WE ARE GOING TO PROCLAIM IT NATIONAL COLONIAL HERITAGE MONTH SO HERE WE GO.

WHEREAS ESTABLISHED IN 1950 THE NATIONAL SOCIETY COLONIAL DAVE'S.

I HAVE 17. IT'S THE 17TH CENTURY AS AN ORGANIZATION OF WOMEN 18 YEARS OF AGE OR OVER WHO ARE LINEAL DESCENDENTS OF AN INCEST OR WHO ARE PRIOR TO 1701 AND ONE OF THE ORIGINAL COLONIES OF THE USA. WHEREAS THE SOCIETY IS COMPRISED OF CHAPTERS LOCATED IN 46 STATES. THE DISTRICT OF COLUMBIA AND CANADA. THEY SHARE A COMMON INTEREST IN AMERICAN HISTORY WITH LOVE AND RESPECT FOR OUR GREAT NATION AND A DESIRE TO WORK TOGETHER IN HARMONIOUS FELLOWSHIP.

THIS IS AN EFFORT TO PERPETUATE THE MEMORY OF THE COLONISTS AND THEIR LASTING LEGACY WHICH IS THE FOUNDATION. WHEREAS THE PRINCESS EMILIO CHAPTER OF THE NATIONAL SOCIETY IN THE 17TH CENTURY IS LOCALLY SPONSORING NATIONAL COLONIAL HERITAGE MONTH DURING THE MONTH OF OCTOBER 2023 WHICH IS THIS MONTH WHERE IS BY VIRTUE OF THEIR LINEAL DISSENT FROM OUR NATION'S EARLIEST ARRIVALS THE MEMBERS OF THE SOCIETY FEEL AN OBLIGATION TO HONOR THE HARDSHIPS AND HEROISM OF THOSE THAT SOUGHT SPIRITUAL AND ECONOMIC FREEDOM WHEREAS THIS COUNTRY'S FIRST ARRIVAL CONTINUE TO CONVEY THE TWO TRUE MEANING OF INHERITANCE BY

REMINDING US THAT THE SALUTE AND THE FREE COUNTRY AND RESPECTING ITS FLAG WITHIN ENEMIES. WE WILL PUT THE CITY STILL ON THIS PROCLAMATION.

AS YOU SEE WE HAVE A POSTER ABOUT IT. OUR CHAPTER IS THE PRIMARY FOCUS WHICH IS TO RECOGNIZE THE HISTORICAL PRESERVATION. ONE OF OUR MEMBERS HAS DESIGNED THE POSTER ABOUT THE HERITAGE MONTH AND WE ARE DISTRIBUTING THIS TO LOCAL SCHOOLS.

[6.2 LICENSE AGREEMENT - PEDESTRIAN CONNECTION - RESOLUTION 2023-178 GRANTING A LICENSE AGREEMENT TO OCEAN COAST FERNANDINA LLC AND AMELIA FERNANDINA LLC ON UNIMPROVED FIRST AVENUE FOR THE PURPOSE OF BUILDING AND MAINTAINING A PEDESTRIAN CONNECTION; AUTHORIZING EXECUTION; AND PROVIDING FOR AN EFFECTIVE DATE. ]

WHAT'S KNOWN AS OCEAN POST HOTEL AND AT THE CORNER THERE THE AMELIA HOTEL AT THE BEACH.

THEY WOULD LIKE TO CONNECT THE TWO PROPERTIES BY BUILDING OF BOARDWALK OR WALKWAY ACROSS THE FIRST AVENUE RIGHT WAY. FIRST THEY ASKED THE CITY FOR AN EASEMENT AGREEMENT.

THAT WASN'T SOMETHING THAT I THOUGHT WE SHOULD DO BECAUSE IT'S A TYPE OF PROPERTY RIGHT.

LICENSE AGREEMENT, THIS PARTICULAR AGREEMENT TO ALLOW FOR THE CONSTRUCTION OF THE WALKWAY AND I UNDERSTAND THAT IT HAS A ROUGH DRAWING WITH IT. THAT IS WHAT WE GOT.

THE LICENSE AGREEMENT CAN BE TERMINATED BY THE CITY WITH FOUR MONTHS NOTICE.

120 DAYS NOTICE SO THERE IS NO PROPERTY RIGHT AND THIS IS NOT FOR A PERIOD OF YEARS NECESSARILY. THE CITY NEEDS THE RIGHT-OF-WAY THEY WOULD GIVE NOTICE AND THEN

YOU ARE EITHER ALLOWED TO GO ACROSS THE WALK OVER TO THE OTHER HOTEL AND THEN YOU GO DOWN TO SADLER WITH THE CIRCLE. THEY PROBABLY HAVE MORE STEPS BECAUSE THEY HAVE TO GO UP THE CROSSOVER. THEY WOULD HIT A POINT ON FLETCHER WHERE IT'S NOT SAFE TO CROSS AND THEN IF THEY CROSS THEY WOULD BE AT A PRIVATE PROPERTY.

THEY HAVE TO GET THEMSELVES TO THE CIRCLE AT SADLER AND FLETCHER.

I'M NOT SURE IN WHAT WAY THE RESIDENTS WILL BENEFIT FROM THIS OR GRANTING THIS.

I CAN'T ACTUALLY THINK OF A SINGLE ONE. ACTUALLY I'M THINKING OF THE TOURISTS THEY COULD ACROSS 200 FEET THROUGH THE CROSSOVER THAT WOULD SAVE 200 FEET OF PUBLIC SIDEWALK. I DO NOT UNDERSTAND WHY. MY BIGGER CONCERN IS WHAT WOULD HAPPEN IN OCEAN AVENUE. PEOPLE DON'T WANT TO GO UP THOSE BIG CROSSWALKS.

REAL PROBLEM IS. THIS ELEVATION IS 17 FEET AT THE BOTTOM OF THAT.

IT'S 1 FOOT. YOU CAN SEE HOW CLOSE TOGETHER THESE ARE.

IT'S BASICALLY A 17 BUT ALL VERTICAL DROP THAT THEY WANT TO PUT THIS BOARDWALK UP.

THE BOARDWALK WOULD GO RIGHT IN HERE. IF YOU GO TO THE NEXT THIS IS FROM THE BOTTOM LOOKING THROUGH. YOU CAN SEE THE CANOPY HERE THAT THIS WOULD HAVE TO GO THROUGH. I READ THEIR LEASE AND I HAVE A BUNCH OF QUESTIONS THAT I ASKED AND HE ANSWERED THEM. THE FIRST ONE IS THE PROPOSED BOARDWALK FROM 1 FOOT TO 17 FOOT. IT APPEARS TO BE A SECONDARY DUNE AND IT SHOWS WHAT THE INSTALLATION OF THE BOARDWALK WITH THE STABILITY.

IT'S THE SECONDARY EROSION AND THAT DEMON WILL WROTE AWAY. THERE IS NO PLAN IN HERE ON HOW YOU WILL DEAL WITH THE EROSION. THERE IS NO PLAN OR LEASE HERE FOR HOW WIDE THIS WOULD BE.

SO WE ARE JUST GRANTING BOARDWALK THAT DOESN'T SAY HOW WIDE IT WILL BE.

DOESN'T TALK ABOUT WHAT THEY WOULD DO WITH THE GOPHER TURTLES THAT ARE LOCATED THERE.

IT DOESN'T TALK ABOUT HOW IT WILL PRESERVE THE EXISTING TREES THAT ARE THERE THERE IS SOME TREES THAT ARE ALMOST HERITAGE SIZED . MY LEGAL CONCERNS ARE CONNECTING TO PARKING LOTS. ARE THEY GOING TO ALLOW UNLIMITED ACCESS TO THE PUBLIC PARKING LOTS? AND AGAIN HOW MUCH THE AREA IS AVAILABLE FOR THE LICENSED.

WHAT HAPPENS TO THE OWNERSHIP OF THESE TWO PROPERTIES SO IT'S ON EITHER SIDE.

IT DOESN'T ADDRESS HE WILL REMOVE THE BOARDWALK IF THE AGREEMENT IS TERMINATED.

IF THE AGREEMENT IS TERMINATED IT DOESN'T ADDRESS 88 ACCESSIBILITY.

IT DOESN'T ADDRESS HOW THE CITY WILL BE MADE AWARE OF HOW THEY WILL MAINTAIN THIS BOARDWALK.

THE AGREEMENT DOES NOT STATE THAT CONSTITUTES ABANDONING THE RIGHT-OF-WAY AND IT SHOULD BE IN THERE IF THEY SHOULD DO THIS. THERE'S A SEVERABILITY CLAUSE.

A PART OF THIS GETS DINGED IN COURT AND THE REST REMAINS. THAT SHOULD NOT BE IN THEIR BECAUSE IT COULD BE FAVORABLE TO A CITY AND THEY WOULD STILL HAVE THEIR BOARDWALK.

IT DOESN'T ADDRESS WHAT HAPPENS IF THIS BOARDWALK IS NOT BEING MAINTAINED.

SUPPORT THIS AGREEMENT UNTIL WE HAVE A WRITTEN ANSWER TO THOSE QUESTIONS.AND FOR FURTHER CONSIDERATION. I WOULD HOPE THAT WE WOULD JUST HAVE THIS POSTPONED TO ANOTHER

THAT'S MONEY THAT THEY ARE BRINGING TO THE COMMUNITY TO REINVEST THIS ENTIRE PROPERTY. FROM WHAT I UNDERSTAND NOTHING ON THE PROPERTY IS GOING TO STAY THE SAME. OTHER THAN SIZE OF IT.

IT'S GOING TO BE COMPLETELY RENOVATED. WE ARE GOING TO SEE THIS BE A JEWEL FOR THE CITY OF FERNANDINA BEACH AT THESE TWO HOTELS.

THE REASON IN THE ASK IS SIMPLE. IT'S TRYING TO MAKE THIS RESORT AREA. IT WOULD BE MUCH LIKE YOU SEE THE OMNI SO START PICTURING THAT IN YOUR MIND. YOU'RE GETTING A REINVESTMENT ON A COMMERCIAL PROPERTY WORKING WITH THESE PARTNERS. THIS BRINGS AN EXTRA TAX REVENUE WHICH WE ARE USING FOR MANY PROJECTS SPECIFICALLY THERE AT THE PARK THAT WE AGREED TO MOVE FORWARD WITH.

WHEN I LOOK AT THIS I UNDERSTAND THAT COMMISSIONER ROSS HAS A LOT OF QUESTIONS THAT I THINK CAN BE ANSWERED AND WHEN THIS PROCESS GOES FORWARD AND WE START LOOKING AT THE CONSTRUCTION THAT'S GOING TO TAKE PLACE WITH THOSE TWO HOTELS WE LOOK AT THE ANSWERS

TO HOW THIS WILL BE DONE. IT MAY NOT BE SPECIFICALLY RIGHT WHERE IT STATED BUT IT COULD BE A LITTLE BIT FURTHER NORTH OR SOUTH. OWNER IS SO AND IN ORDER TO PROCEED BECAUSE NOT STAND THE COMMISSIONERS AND THE COMMUNITY

IT WILL BE A HOLIDAY AND RESORT SO EVERYTHING IN THAT PIECE OF PROPERTY WILL BE TOUCHED AND RENOVATED. THAT MAIN BUILDING WHERE THEY HAVE THAT OFFICE AND THE BAR WILL BECOMPLETELY RENOVATED . NOTHING WILL LOOK LIKE IT DOES NOW.

IT WILL BE A REALLY BEAUTIFUL OF PROPERTY THE POOL DECK WILL BE EXPANDED.

THERE WILL BE A LAZY RIVER WHERE THE CHILDREN CAN PLAY IN. BECAUSE AMELIA HOTEL WHICH WILL ALSO GET RENOVATED AND WE WILL DO THE LANDSCAPING IN FRONT OF THE HOTEL SO THAT THAT BEAUTIFUL CIRCLE WORKING WITH THE PLANS THAT YOU HAVE TO DO THOSE WALLCOVERINGS.

THAT PROPERTY DOESN'T ACCOMMODATE ANYTHING BIGGER THAN THAT SMALL POOL THAT THEY HAD SO WE WANT TO HAVE IT SO THAT THOSE GUESTS CAN COME OVER AND USE THOSE FACILITIES AS WELL.Y DOING THAT THE ADDED BENEFIT IS THAT WE COULD CHARGE A HIGHER RATE WHICH MEANS YOU GET MORE BAD TAX FROM US SO IT IS A WIN WIN AND REALLY MAKE A BEAUTIFUL SECTION OVER THERE THAT'S WHAT WE ARE OUT TO DO QUICK THANK YOU FOR BEING WITH US TONIGHT WE APPRECIATE IT.
