARK.

BUT PARK. SO WITH THE VAST NUMBER GROWING WE BUILT FOUR PICKLE BALL COURTS.

IT CONTINUED TO GROW SO WE BUILT PICKLE BALL COURTS AND ADDED LIGHTS WHICH WERE EXTREMELY EXPENSIVE.

AND WHAT WE'RE FINDING IS THE LIGHTS ARE NOT BEING USED BECAUSE PEOPLE ARE PLAYING DURING THE DAY.

SO THERE IS PLENTY OF OPPORTUNITY IN THE EVENING TO PLAY PICKLE BALL. WHEN WE DID THIS WE HAD THE INTENT TO KEEP TENNIS AND PICKLE BALL SEPARATE EXCEPT FOR THE OCCASIONS WHEN THERE WERE GOING TO BE TOURNAMENTS OFFERED.

SO THE STAFF FROM THE PARKS AND RECREATION DEPARTMENT WOULD PREFER NOT OVERLAPPING THAT BECAUSE SOME OF THE CONTROVERSY WE HAD IN THE PAST WITH TENNIS. BUT THEY ALWAYS EVOLVE.

THE PEOPLE THAT PLAY TENNIS , THE PEOPLE THAT PLAY PICKLE BALL, THE NUMBERS GO UP AND DOWN.

IN THE LAST TWO YEARS WHEN WE FINISH UP THESE COURT, IT WAS ASKED ARE YOU GUYS GOING TO ASK FOR ANYTHING ELSE FOR PICKLE BALL. BECAUSE WE'RE DOWN.

WE'RE NOT PROVIDING ANYMORE. AND THE ANSWER WAS YES.

THINGS CHANGE AND I UNDERSTAND THAT.

STAFF IS RECOMMENDING THAT IT IS NOT THE TENNIS COURTS ARE NOT USED ON A REGULAR BASIS FOR PICKLE BALL.

ONLY FOR SPECIAL EVENTS SUCH AS THE TOURNAMENTS.

>> SO JUST OUT OF CURIOSITY, I REMEMBER WHEN WE PUT THE LIGHTS IN FOR PICKLE BALL, WHY AREN'T THE PICKLE BALL COURTS BEING UTILIZED AT NIGHT WITH THE LIGHTS?

>> I'VE PLAYED UNDER THE LIGHTS TWICE THIS WEEK.

SO NO IT'S NOT AS FREQUENT PEOPLE GO HOME AND GO TO DINNER.

I DON'T KNOW HOW IT CONFLICTS WHICH I'M SURE IT DOESN'T WITH THE DAWN TO DUSK THING. WE WOULD NOT HAVE PUT LIGHTS IF YOU HAD TO LEAVE BY DUSK. PART OF IT IS THE EMAIL LIST FOR THE PICKLE BALL PIRATES HAS GONE UP OVER 350 PEOPLE ON THE LIST FOR SIX COURTS. NOT TO SAY THERE ARE 350 WANTING 3 -- WE ARENOT PLAYING AS MUCH S DURING THE DAY.

NO ONE IS PLAYENING TO TENNIS COURTS.

NOT WANTING TO AS I PROPOSED HERE PERSONALLY NOT REPRESENTING THE PICKLE BALL COMMUNITY, MY SUGGESTION WAS IF THERE ARE FOUR COURTS OF TENNIS THAT WANT TO BE PLAYED, THEY GET IT.

BUT IF THERE IS NO ONE THERE, WHY WOULD YOU NOT USE A CITY FUNDED BUILT BEAUTIFUL OPPORTUNITY?

>> DO I HAVE A QUESTION. OF THE PICKLE BALL PLAYERS, HOW MANY OF THOSE ARE RESIDENT OF THE CITY AND HOW MANY ARE

COUNTY? >> I PERSONALLY DON'T HAVE THAT NUMBER I CAN'T HELP YOU. BUT I DON'T KNOW.

>> WE HAVE ASKED THAT QUESTION OURSELVES.

AND BEEN INFORMED THAT WE'RE NOT PRIVY TO THAT INFORMATION.

THEY DON'T HAVE IT BUT THEY WON'T PROVIDE THE NAMES AND EMAILS. BASICALLY WE'RE GUESSING IT'S PROBABLY A 50/50 BECAUSE WE DO HAVE THE ONLY PICKLE BALL COURTS IN THE DONE COUNTY. COUNTY.

I COULD BE WRONG. >> THERE ARE SOME BUT I THINK

PRIVATE IN NORTH HAMPTON. >> AND THERE IS SOME AT SUMMER

BEACH. >> THE OTHERS ARE ALL PRIVATE.

AND I DON'T KNOW HOW MANY PEOPLE THAT COME BRING THEIR KIDS TO

CENTRAL PARK ARE CITY OR COUNTY. >> QUESTION OF THE TEMPORARY TAPE S THAT SOMETHING THAT COULD BE APPLIED DURING NON-TOURNAMENT TIMES TO SOLVE THIS PROBLEM RATHER THAN HAVE THE CITY PAINT?

>> IT WOULD HAVE BEEN TAPE? >> WE ARE REQUESTING PAINT.

[01:35:07]

>> NO PAINT. >> WOULD STAFF ALLOW TAPE TO BE PUT ON DURING TIME THE TENNIS COURTS ARE EMPTY?

>> LIKE I SAID BEFORE, ONE OF MY COWORK 76ERS HERE.

HE DEALS WITH THIS MUCH MORE THAN I DO WAS THE FACT THERE ARE MULTIPLE LINES ON THE COURTS NOW BECAUSE WE HAVE FOR , JR.

CLINICS AND THEN FOR THE REGULAR TENNIS LINES.

SO ADDING ADDITIONAL LINES WAS CONSIDERED KIND OF IRRITATING TO THE TENNIS PLAYERS WHEN THEY HAD THE ADDITIONAL LINES.

THAT CAUSED US TO PROVIDE PICKLE BALL COURTS.

WE SPENT A SUBSTANTIAL AMOUNT OF MONEY ON THE SIX COURTS AND THE

LIGHTING. >> AND THEY ARE BEING WEREN'TFULLY APPRECIATED AND USED.

>> COULD YOU PUT TAPE DOWN WHEN THE TEST COURTS ARE EMPTY?

>> CAN I SPEAK UPON THAT? I'M THE ASSISTANT PARKS AND RECREATION DIRECTOR. I'M A HUGE PICKLE BALL GUY.

I LOVE IT. I REMEMBER THE FIRST DAY WE PLAYED AT THE BEACHMENT I AGREE WITH NAN AND OUR STAFF IS NOT SUPPORTING THIS. AND THAT'S HARD FOR ME TO SAY BECAUSE I'M A HUGE PICKLE BALL GUY.

HOWEVER WE DO HAVE SIX COURTS THAT WE JUST BUILT.

WE PUT LIGHTS THERE. I THINK HALF OF THE PEOPLE ARE NON-CITY RESIDENTS. PICKLE BALL IS A SOCIAL SPORT.

SO WHEN THEY DO PLAY IT'S EVERYONE COMES AT THE SAME TIME.

SO YES, YOU HAVE TO WAIT. IT'S THE NAME OF THE GAME.

INSTEAD OF PUTTING OTHER MARKINGS ON THE TENNIS COURTS WHICH WE REALLY ONLY HAVE TWO TENNIS COURTS BECAUSE THE TENNIS PRO IS TEACHING A LOT ON THE FRONT TWO COURTS.

IF YOU ARE AN AVID TENNIS PLAYER IN THE CITY LIMBS YOU ONLY HAVE TWO COURTS. IT'S NOT TRUE?

WHERE ARE THE OTHER ONES? >> THERE IS ONLY FOUR.

>> THERE IS FOUR COURTS. >> WE REALLY ONLY HAVE TWO COURTS THAT ARE AVAILABLE ALL THE TIME.

AND JUST IN THE LAST TWO WEEKS OR IN THE LAST WEEK I WAS DRIVING BY THE TENNIS COURTS AND IT'S FUNNY HOW EVERYONE IS SO DIFFERENT ON IT. TENNIS PLAYERS SAID TO ME WE'RE TRYING TO FIGURE OUT WAYS TO GET MORE TENNIS COURTS.

SOMEBODY IS SAYING WE NEED MORE -- THEY ARE NOT SAYING WE DON'T NEED TENNIS COURTS. THEY ARE SAYING THEY WANT MORE PICKLE BALL COURTS. THERE IS TWO VIEWS TO IT.

COULD WE HAVE TENNIS? THE TENNIS PRO PROBABLY IF WE ALLOWED HIM COULD BE TEACHING LESSONS ON THE BACK COURTS.

THE FRONT TWO COURTS ALREADY LINED.

AND SOME OF THE TENNIS PLAYERS WITH MULTIPLE LINES ON THE COURTS CAN GET A LITTLE CONFUSED.

NOW I AGREE WITH THEM THAT THIS IS A COMMON PRACTICE AMONG TENNIS COURTS THAT LINES ARE PAINTED.

IT'S NORMAL. I WOULD DEFINITELY NOT RECOMMEND TAPE. TAPE CAN DEPENDING ON I'VE WORKED WITH THEM ON RUNNING PICKLE BALL TOURNAMENTS, IS FOR A WEEKEND IT'S FINE. IT WILL COME UP.

I THINK IF IT STICKS LIKE DOWN AT MAIN BEACH AT THE MULTIPURPOSE COURTS WHEN YOU PULL THE TAPE UP, IT COULD RIP UP SOME OF THE ASPHALT IF IT'S THERE FOR A WHILE.

I JUST THINK INSTEAD OF GOING OVER TO THE EXISTING TWO TENNIS COURTS, PLAN MORE GROUP TIME DURING THE DAY, UNDER THE LIGHTS, A LOT OF PEOPLE WANT TO PLAY AT 8:00 IN THE MORNING.

IT'S TO ME AND OUR STAFF I AGREE UNANIMOUS.

AS OF NOW I WOULD NOT MARK THEM. >> WOULD YOU GO ALONG WITH HAVING THEM BE ABLE TO USE THE TENNIS COURTS FOR PICKLE BALL

TOURNAMENTS. >> RIGHT I'VE ALREADY STATED

[01:40:03]

THAT. >> I'M ALL FOR THAT.

>> AND THEY WORK WITH US. THEY WORK WITH US AND THEY SAY WE'RE GOING TO RUN A TOURNAMENT, WASN'T TO MARK THE COURTS FOR THE WEEKEND. ABSOLUTELY.

>> GIVE THEM THAT WHEN THE WHOLE ISSUE OF BUILDING MORE PICKLE BALL COURTS CAME UP, THE QUESTION WAS IS THAT IT AND THE ANSWER WAS YES. BY THE PICKLE BALL FOLKS.

THAT'S ALL THEY ARE GOING TO BE AT LEAST FOR THE FORESEEABLE FUTURE. IF THERE ARE SITUATIONS WHERE THEY NEED TO HOLD A TOURNAMENT, WHERE A LOT MORE PEOPLE ARE GOING TO COME, USE THE TENNIS COURT FOR THAT AND YOU ARE OK

WITH THAT, MAYBE THAT'S -- >> WE ENCOURAGE THAT.

WE DO HAVE ONE MORE REQUEST. >> AS A POINT OF CLARIFICATION ASIDE FROM THIS ISSUE, BECAUSE QUESTION CAME UP ABOUT RESIDENT AND NONRESIDENT. THIS IS FOR THE AUDIENCE.

THE CITY ALLOWS ANYBODY TO COME IN TO THE REC DEPARTMENT AND PURCHASE A KEY TO THE COURT. THEY DON'T HAVE SCORING METRIC WHETHER YOU ARE A RESIDENT OR NONRESIDENT.

ANYBODY CAN GET ACCESS TO IT. THAT ISSUE IS A PROBLEM IN EVERY ONE OF OUR FACILITIES, NOT JUST IN PICKLE BALL.

TO SIGNAL OUT PICKLE BALL AS A SECTION THAT HAS TOO MANY NONRESIDENTS DOESN'T MAKE SENSE UNLESS YOU ARE GOING TO ADDRESS THAT ACROSS ALL FACILITIES. IT ONLY MAKES SENSE WHEN YOU ASK

FOR ADDITIONAL. >> THE OTHER ISSUE IS THERE WAS NO DIRECTOR OF PICKLE BALL. THERE WERE NO CLINICS.

IF I CAN FINISH. >> SO THAT JUST IT'S INFORMATIONAL. NOT ARGUING.

I'M JUST TRYING TO PROVIDE SOME ADDITIONAL INFORMATION.

THAT DIDN'T EXIST WHEN WHEN THOSE COURTS WERE ADD.

NOW THEY ARE BEING USED FOR LESSONS WHICH IS GREAT.

WE LOVE IT. WHAT IT'S DOING IS THROWING A LOT OF THOSE TENNIS PEOPLE INTO PICKLE BALL.

THAT IS PART OF WHAT IS GOING ON IS THERE IS MORE DEMAND BECAUSE THE SPORT IS GROWING. OF COURSE THEY ARE NONRESIDENTS.

WE GIVE LESSONS TO NONRESIDENTS. OF COURSE YOU ARE GOING TO HAVE NONRESIDENTS COMING IN USING THE COURTS.

WE ARE CONVERTING A LOT OF TENNIS PLAYERS.

I'M JUST TRYING TO PROVIDE CLARITY.

THAT IS WHAT IS DRIVING THIS IS WE ARE ADVERTISED ALL OVER THE WORLD. PEOPLE COME DOWN HERE AND PLAY PICKLE BALL. TODAY THE WINTERTIME IT'S PACKED BECAUSE WE HAVE ALL THE SNOW BIRDS DOWN HERE.

THERE IS A LOT OF STUFF GOING ON DRIVING THIS.

CLEARLY IT'S THE DEPARTMENT'S DECISION ON WHAT THEY WANT TO DO. I'M JUST TRYING TO GIVE YOU BACKGROUND ON WHERE IT'S COMING FROM.

>> WE ARE NOW PICKLE BALL CAPITOL OF THE WORLD.

>> IT'S THE DEPARTMENT'S DECISION WHAT YOU DO.

I'M TRYING TO PROVIDE BACKGROUND ON WHAT IS DRIVING IT AND WHY THERE HAS BEEN A LOT OF USE. WE LOVE HAVING LESSONS AND CLINICS. IT'S GREAT.

>> ROB ALSO TEACHES OR HAS PICKLE BALL CLINICS.

AND HE IS CURRENTLY NOT DOING MANY OF THEM, HOWEVER HE IS DOING THEM OUTSIDE OF GROUPS PLAY TIME.

>> HE IS. AND HE TAKES UP TWO COURTS.

BUT IT IS OUTSIDE OF GROUP PLAY TIME.

SO GROUP PLAY TIME IS WHEN EVERYBODY SHOWS UP.

>> I THINK REGARDLESS STAFF DOES NOT SUPPORT PAINTING LINES ON THE TENNIS COURT. WE PROVIDE TENNIS FOR TENNIS PLAYERS. WE PROVIDED ABOVE AND BEYOND FOR PICKLE BALL WITH FUNDING AND THE FACILITY ITSELF.

IT IS STAFF'S DECISION. IT WAS PUT ON THE AGENDA SO ARGUE WARE OF IT. IT WENT TO THE COMMISSION WHEN IT SHOULD HAVE COME TO STAFF. STAFF IS NOT SUPPORTING PAINTING THE TENNIS COURTS. WHO KNOWS IF IT BECOMES UNBELIEVABLY OUT OF CONTROL, WE CAN VISIT IT AGAIN.

BUT AT THIS POINT WE ARE NOT GOING TO.

>> WE HAVE ONE MORE REQUEST TO SPEAK.

>> MY NAME IS SHELLY DUNCAN. I LIVE AT 93 OAK GROVE PLACE.

I'M A VOLUNTEER OBSESSED WITH PICKLE BALL.

[01:45:02]

I'M THE AMBASSADOR FOR AMELIA ISLAND.

I MOVED HERE IF 2016. FOUND OUT ABOUT PICKLE BALL.

IT'S TWO BLOCKS FROM MY HOUSE. I PLAY ALMOST EVERY DAY.

YES, I WAS THERE WHEN WE SAID WE WERE NOT GOING THE NEED ANYMORE COURTS. WE ALSO AT THE TIME DID NOT KNOW WE WERE GOING TO GET A DIRECTOR OF PICKLE BALL AND TENNIS.

WE LIKE THAT. IT'S ALWAYS FUN TO PLAY AGAINST OTHER FOLKS. IT'S A GREAT GAME AND SOCIAL ACTIVITY. IT'S A SIMPLE THING TO PAINT LINES. I'VE PLAYED ACROSS THE COUNTRY.

CALIFORNIA AND BACK. A LOT OF PLACES DO IT.

PEOPLE PLAY PICKLE BALL ALL THE TIME.

WE HAVE GROUP PLAY. WE WORK WITH ROD AND HIS SCHEDULE TO ACCOMMODATE WHEN HE NEEDS TIME FOR CLINICS.

ANOTHER THING THAT HAPPENS IN PICKLE BALL IS YOU GET A GROUP TOGETHER AND WANT A PICKUP GAME SO YOU WANT TO GO TO THE COURTS AND PLAY. WHEN I GO THERE I SEE A LOT OF PEOPLE I'VE NEVER MET BEFORE BECAUSE THERE ARE A LOT MORE PEOPLE PLAYING THROUGH ROD'S CLASSES, VISITORS AND SNOW BIRDS. SO WHEN WE'RE THERE OR GO TO SHOW UP TO PLAY, AND YOU CAN'T PLAY BECAUSE ALL THE COURTS ARE TAKEN AND YOU LOOK AT THE TENNIS COURTS AND THEY ARE NOT BEING USED YOU GO WOW IT AN UNDERUTILIZED RESOURCE.

THE STAFF MAY NOT BE RECEPTIVE TO IT RIGHT NOW.

WE WANT TO KNOW WHAT NEEDS TO HAPPEN TO GET IT ON THE TABLE FOR DISCUSSION. IT WOULD ONLY COST $160 TO PAINT THE LINES FOR TWO COURTS. I'VE DONE IT AT NORTH HAMPTON.

WE PAINTED TWO COURTS. WE PAINTED TWO COURTS AT THE BEACH CLUB. MY HUSBAND AND I.

WE GET IT DONE IN A DAY. THESE ARE PICTURES FROM THE BEACH CLUB. THAT IS THE PICTURE HERE.

THEY HAVE FOUR PICKLE BALL COURTS WAY TENNIS COURT AND TWO PAINTED ON THERE PORTABLE NETS. YOU TAKE THE PORTABLE NETS DOWN.

WE APPRECIATE THE COURTS. WE APPRECIATE THE LIGHTS.

WE APPRECIATE THAT DOE HAVE THESE LOVELY COURTS.

WE ARE VERY INVESTED IN TAKING CARE OF THE COURTS.

OUR GROUP PROVIDE EQUIPMENT. WE PUT THE FIRST WIND SCREENS UP. WE ADDED A BENCH.

WE HAVE THE BULLETIN BOARD THAT ADVERTISES ROD GIBSON.

WE PAID FOR. THAT WE PAID FOR GATES TO GO AT THE FACILITY. WE DONATED $2,400 FOR MORE TREES TO BE PLANT WHEN HAD THE TWO NEW COURTS COME UP.

WE WORK WELL WITH PARKS AND REC. I TALK TO SCOTT ALL THE TIME.

THEY ARE SUPPORTING OUR TOURNAMENT COMING UP IN MAY.

WE'RE HAPPY ABOUT THAT. WHAT DOE FOR A TOURNAMENT IS PUT TAPE DOWN. IT TAKES A LOT LONG TORE PUT THE TAPE DOWN EVERY TIME AND IT LAST THREE DAYS AND YOU HAVE TO TEAR IT UP. IF WE COULD PAINT THE LINES.

PEOPLE GET USED TO IT. IT'S NOT THAT INTRUSIVE.

I'D LIKE TO KNOW A WAY TO GET LINES PAINTND TO COURTS.

THANK YOU. >> IT SOUND TO ME LIKE THE REAL STUM BLING BLOCK IS THE PERMANENCY OF PARKING UP THE TENNIS COURTS. I'M THINKING TO MYSELF IF THERE WAS A WAY WHEN YOU HAVE A PICKUP GAME TO BE ABLE TO PUT A HOLOGRAM OR SOME LIGHT OR SOMETHING DOWN THERE.

IT'S NOT A PERMANENT THING AND DOESN'T REQUIRE THEM TO DO A LOT OF EFFORT. I'M JUST SAYING IS THERE SOME KIND OF TECHNOLOGY WAY OUT OF THIS SO EVERYBODY CAN GET --

>> NOT WHEN THE SUN IS OUT. >> THERE IS A MILLION DOLLARS

IDEA. >> I WOULD LIKE TO SAY ONE OTHER THING. I THINK ONE THING THAT HAS CHANGED WITHIN THE LAST FEW MONTHS IS AND HE MAY NOT BE USING THE APPROPRIATE TITLE BUT ROD GIBSON IS OUR HAS A CONTRACT WITH THE CITY AND WE DO CURRENTLY DO AN 85/20 SPLIT.

THE CITY COLLECTS THE MONEY. KEEPS 20% OF THE MONEY.

HE GETS 70% OF THE MONEY. AND HE NOW IN THE LAST FEW MONTHS OR THREE MONTHS OR WHATEVER IT MAY BE IS TEACHING CLINICS. THAT IS ONE THING THAT HAS CHANGED AT THE CURRENT SIX COURTS.

SO THAT IS THE ONE THING THAT HAS CHANGED.

ONCE AGAIN HE IS DOING THAT OUTSIDE OF WHEN THERE IS GROUP PLAY. SO THAT WAS ONE OF THE

STIPULATIONS. >> EXCEPT SUNDAYS AT 3:00.

>> IF THEY ARE BOOKED AND YOU LOOK AT THE TENNIS COURTS AN NO

[01:50:04]

ONE IS EVER THERE. LET US USE THE RESOURCES THAT WE

HAVE. >> IT'S BASICALLY ABOUT THE

LINES. >> THAT'S IT.

>> AND WE'LL PAY FOR IT. WE'LL DO IT.

>> I DON'T THINK THAT'S THE ISSUE.

IT'S THE ISSUE OF WHETHER THE LINES ARE A PROBLEM FOR THE

TENNIS FOLKS CORRECT? >>

>> THE COMMITTEE HERE YOU CAN ADVISE MAKE RECOMMENDATIONS TO THE COMMISSION. THEY ARE BRINGING IT TO YOU TO LET YOU KNOW WHAT THEIR REQUEST IS BUT STAFF IS NOT GOING THE PAINT THE LINES ON THE COURT. ALLOW LINES TO BE PAINTED.

>> WE DON'T HAVE TO MAKE A RECOMMENDATION.

>> I JUST WANT TO MAKE SURE. >> CLARIFY WHAT THE ISSUE IS.

IF IT'S JUST ABOUT THE LINES AND IT DOESN'T OFFEND TENNIS PEOPLE, WHY THE PARKS AND REC DEPARTMENT WOULDN'T GO AHEAD AND DO THAT?

>> THAT'S LIKE WE'LL BE PEDDLING BACKWARDS.

THAT'S WHY WE BUILT THE PICKLE BALL COURTS IN THE FIRST PLACE BECAUSE THERE WAS CONTROVERSY WITH THE PICKLE BALL LINES ON

THE TENNIS COURTS. >> WE DON'T WANT TO GET BACK INTO THAT. EVERYBODY NEEDS A LITTLE BIT OF SOMETHING. WE HAVE TO UNTIL THERE IS --

>> IS THERE AN ORGANIZED TENNIS COMMUNITY?

>> YES. THEY PLAY AT DIFFERENT LOCATIONS

BUT THERE IS, YES. >> ARE THEY AWARE OF THIS?

>> I DOUBT IT. >> I WOULD SAY THERE IS NOT AN ORGANIZED GROUP. BASICALLY THE CITY HAS ALLOWED THE PICKLE BALL PIRATES TO -- WE DIDN'T GET TOO INVOLVED WITH PROGRAMMING OF THE COURTS. THERE IS AN AVID GROUP OF PICKLE BALL PEOPLE. AND THEY HAVE FORMED AN UNOFFICIAL GROUP AND HAVE WE THE CITY HAS ALLOWED THEM TO SET TIMES WHEN THEY COME THERE AS A GROUP, WE'VE WORKED VERY WELL TOGETHER. SO NO THERE IS NOT A COMPARISON OF THE TENNIS BECAUSE TENNIS ISN'T AS SOCIAL PLAY AS PICKLE BALL. YOU GO PLAY TENNIS WITH FOUR PEOPLE OR TWO. IT TAKES AN HOUR AND A HALF TO PLAY A MATCH. THESE MATCHES TAKE TEN MINUTES 20 MINUTES. AND THEN YOU PLAY SOMEBODY ELSE.

SO THE TENNIS POPULATION WASN'T AWARE OF THIS WANTING TO HAPPEN

I WOULD IMAGINE THEY WEREN'T. >> I DO THINK YOU WOULD HAVE HAD SOME ISSUES, PEOPLE WOULD HAVE SPOKE UP AGAINST IT I THINK.

>> WOULD IT MAKE SENSE FOR THE PICKLE BALL PEOPLE TO FIND THE TENNIS PEOPLE AND FIND OUT WHAT THEY THINK?

WOULD THAT AFFECT YOUR. >> PICKLE BALL PEOPLE, WE REALLY DO, I THINK AT THIS TIME WE HAVE SIX LIGHTED COURTS FOR THEM.

AND I THINK WE HAVE GIVEN THE CITY HAS PROVIDED -- ONLY SO

MUCH WE CAN DO. >> YOU ARE NOT ELIGIBLE TO SPEAK

RIGHT NOW. >> WE'RE DONE WITH THAT FOR NOW.

>> INBOUND ELSE HAVE ANY COMMENTS?

>> ANYTHING. >> AS A RESULT TO SIGN UP FOR M.

>> YOU CAN FILL OUT A FORM AFTER.

>> I DON'T PLAY PICKLE BALL. JUST AS AN OBSERVATION FOLLOWING UP ON CHIP'S COMMENT. IT SEEMS TO ME IF THE REC ESCAMBIA DEPARTMENT IS AGAINST PAINTING THE LINES BUT I'VE HEARD THERE IS A BIG SHIFT IN WHAT THE CITIZENS OF THE CITY WANT OR THE PLAYERS OF PICKLE BALL AND TENNIS WANT, IT SEEMS TO META ASKING THE PARKS AND REC DEPARTMENT TO DO A UTILIZATION STUDY WOULD BAY REASONABLE REQUEST AND COME BACK WITH DATA.

[01:55:03]

IF THEY COME BACK WITH DATA THAT SAYS THE TENNIS COURTS ARE USED 10% OF THE TIME DURING LIGHTED HOURS AND PICKLE BALL IS USED 90%, IT WOULD SEEM TO BE A REASONABLE REQUEST TO GO BACK AND SAY MAYBE WE NEED TO LOOK AT WHAT THE CITIZENS OF THE CITY WANT IN TERMS OF RECREATION FACILITIES.

IF THAT IS PAINTING SOME LINES ON TENNIS COURTS THAT AREN'T BEING UTILIZED, THAT WOULD BE A REASONABLE REQUEST.

THANK YOU. >> WORK PLAN.

[Item 6.4]

WE HAVE BEEN TASK BID CITY COMMISSION.

DO YOU HAVE A DATE YET FOR WE HAD AN ORIGINAL DATE BUT I COULDN'T BE THERE. WASN'T IT ORIGINALLY IN APRIL? IT WAS BUT IT WILL BE MOVED BECAUSE I CAN'T BE THERE.

>> LET ME CHECK WITH THE CITY. WHO WAS SETTING THAT UP WITH

YOU? >> NICOLE AND I DROPPED THE BALL

IN RESPONDING TO HER. >> LET ME FOLLOW UP WITH HER.

>> AS PRESENTATION TO THE COMMISSION.

SO WE ALSO NEED TO ADD TO THAT THE MASTER PLAN RECOMMENDATIONS THAT YOU GUYS APPROVED. SO THAT CAN BE PART OF IT.

>> SO WHAT I OPEN FOR DISCUSSION.

BUT MY RECOMMENDATION IS THAT WE COME TO IT WON'T BE ON THE APRIL AGENDA FOR COMMISSION FOR TO US MAKE A PRESENTATION FOR OUR WORK PLAN. WE COME TO OUR APRIL MEETING WITH SOME ITEMS WE WOULD LIKE TO POINT IS LET THE COMMISSION KNOW WHAT WE HAVE DONE AND WHAT WE ARE DOING AND WHERE WE ARE GOING. AND WE HAVE DONE QUITE A BIT

SINCE OUR LAST PRESENTATION. >> WOULD IT BE POSSIBLE TO WORK ON THE MASTER PLAN WITH SOME THOUGHTS AND EMAIL ANYONE WHO COULD EMAIL AHEAD OF TIME TO THE SUBCOMMITTEE AND ADD THEIR SUGGESTIONS. SO THAT WE HAVE SOME IDEA WHERE WE'RE GOING WHEN WE MEET AT THE APRIL MEETING?

>> YES. >> IF YOU WANT THE SAME SUBCOMMITTEE OR CHANGE IT. AND WE JUST NEED TO KNOW THE TIME AND WHAT YOUR AGENDA IS SO WE CAN POST IT.

IS NERVE FAVOR OF DOING IT THAT WAY?

>> WHO WANT TO BE ON THAT SUBCOMMITTEE SPARTANBURG.

>> WHAT I HEARD COMMISSIONER SAY THAT HE WANTED US TO PUT FORWARD BUDGET ITEMS IN THIS WORK PLAN AT THE CITY COMMISSION MEETING.

>> LOOKING FOR SOME GUIDANCE. >> I'M NOT SURE HOW MUCH IN DEBT

WE HAVE THE DETAIL TO DO THAT. >> WE DON'T.

BUT IF WE ARE GOING TO SUGGEST THINGS TO BE SPENDING MONEY ON

[02:00:01]

THEY CAN BE SUGGESTIONS. >> WE CAN PUT THAT IN THERE.

>> WHAT I WILL DO IS RIGHT NOW IT'S VERY EARLY IN THE PLANNING STAGES FOR OUR CAPITOL IMPROVEMENT REQUESTS.

WHAT I CAN DO IS SEND YOU WHAT HAS BEEN SUBMITTED TO THE FINANCE DEPARTMENT AT THIS POINT.

THERE ARE STILL ITEMS ON THERE THAT WILL BE ADDED.

BUT AT LEAST YOU CAN KIND OF SEE WHERE WE'RE GOING RIGHT NOW.

SO I'LL SEND YOU THE PROPOSED CAPITAL IMPROVEMENT PLAN MINUS SOME ITEMS THAT AREN'T IN THERE AT THIS POINT THAT WILL BE ADDED AS WE PROGRESS THROUGH BUDGET PROCESS THAT WILL HELP WITH THE MEETING WHATEVER DATE WE SAY FOR THE WORK PLAN.

AND THEN ALSO YOU GUYS WILL BE ABLE TO SEE THAT BEFORE YOU MEET AND TALK ABOUT THE WORK PLAN. WILL YOU SET A DATE FOR YOUR

SUBCOMMITTEE? >> WE COULD PUBLIC NOTICE THAT

AND SET THE DATE THROUGH EMAIL. >> WE DID LAST TIME AND SAID WE

COULD CHANGE IT IF NEEDED TO. >> SOMETIMES IT NOT IN OUR

COMPUTER. >> GIVE US SOME DATES.

>> RIGHT. AND MOST OF YOU -- YOU OK WITH

THE MORNINGS LIKE 9:00 OR SO. >> THAT'S FINE.

>> WE MET UP IN THE OTHER ROOM. >> THAT'S WHERE WE MET FOR THE

BY LAW SUBCOMMITTEE. >> THE CONFERENCE ROOM UP ON THE

SECOND FLOOR. >> OK GREAT.

>> EASIER PROBABLY TO GET ACCESS.

>> WE'LL DO THAT. WE'LL CHECK THE DATES AND SEND IT TO THE THREE SUBCOMMITTEE MEMBERS.

>> MOVING ON. WATER FRONT PARK.

[Item 6.5]

>> WE DON'T HAVE TO MAKE A VOTE ON IT.

>> I BELIEVE SOME OF YOU EVER -- I SENT ALL OF YOUR SUGGESTIONS THAT YOU SUBMITTED TO ME TO THE CITY MANAGER AND HE HAS INCORPORATED THOSE INTO WHAT -- AND I KNOW THAT YOU ARE PART OF

THAT WHOLE CONVERSATION. >> YES, I SAW THIS.

>> RIGHT NOW WITH THE WATER FRONT PLAN, HE SUBMITTED ALL THOSE TO THE ARCHITECT OR ENGINEER.

AND THEY ARE MOVING FROM THERE. THE NEXT STEP WILL BE ANOTHER CONCEPT BASED ON WHAT FOLKS HAVE SUBMITTED FROM THE DIFFERENT COMMITTEES. AM I UNDERSTANDING THAT?

>> THAT'S MY UNDERSTANDING AND THERE IS A PUBLIC HEARING

SCHEDULED. >> WHAT YOU GUYS HAVE DONE IS THE FOUR THINGS THAT HE ASKED FOR.

YOUR DISCUSSION SUGGESTIONS FOR THE CONCEPTUAL PLANS LIKE REDUCING THE SIZE OF THE VENUE. IT'S ALL DOCUMENTED AND HE'S

MOVING FORWARD WITH IT. >> THERE IS ONE THING ABOUT THAT. I WAS NOT AWARE OF WHICH IS THAT MARK IS GOING TO PRODUCE A NEW CONCEPT THAT WILL BE PRESENTED TO THE PUBLIC BASED ON THE COMMENT OF THE BOARD.

OR IS HE GOING TO PRESENT THE SAME ONE?

>> IT'S MY UNDERSTANDING HE'S TAKING THE COMMENT FROM THE BOARD AND GETTING SOME FEEDBACK. I DON'T KNOW WHAT IT LOOKS LIKE.

I'M NOT INVOLVED EXCEPT FROM THE CONVERSATIONS WITH BRINGING THAT TO YOU GUYS WITH THE FOUR ITEMS THAT HE WANTED YOU TO PROVIDE YOUR FEEDBACK ON. I DON'T HAVE ANY ADDITIONAL

INFORMATION AT THIS TIME. >> I JUST HAVE A QUICK QUESTION.

OBVIOUSLY I WAS NOT THERE BUT I DID WATCH THE VIDEO.

IT WAS A LITTLE BIT CONFUSING TO ME BECAUSE IT STARTED TO GO ALL OVER THE PLACE WITH THE WATER FRONT PARK WAS IT APPEARS THAT WHAT IT IS IS 7 PEOPLE'S INDIVIDUAL OPINIONS.

SO WE'RE SITTENING TO COMMITTEE. BUT WE'RE NOT FORMING ANY CONSENSUS OR VOTING ON ANYTHING. I'M ASSUMING THAT WAS THE

PURPOSE. >> THE IDEA IS TO WHITTLE IT DOWN TO A PLAN THAT INCORPORATES STAKEHOLDERS THAT INCORPORATES THE MOST THAT THEY CAN AND THEN TAKE IT TO THE PUBLIC AND THEN COMING BACK AGAIN AND THEN AT THAT TIME WHEN THEY COME BACK WITH A FINAL, THAT IS WHEN THEY'LL REQUEST RECOMMENDATION

[02:05:02]

OR NOT. >> I KNOW PUBLIC MEETING IS BEING HELD APRIL 4 IS THE PUBLIC MEETING AND THEY WANTED TO HAVE

ALL THE DATA FOR THE -- >> IS IT HERE?

>> I DON'T KNOW. I HAD ONE OF THE COMMISSIONERS TELL ME. CHIP DO YOU KNOW THAT FOR SURE?

APRIL 4? >> THE WATER FRONT PUBLIC

MEETING. >> IT IS.

>> THAT'S WHAT THEY SAID. >> I HAD ASKED TERESA, I COMBED BY EMAIL. I DIDN'T SEE ANYTHING ASKING TO US COMMENT ON THOSE FOUR POINT OTHER THAN YOUR RESPONSES.

FRANKLY THEY ONLY GOT COMMENTS FROM THREE PEOPLE, WELL FOUR.

>> FAITH AND JOY, ERIC -- I DIDN'T SEE ERIC'S.

>> BECAUSE HE SENT IT TO ME. >> I SPOKE TO HER SPECIFICALLY.

>> YOU COPIED US ON JOY'S AND SOG'S, SO I'M LIKE I DON'T KNOW

WHO ELSE RESPONDED. >> I DID?

>> YES BECAUSE I SAID I WOULD SEND THEM TO YOU.

>> I DIDN'T KNOW IF YOU RESPONDED.

>> DIDN'T YOU SEND YOURS DIRECTLY TO THE CITY MANAGER?

>> I JUST DIDN'T KNOW WHERE THE EMAIL ORIGINATED THAT SAID HERE ARE THE FOUR THINGS SUPPOSE TO BE.

>> IT WAS IN THE PRESENTATION. >> AND I WASN'T HERE.

>> I DIDN'T KNOW WRIT CAME FROM. >> IT WAS IN THAT 42 PAGES OF STUFF. IT'S IN THERE.

>> FOUR THINGS. >> IS IT TOO LATE FOR ME OR CAN

I SUBMIT SOMETHING? >> SUBMIT.

>> COPY ME. DO YOU WANT TO SHARE IT I'M

FINE. >> I'LL GUARD IT TO EVERYBODY SO THEY CAN SEE WHAT YOUR THOUGHTS ARE.

>> COULD YOU COPY ME ON THAT AS WELL?

>> YES. YOU HAVE YOU CAN ONLY RESPOND TO ME. THAT IS PART OF THE WHOLE

SUNSHINE LAW. >> I'LL MAKE SURE YOU GET IT IF THERE ARE ANY ISSUES YOU'LL BE FINE.

>> ANY OTHER DISCUSSION? >>

>> I WOULD LIKE TO BRING UP THERE WAS AN EMAIL ABOUT HICKOR-

>> OH YEAH. >> I'D LIKE TO LET THE BOARD KNOW THIS IS SCHOOL BOARD PROPERTY WHERE THE SOAKER FIELDS ARE. AND SO THEREFORE THIS WILL LIKELY NOT COME BEFORE US. BUILDING RESTROOMS ON COUNTY PROPERTY IS -- ENTER I WILL SAY AS A PRIVATE SID I WAS VERY

MOVED BY THE EMAIL. >> I'LL BE CONTACTING THE COUNTY

AND REQUESTING THEY DO THAT. >> THE SCHOOL BOARD OWNS THE

PROPERTY. >> $100,000 TO THE CITY WHEN WE BUILT THOSE APPROXIMATE 2002. SO THEY DID HELP FUND THE CONSTRUCTION OF THOSE. THE CITY BUILT THEM.

THE COUNTY GAVE US $100,000. >> CAN WE ASK THEM TO GIVE US

MORE FUNDING TO BUILD RESTROOMS? >> WE CAN'T BUT WE CAN ASK THE

COMMISSION TO. >> I'LL ASK.

>> IF YOU GET IT -- >> WE CAN'T DO IT AS THE PARKS AND REC. THAT LEASE AGREEMENT WITH THE SCHOOL BOARD AND THE CITY I BELIEVE EXPIRES 2026.

>> I JUST HAVE ONE QUICK POINT OF INFORMATION.

THE COUNTY IS DOING A WHOLE RECREATION STUDY AND SO FARTHER.

NAN WAS AT THIS MEETING, WE WERE THAT THE MEETING AND I THINK IT'S SOMETHING THAT I KNOW WE CAN'T DO IT AS A COMMITTEE, BUT AS INDIVIDUAL CITIZENS, I THINK PEOPLE NEED TO GET OUT THERE AND

[02:10:03]

ODD HAVE KATE. I WENT UP AND DIDN'T REALIZE HE'S THE GENTLEMAN THAT DID THE MASTER PLAN DAVIS.

I MADE A COMMENT ABOUT WHAT IS GOING ON IN THE ISLAND.

AND THE RESPONSE IS WELL THE CITY HAS ALWAYS PROVIDED SO WE DON'T FORESEE ANY. I ACTUALLY PRINTED OFF THEIR LIST OF WHAT THEY HAVE AND INCLUDED IS A LIST OF WHAT WE HAVE. JUST FOR THE RECORD THEY DO NOT OWN A BALL FIELD, A SOCCER FIELD, A BASEBALL FIELD, A FOOTBALL FIELD, A TENNIS COURT, NOTHING ON THE ISLAND OTHER THAN WHEN CHILL FACTORS IS NICE, WE ARE COUNTY TAXPAYERS, THEY TONE BOAT RAMP AND THE BEACH ACCESSES.

BUT THEY OWN NO FACILITIES AND THERE IS NO CURRENT MOVEMENT.

I DON'T KNOW IF YOU SEE ANYTHING DIFFERENTLY TO DO ANYTHING HERE BECAUSE WE ALREADY DO IT ALL. SO --

>> PIGGY BACKING ON THAT, I AM ENCOURAGING PEOPLE HERE AND PEOPLE HERE TO CONTACT YOUR FOLKS OR GET OUT TO THE MEETINGS AND SAY UNLESS YOU WANT THE CITY TO TAKE DRASTIC ACTION ABOUT ACCESSING OUR FACILITIES, YOU NEED TO GET SOME STUFF OUT HERE.

AND ONE OF THOSE COULD BE A DOG PARK FRANKLY.

THE COUNTY HAS LAND. >> SO ANYWAY, JUST I'VE BEEN TRYING TO KEEP AN EYE ON TO SEE IF THERE IS ANYTHING ELSE GOING ON. THAT WAS OUT OF THE MOUTH OF MR.

>> WHY WOULD THE COUNTY PROVIDE ANYTHING WHEN YOU DO IT ALL.

THERE IS NO PRESSURE TO DO ANYTHING.

>> ARE THERE ANYMORE? >> JUST ONE COMMENT I GUESS.

[Items 7 & 8]

AT THE SOCCER FIELDS THERE IS A HUGE PARKING PROBLEM.

AND YOU ARE AWARE OF THAT RIGHT? >> IT'S BEEN THAT WAY FOR YEARS.

NOW ESPECIALLY SINCE WE LOST THAT ACCESS ROAD.

>> IS THERE ANY WAY TO OR ANY SPACE WHERE THE SKY DIVING TRAILER IS BACK THERE TO HAVE PARKING AND I THINK THE USE THAT AREA FOR PARKING DURING THE CONCOURSE.

>> AND HAVE AN ENTRANCE THROUGH FENCE.

>> I HAVE BEEN TOLD NO, THAT IS NOT AN OPTION.

WHERE THE BIG BERM IS YOU TALKED ABOUT.

>> RIGHT. >> THE BERM AND THE FENCE.

>> CORRECT. >> BUT WE ARE LOOKING --

>> WHOSE PROPERTY IS THAT? >> IT AIRPORT.

EVERYTHING OUT THERE IS AIRPORT PROPERTY.

>> ISN'T THERE COUNTY LAND ADJACENT TO IT, IFTH FIELDS?

>> WE'RE SURROUNDED BY THERE ARE NO OPTIONS OUT THERE.

THEY SOLD THAT LAND THAT ADJACENT LAND IF.

>> YES. AND THE COUNTY SOLD THE OTHER PIECE TO CRANE ISLAND I BELIEVE. BUT THE FOOTPRINT OF THAT PARK IS ON AIRPORT PROPERTY. SO AT ANY GIVEN TIME THEY CAN TAKE THAT BACK. SO I KNOW THAT THE SOFTBALL FIELDS I BELIEVE WERE BUILT IN THE LATE 80'S AND SOCCER WAS BUILT IN THE EARLY 2,000'S. SO BUT WE'RE JUST THERE KIND OF AT THEIR WILL. I DON'T FORESEE ANYTHING HAPPENING. BUT EXPANDING ON THAT FOOTPRINT.

IT'S BEEN A PROBLEM I CAN'T TELL YOU HOW MANY YEARS.

I KNOW MY KID PLAY SOAKER AND IT WAS HARD TO FIND A PARKING PLACE THEN AND THEY ARE IN THEIR TWENTIES.

YES. I CAN SAY YES, WE ARE AWARE

THERE IS. >> MAYBE WE SHOULD ASK THE

COUNTY TO STEP UP TO THE PLATE. >> THEY WON'T LET YOU DO THAT,

WHO IS THEY? >> THAT IS PART OF THE AIRPORT.

IT NOT FAA. IT HASN'T BEEN TAKEN TO THE FAA.

THAT IS AIRPORT PROPERTY AND SUPPOSED TO BE SECURE.

[02:15:03]

TO PROVIDE PARKING OUT THERE IT IS NOT CURRENTLY AN OPTION.

I'D LIKE TO KNOW MORE ABOUT WHY THAT IS NOT AN OPTION.

>> YOU MAY WANT TO GO TO THE AIRPORT ADVISORY BOARD AND ASK

THEM. >> OR THE AIRPORT MANAGER MAYBE.

>> RIGHT. BECAUSE THAT LAND AND THEY ARE USING IT. SO ON THOSE OCCASIONS WHERE

THERE IS -- >> SATURDAYS, BASICALLY SATURDAY

MORNINGS ARE A NIGHTMARE. >> IS THE SKY DIVER RELEASING

THAT PROPERTY FROM THE AIRPORT? >> I DON'T KNOW.

I WOULD ASSUME SO BECAUSE THEY HAVE A TRAILER THROUGHOUT.

BUT I DON'T KNOW THE DETAILS OF THAT.

>> THE SKY DIVER MAY HAVE A LEASE.

>> BUT I DON'T KNOW THAT THEY WOULD.

CALL NATE AND ASK HIM AND SEE WHAT THE RULES ARE WITH THAT.

>> I DON'T KNOW THAT'S MY RESPONSIBILITY.

>> YOU WANT TO KNOW IF THEY CAN USE IT.

I'VE BEEN TOLD THAT'S NOT AN OPTION.

I CAN ASK AGAIN. ARE THERE ANY OTHER ITEMS?

>> I WAS REQUESTED PUBLIC INPUT I MOVE TO ADJOURN.
