PROCLAMATION - WILD AMELIA JUNIOR NATURALIST PROGRAM
Recognizes Ms. Robin Nemes and the Wild Amelia Junior Naturalist Program for educating, developing lasting community benefits and creating lifelong curators of Florida’s coastlines, maritime forests and saltmarshes.
4.2.
PROCLAMATION - HERITAGE TREE PROGRAM SUPPORT

Recognizes Ms. Peggy Lehosit in her efforts to provide renewed energy and support for the City’s Heritage Tree Program.

CONSENT AGENDA
6.1.
FACILITIES USE AGREEMENT - DRIVING DYNAMICS
RESOLUTION 2016-156 APPROVING A FACILITIES USE AGREEMENT WITH DRIVING DYNAMICS, INC. FOR THE USE OF AIRPORT PROPERTY TO CONDUCT DEFENSIVE DRIVER SAFETY TRAINING; AUTHORIZING EXECUTION; AND PROVIDING FOR AN EFFECTIVE DATE. Synopsis: Approves a Facilities Use Agreement with Driving Dynamics, Inc. for defensive driver training at the Fernandina Beach Municipal Airport.

HERITAGE TREE DESIGNATION - ALACHUA STREET AND NORTH 6TH STREET
RESOLUTION 2016-157 DESIGNATING FIVE TREES LOCATED WITHIN THE DOWNTOWN AREA ON PUBLIC RIGHT-OF-WAY LOCATED ON NORTH 6TH STREET AND ALACHUA STREET AS HERITAGE TREES; AUTHORIZING EXECUTION; AND PROVIDING FOR AN EFFECTIVE DATE. Synopsis: Grants the designation of “Heritage Tree” to five trees located on North 6th Street and Alachua Street.

HERITAGE TREE DESIGNATION-VARIOUS LOCATIONS WITHIN THE DOWNTOWN AREA
RESOLUTION 2016-158 DESIGNATING SIX TREES LOCATED WITHIN THE DOWNTOWN AREA ON PRIVATE PROPERTIES AS HERITAGE TREES; AUTHORIZING EXECUTION; AND PROVIDING FOR AN EFFECTIVE DATE. Synopsis: Grants the designation of “Heritage Tree” to six trees located within the downtown area.
6.4.
AGREEMENT EXTENSION - CERES ENVIRONMENTAL SERVICES INC -
RESOLUTION 2016-160 APPROVING THE EXTENSION OF THE EXISTING CONTRACT WITH CERES ENVIRONMENTAL SERVICES, INC. FOR A PERIOD OF SIX MONTHS FOR DISASTER RECOVERY AND DEBRIS REMOVAL SERVICES; AUTHORIZING EXECUTION; AND PROVIDING FOR AN EFFECTIVE DATE. Synopsis: Approves the extension agreement with Ceres Environmental Services, Inc. as the City’s primary provider of disaster recovery and debris removal services for an additional six months.

7.1.
LEASE AMENDMENT - CROWN CASTLE SOUTH LLC

RESOLUTION 2016-159 AUTHORIZING A THIRD AMENDMENT TO THE CURRENT GROUND LEASE WITH CROWN CASTLE SOUTH, LLC, AMENDING THE CURRENT GROUND LEASE AGREEMENT FOR THE CELL TOWER LOCATED AT 3427 CITATION COURT, FERNANDINA BEACH, FLORIDA;  EXTENDING THE TERMS TO DECEMBER 31, 2084; AUTHORIZING EXECUTION; AND PROVIDING FOR AN EFFECTIVE DATE. Synopsis: Approves the “Third Amendment to the Ground Lease Agreement” with Crown Castle South, LLC.

8.1.
TABLED AT FIRST READING ON DECEMBER 6, 2016 - RIGHT-OF-WAY VACATION – PORTION OF GUM STREET
ORDINANCE 2016-40 APPROVING A VACATION OF PUBLIC RIGHT-OF-WAY FOR A PORTION OF GUM STREET TOTALING APPROXIMATELY 755 LINEAR FEET EXTENDING BETWEEN CITRONA DRIVE AND THE EGANS CREEK GREENWAY; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. Synopsis: Approves the vacation of a portion of Gum Street, an unopened public right-of-way totaling approximately 755 linear feet between Citrona Drive and the Egans Creek Greenway.

ORDINANCE 2016-18 PROHIBITING AND REGULATING PERSONAL PROPERTY UNATTENDED ON ATLANTIC OCEAN BEACHES WITHIN THE CITY OF FERNANDINA BEACH; CREATING SECTION 90-49 REGARDING PURPOSE; CREATING SECTION 90-50 REGARDING DEFINITIONS; CREATING SECTION 90-51 DECLARING PUBLIC NUISANCE; CREATING SECTION 90-52 PROHIBITING UNATTENDED PERSONAL PROPERTY ON CITY BEACHES; CREATING SECTION 90-53 PROVIDING FOR EXCEPTIONS; CREATING SECTION 90-54 REGARDING PERMITS; CREATING SECTION 90-55 REGARDING NOTIFICATION OF BEACHGOERS AND PROPERTY OWNERS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. Synopsis: Amends various sections of the City Code pertaining to unattended personal property on the beach.

• A THREE (3) MINUTE TIME LIMIT MAY BE IMPOSED FOR ALL SPEAKERS (EXCEPT IN A QUASI-JUDICIAL HEARING). A “REQUEST TO SPEAK” FORM IS AVAILABLE ON THE COUNTER AT THE ENTRANCE TO THE COMMISSION CHAMBERS.  THE FORM SHOULD BE GIVEN TO THE CITY CLERK UPON COMPLETION.

• IN ACCORDANCE WITH STATE LAW, ITEMS NOT ON THE AGENDA MAY BE BROUGHT UP FOR DISCUSSION BUT NO ACTION MAY BE TAKEN BY THE CITY COMMISSION. IF APPROPRIATE THE ITEM MAY BE SCHEDULED ON A FUTURE AGENDA.

• THE MAYOR WILL DETERMINE THE ORDER OF THE SPEAKERS AND MAY IMPOSE MORE RESTRICTIVE TIME LIMITS.

• ONE PERSON WILL SPEAK AT A TIME AND ADDRESS COMMENTS TO THE MAYOR, NOT INDIVIDUAL CITY COMMISSION MEMBERS.

• THE CITY COMMISSION MAY ASK QUESTIONS OF SPEAKERS WHO WILL HAVE ONE MINUTE TO RESPOND. ADDITIONAL TIME MAY BE GRANTED AT THE DISCRETION OF THE MAYOR OR BY A MOTION BY THE CITY COMMISSION.

• SPEAKERS MAY FILE COPIES OF THEIR REMARKS WITH THE CITY CLERK WHO WILL MAKE THEM AVAILABLE TO THE COMMISSION.

• FERNANDINA BEACH CITIZENS WILL SPEAK BEFORE NONRESIDENTS AND SPEAKERS WILL LIMIT REMARKS TO THE SPECIFIC SUBJECT MATTER.

• DISCUSSION – DIRECTION - ACTION ITEMS MAY BE ACTED UPON BY THE CITY COMMISSION BY EITHER MOTION AND VOTE IN ACCORDANCE WITH ROBERTS RULES OF ORDER, OR BY A CONSENSUS OF THE CITY COMMISSION.

• PURSUANT TO RESOLUTION 95-32, IF AN ITEM IS NOT ON THE AGENDA IT REQUIRES A FOUR-FIFTHS VOTE OF THE CITY COMMISSION DECLARING THE ITEM AN EMERGENCY BEFORE ACTION CAN BE TAKEN.

• QUASI-JUDICIAL - DENOTES THAT THE ITEM MUST BE CONDUCTED AS A QUASI-JUDICIAL HEARING IN ACCORDANCE WITH CITY COMMISSION ESTABLISHED PROCEDURE AND FLORIDA STATUTES. ANY PERSON WISHING TO APPEAL ANY QUASI-JUDICIAL DECISION MADE BY THE COMMISSION WITH RESPECT TO ANY MATTER CONSIDERED AT SUCH MEETING OR HEARING WILL NEED A RECORD OF THE PROCEEDINGS, AND, FOR SUCH PURPOSES, MAY NEED TO ENSURE THAT A VERBATIM RECORD OF THE PROCEEDINGS IS MADE, WHICH RECORD INCLUDES THE TESTIMONY AND EVIDENCE UPON WHICH THE APPEAL IS MADE.
