I HAVE THREE OPTIONS THAT AT LEAST HAVE BEEN PROPOSED TO ME OR COME TO MIND AS FAR AS HOW WE WILL MOVE FORWARD AND I WOULD LIKE TO HEAR HOW MY FELLOW COMMISSIONERS WOULD LIKE TO CONSIDER THAT. OPTION NUMBER ONE IS TO CONTINUE STAYING WITH OUR CURRENT INTERIM CITY MANAGER FOR UP TO A YEAR.

AND THEN REINITIATE THE SEARCH FOR COLIN BAENZINGER AT THE COMPLETION OF AN ELECTION. THE COMMENT SUPPORTING THIS SUGGESTION WAS SUCH THAT THE NEW CITY MANAGER IN SUCH SHORT TIME COULD BE THE TARGET OF AN UPCOMING ELECTION.

OPTION NUMBER TWO, BEGIN SEARCHING FOR A NEW CITY MANAGER. WE HAVE A RETAINER FOR THE TERM AND SOMETHING THAT IS WORTH CONSIDERING WHILE MR. GEORGE CONTINUES TO MANAGE OUR CITY. OPTION NUMBER THREE WOULD BE TO DISCUSS CONSIDERATIONS IF WE FEEL THAT MR. GEORGE IS WORTHY OF OUR PERMANENT CITY MANAGER POSITION AND, OF COURSE, HE NEEDS TO BE WILLING TO ACCEPT THAT.

IF THERE ARE ANY OTHER OPTIONS ON THE TABLE, I WOULD LOVE TO HEAR YOUR THOUGHTS AS WELL, BUT WE OWE IT TO THE CITIZENS TO DISCUSS WHICH ONE OF THOSE WE ARE GOING TO START LEANING

I AM TRYING TO SAY WE SHOULD -- >> SO TY ROSS ESSENTIALLY PROPOSED HIS RESIGNATION IN EXCHANGE FOR WHAT -- WHAT IS PROVIDED TO ALL OF YOU AND I KNOW MEMBERS OF THE PUBLIC HAVE IS A SEPARATION AGREEMENT AGREEING TO PAY HIM SIX WEEKS OF SEVERANCE, HIS ROW LOCATION EXPENSES THAT HE BARGAINED FOR WHEN HE SIGNED HIS EMPLOYMENT CONTRACT.

HAND THIS WITH THE SIX WEEKS OF SEVERANCE, THE WAY THAT IS HANDLED INCLUDES -- AND IT ENDS UP BEING, YOU KNOW, ADDED UP SIGNIFICANT IS FICA AND HEALTH BENEFITS.

EVERYTHING THAT THE CITY PAYS FOR SOMEBODY, NOT JUST SIX WEEKS OF SALARY. THAT TOTAL AMOUNT IS $50,733.73.

AND SO I THINK THAT YOU ALL HAVE TO DECIDE WHETHER YOU WILL ACCEPT HIS RESIGNATION ON THOSE TERMS. HE DID SIGN THE AGREEMENT. AND IF THE COMMISSION VOTES TO ACCEPT IT, THEN I WOULD EXPECT THAT IN THE FORM OF A VOTE.

SINCE THERE WERE NO SPEAKERS. POINT OF POINT OF ORDER.

BEFORE YOU TAKE ANY VOTE, MAKE SURE YOU ASK FOR PUBLIC COMMENT.

BUT TO ME, THE $50,000 PRICE TAG AND ALL THE THINGS THAT ARE LOADED IN THERE SENDS REALLY THE WRONG SIGNAL TO THE COMMUNITY.

WE WENT THROUGH A BUDGET PROCESS.

WE DIPPED INTO RESERVES TO MAKE THE BUDGET WORK.

AND NOW WE ARE GOING TO GIVE SOMEBODY A PACKAGE THAT LOOKS -- I AM SORRY, I AM A LITTLE FAT. AND I THINK THE $25,000 TO GIVE HIM WHAT HE NEEDS TO -- THAT IS BASED FOR GETTING HIS LIFE BACK ON TRACK. BUT THE -- THE VACATION AND ALL THIS STUFF, IT JUST LOOKS -- JUST WRONG TO IT THE COMMUNITY.

AND ALSO, I THINK NONE OF THE OTHER CITY EMPLOYEES -- I KNOW THEY ARE NOT CONTRACT EMPLOYEES, BUT THEY LOOK AT THAT AND, COME ON, I MEAN, THAT -- THEY WOULDN'T BE TREATED THAT WAY IF THEY WERE IN THOSE SHOES. SO I WILL STOP THERE.

I TOOK A LOOK AT THE NUMBERS AND I ONLY HAD ISSUE WITH OF TWO THE NUMBERS ON THERE. I BEEN ATTED TO QUESTION THE VACATION ACCRUAL RATE. THE MATH DID NOT ADD UP TO ME.

BECAUSE "ACCRUAL," VACATION ACCRUAL SHOULD NOT BE OVER THE SIX WEEKS OF THE SEVERANCE, IT SHOULD BE OF THE SIX OR EIGHT WEEKS -- HOW MANY WEEKS HERE THAT HE WORKED.

THAT NUMBER LOOKED A LITTLE HIGH TO ME.

AND HAVING NOT MOVED HERE, TYPICALLY WHAT HAPPENS WITH A

RELOCATION PACKAGE IS THAT SOMEONE MOVES.

AND THEN THEY ARE REIMBURSED AN AMOUNT UP TO WHATEVER THAT NUMBER IS. HAVING SEEN THAT MR. ROSS DID NOT MOVE HERE. $7500 SEEMS EXCESSIVE.

SO I GET THE CONTRACTUAL PART. AND WE HAVE TO HAVE SOME SEPARATION AND WHEN YOU LOSE, LOSE FAST.

I AGREE WITH THAT COMPLETELY, BUT LET'S -- I THINK THAT NUMBER IS A LITTLE SMALLER THAN WHAT WE SAW ON THE PROPOSED PACKAGE.

ONCE YOU MAKE IT PAST A PROBATIONARY PERIOD OF A YEAR OR WHATEVER THE CASE MAY BE, WHATEVER WE DETERMINE, THEN WOULD YOU GET A FULL SEVERANCE PACKAGE IF SOMETHING WAS TO HAPPEN WHETHER WE PART WAYS AM MIABLY OR UNAM MIABLY.

I THINK WE SHOULD PUT THIS THAT IN OUR CONTRACT.

DERELICTION OF DUTIES OR FOR-CAUSE TERMINATION AND THAT WOULD HAVE REQUIRED THE CITY COMMISSION TO PROVIDE WHICH WOULD HAVE MEANT A PUBLIC MEETING LIKE THIS.

IF YOU ALL DECIDE. YOU WOULD WISH TO DETERMINATE THE CITY MANAGER. YOU PROVIDE THE CITY MANAGER WITH NOTICE THAT YOU INTEND TO TERMINATE FOR DERELICTION OF DUTIES. AND THEN THE HEARING IS SET NO LESS THAN 20. NO MORE THAN 40 DAYS AFTER THAT LETTER. SO WE WOULD HAVE BEEN IN JANUARY, SECOND OR THIRD WEEK IN JANUARY HAVING A HEARING.

AND AT THAT POINT, THAT'S WHEN TY ROSS, THE CITY MANAGER, WOULD HAVE HAD THEIR DUE PROCESS, THEIR HEARING, THEIR DAY IN FRONT OF THE COMMISSION OR THE PUBLIC AND NO RULES SET UP FOR THAT. THAT WOULD BE QUESTIONS, ANSWERS, DISCUSSION. THEN AT THE END OF THAT MEETING, FOUR OUT OF THE FIVE CITY COMMISSIONERS, IF THEY VOTED TO TERMINATE, YOU WOULD TERMINATE AND NO SEVERANCE, BUT STILL THE 96 HOURS OF VACATION TIME THAT WOULD BE PAID JUST OVER $10,000.

THOSE WERE THE TWO -- THE TWO THINGS WE HAD TO FACE.
