WHAT IS THE CITY'S ROLE IN ADDRESSING THE CONDITION AND I THINK COMMISSIONER ROSS SAID THAT CODE ENFORCEMENT YOU CAN'T

REALLY DO ANYTHING ABOUT THAT. >> OUR CODE ENFORCEMENT DEPARTMENT DOES ENFORCE WE HAVE MAINTENANCE OF PROPERTY AND MAINTENANCE OF STRUCTURES. AND I THINK CODE ENFORCEMENT COULD IF ASKED, THIS IS A SPECIAL SITUATION BECAUSE IT'S A CITY-OWNED PROPERTY, IT'S LEASED.

THEY HAVEN'T DONE THAT, BUT THEY COULD UNDER THE LEASE, ATLANTIC SEAFOOD IS SUPPOSED TO MAINTAIN THE BUILDING AND KEEP EVERYTHING IN GOOD CONDITION. WHAT WOULD IT TAKE -- CODE ENFORCEMENT ISN'T GOING TO GO OUT.

BECAUSE THE DIRECTION FROM THE CITY COMMISSION IS AND OUR CITY ENGINEER AND BUILDING DEPARTMENT, THERE HASN'T BEEN AN UNSAFE BUILDING CASE BROUGHT AND THAT'S REALLY WHAT IT WOULD BE.

MAINTENANCE OF STRUCTURES IS A CHOICE AT THE DISCRETION OF CODE ENFORCEMENT AND THEY HAVE CHOSEN NOT TO.

AND I'M ASSUMING THAT'S AT THE DIRECTION OF THE CITY COMMISSION. MEANING NOT THAT BEHIND CLOSED DOORS WE WOULD HAVE HEARD IT HERE, BE YOU THE CITY COMMISSION HASN'T EXPRESSED ANY CONCERN AND IF SOMEBODY FROM THE PUBLIC CALLED CODE ENFORCEMENT TO MAKE A COMPLAINT, NO MORE ANONYMOUS COMPLAINT, SOMEBODY COULD CALL AND MAKE A COMPLAINT AND THEY WOULD SAY THAT THEY COULD GET BACK TO THEM OR LOOK INTO IT.

AND I'M SURE THAT CODE ENFORCEMENT WOULD GO TO THE CITY MANAGER'S OFFICE AND THE CITY MANAGER WOULD PROBABLY SAY TO LEAVE IT ALONE BECAUSE THAT'S WHAT THE CITY COMMISSIONERS ARE WAITING FOR A NEW PLAN. AND YOU MAY ASK HOW LONG, I CAN'T ANSWER THAT. YOU HAVE TO ASK YOUR CITY COMMISSIONERS. I KNOW THAT'S PROBABLY NOT A GOOD ANSWER, HOWEVER WE GET THIS BUILDING GONE, MOVED, IMPROVED, IT'S GOING TO BE THROUGH DEMOLITION AND A NEW STRUCTURE.

IN ABOUT 18 MONTHS, THE CITY IS GOING TO BE, WE THINK

APPROXIMATELY, READY TO AND NEED TO DEMOLISH THE STRUCTURE SO THAT THE SEAWALL CAN BE CONSTRUCTED IN THAT LOCATION.

AND AT THAT TIME WE PLAN TO TAKE THAT UP.

UNDER THE LEASE THEY HAVE TO LEAVE THE BUILDING.

SO IF THERE IS NO PLAN AND NO PLACE TO GO, THEY HAVE A RIGHT TO BUILD UP TO 1200 SQUARE FEET. WE KNOW THAT MR. SALTMARSH IS LOOKING FOR MORE. MY UNDERSTANDING IS THAT HE HAD A FAMILY MEDICAL EMERGENCY HE WAS TENDING TO FOR ABOUT A MONTH AND SO IT WAS HARD TO GET IN TOUCH WITH HIM, BUT HE'S BACK ON THE SCENE AND MY UNDERSTANDING IS HE IS TALKING INDIVIDUALLY WITH CITY COMMISSIONERS ABOUT A NEW PLAN.

I GUESS IT'S SCALED DOWN ABOUT 500 SQUARE FEET.

IT WAS ABOUT 4600 MAYBE A LITTLE MORE THAN THAT.

SO IT'S STILL OVER 4,000 AND THAT'S JUST OFF THE TOP OF MY

I THINK COMMISSIONER ROSS ALSO SAID SOMETHING ABOUT IT'S ACTUALLY NOT CODE ENFORCEMENT THAT WOULD BE INVOLVED WITH THAT BECAUSE THE BUILDING DEPARTMENT WOULD BE --

IF HE FINDS THAT IT IS NOT SAFE AND UNSAFE UNDER THE ABATEMENT CODE MEANS LIKELY TO PARTIALLY OR TOTALLY COLLAPSE.

SO THAT IS THE BUILDING OFFICIAL'S DECISION IF THEY WANT TO GO OUT THERE. AND THAT'S AGAIN STRUCTURAL.

THE MAINTENANCE OF STRUCTURE, THAT'S REALLY AN AESTHETIC THING THAT WE USE UNDER OUR CITY CODE OF ORDINANCES.

AND BY DOING THAT, HE IS TRYING TO FIND A DESIGN THAT IS GOING TO FIT ALL OF THE ADA ACCESSIBLE BATHROOMS, I'M ALMOST CERTAIN HE'LL WANT THE SECOND STORY OF SOME TYPE EVEN IF IT'S JUST A DECK. HE'LL NEED AN ELEVATOR, MAKING ROOM FOR ALL OF THOSE 150 SEATS AND A KITCHEN AND STORAGE IS I THINK WHAT HE'S STRUGGLING TO DO.
