CITY SEAL USAGE APPROVAL – RESOLUTION 2015-01

RESOLUTION 2015-01 APPROVING THE USE OF THE CITY SEAL IN ACCORDANCE WITH ORDINANCE 2011-06 FOR AUTHOR, ERIC JAY DOLIN TO USE THE CITY SEAL IN A BOOK ABOUT AMERICA’S LIGHTHOUSES; AND PROVIDING FOR AN EFFECTIVE DATE. Synopsis: Approves the use of the City seal in black and white by author, Eric Jay Dolin for a book about the history of America’s lighthouses published by Liveright sometime in 2016 but no later than July 1, 2017.

FACILITIES USE AGREEMENT – OCEANUS SLIDES, LLC – RESOLUTION 2015-02

RESOLUTION 2015-02 APPROVING THE FACILITIES USE AGREEMENT BETWEEN OCEANUS SLIDES, LLC AND THE CITY OF FERNANDINA BEACH FOR THE OPERATION OF A TEMPORARY WATERSLIDE AND BEACH GEAR RENTALS AT MAIN BEACH PARK; AUTHORIZING EXECUTION; AND PROVIDING FOR AN EFFECTIVE DATE. Synopsis: Approves the Facilities Use Agreement between Oceanus Slides, LLC and the City of Fernandina Beach and authorizes the City Manager to execute an assignment of the Agreement on behalf of the City should new LLC’s specific to this business at Main Beach be created.

FUTURE LAND USE MAP AMENDMENT – DADE STREET & NORTH 3RD STREET – ORDINANCE 2014-26 CHANGING THE CITY’S FUTURE LAND USE MAP TO ASSIGN A CITY FUTURE LAND USE MAP CATEGORY OF PUBLIC AND INSTITUTIONAL (PI), FOR PARCELS TOTALING 0.61 ACRES OF LAND LOCATED AT DADE STREET AND NORTH THIRD STREET; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. Synopsis: Assigns a Future Land Use Map Designation of Public & Institutional (PI) to 0.61 acres located at Dade Street and North 3rd Street.

• A THREE (3) MINUTE TIME LIMIT MAY BE IMPOSED FOR ALL SPEAKERS (EXCEPT IN A QUASI-JUDICIAL HEARING). A “REQUEST TO SPEAK” FORM IS AVAILABLE ON THE COUNTER AT THE DOOR AND SHOULD BE FILLED OUT WITHIN 15 MINUTES AFTER THE START OF THE MEETING AND GIVEN TO THE CITY CLERK.

• IN ACCORDANCE WITH STATE LAW, ITEMS NOT ON THE AGENDA MAY BE BROUGHT UP FOR DISCUSSION BUT NO ACTION MAY BE TAKEN BY THE CITY COMMISSION. IF APPROPRIATE THE ITEM MAY BE SCHEDULED ON A FUTURE AGENDA.

• THE MAYOR WILL DETERMINE THE ORDER OF THE SPEAKERS AND MAY IMPOSE MORE RESTRICTIVE TIME LIMITS.

• THE CITY COMMISSION MAY ASK QUESTIONS OF SPEAKERS WHO WILL HAVE ONE MINUTE TO RESPOND. ADDITIONAL TIME MAY BE GRANTED AT THE DISCRETION OF THE MAYOR OR BY A MOTION BY THE CITY COMMISSION.

• SPEAKERS MAY FILE COPIES OF THEIR REMARKS WITH THE CITY CLERK WHO WILL MAKE THEM AVAILABLE TO THE COMMISSION.

• FERNANDINA BEACH CITIZENS WILL SPEAK BEFORE NONRESIDENTS AND SPEAKERS WILL LIMIT REMARKS TO THE SPECIFIC SUBJECT MATTER.

• DISCUSSION – DIRECTION - ACTION ITEMS MAY BE ACTED UPON BY THE CITY COMMISSION BY EITHER MOTION AND VOTE IN ACCORDANCE WITH ROBERTS RULES OF ORDER, OR BY A CONSENSUS OF THE CITY COMMISSION.

• PURSUANT TO RESOLUTION 95-32, IF AN ITEM IS NOT ON THE AGENDA IT REQUIRES A FOUR-FIFTHS VOTE OF THE CITY COMMISSION DECLARING THE ITEM AN EMERGENCY BEFORE ACTION CAN BE TAKEN.

• QUASI-JUDICIAL - DENOTES THAT THE ITEM MUST BE CONDUCTED AS A QUASI-JUDICIAL HEARING IN ACCORDANCE WITH CITY COMMISSION ESTABLISHED PROCEDURE AND FLORIDA STATUTES.
