[ 1. CALL TO ORDER] [00:00:13] >> CALLED TO ORDER THE DECEMBER 6, 2022 REGULAR MEETING OF THE CITY COMMISSION. MADAME CLERK WILL YOU PLEASE CALL THE ROLE. >> THANK YOU. VICE MAYOR LEADERS THROUGH THE PLEDGE AND REMAIN STANDING FOR THE INVITATION BY REVEREND PALMER. >> I PLEDGE OF ALLEGIANCE TO THE FLAG OF THE UNITED STATES OF AMERICA AND TO THE REPUBLIC FOR WHICH IT STANDS ONE NATION UNDER GOD INDIVISIBLE WITH LIBERTY AND JUSTICE FOR ALL. >> THANK YOU TO THIS COMMUNITY WE WANT THE WISDOM TO HELP US MAKE TOUGH DECISIONS. WE ALL SAY TOGETHER, AMEN. >> PERSONAL DEVICES WHICH YOU WOULD -- IF YOU WOULD PUT THEM [4.1 PRESENTATION - NASSAU HUMANE SOCIETY] ON SILENT. I HAVE ITEM 4.1 NASSAU HUMANE SOCIETY. WELCOME. >> SO THIS IS MY BUDDY CONWAY AND HE IS OUR RESIDENT DOG AT THE SHELTER. HE IS A YEAR END A HALF AND HE HAS BEEN THERE ALMOST A YEAR. HE WAS PULLED FROM THE SHELTER IN JANUARY. HE IS PERFECT EXCEPT HE DOESN'T REALLY LIKE OTHER DOGS. IF YOU HAVE ONE WE WOULD BRING THEM FOR A MEET AND GREET. HE LOVES PEOPLE, HE LOVES KIDS, ... IT ON YOUR LAP. AND OTHER THAN THAT HE'S GREAT. HE WILL NOT BE AT OUR THERE AT 63918 AIRPORT ROAD AND YOU CAN VIEW ALL OF OUR DOGS AND CATS AT YOU MAY.COM. AND IF YOU KNOW OF ANYONE WHO IS IN NEED OF PET FOOD FOR THEIR DOGS OR CATS WE DO HAVE A FOOD BANK. AND WE ARE STARTING A LITTLE LOW COST CLINIC. ANYONE WHO NEEDS HELP WITH THAT WE CAN HELP WITH THAT AS WELL. [4.2 PRESENTATION - FERNANDINA BEACH MAIN STREET PROGRAM ] >> OKAY ITEM 4.2 PRESENTATION, FERNANDINA BEACH MAIN STREET PROGRAM. WELCOME. >> NAME AND ADDRESS FOR THE RECORD. >> LIZZA FINKELSTEIN 492 START LANDING, FERNANDINA BEACH. THIS IS OUR 1ST QUARTER REPORT FOR THE MAIN STREET ACTIVITIES. I'M GOING TO COCOUNSEL BY COUNSEL, THERE IS QUITE A BIT LISTED AND I WILL HIGHLIGHT A FEW THINGS. WITH OUR ECONOMIC VITALITY COUNSEL WE ARE LOOKING TO SUPPORT BUSINESSES. WE PROVIDE WEEKLY E-MAILS WITH ANY INFORMATION REGARDING STREET CLOSER OR ANYTHING LIKE THAT. [00:05:06] I DID HAVE AN E-MAIL I WANTED TO SHARE AS A RESULT OF LAST WEEK'S E-MAIL TO THE BUSINESS FROM ONE OF OUR LOCAL BUSINESSES. FIRST I WANTED TO EXPRESS MY GRATITUDE FOR YOUR TIME AND EFFORT PROVIDING THE INFORMATION TO LOCAL BUSINESSES ABOUT WHAT IS HAPPENING DOWNTOWN. I USE THIS TO HELP MY MANAGEMENT TEAM ADEQUATELY PREPARE AND KEEP STEPPING FORWARD. WE DO HEAR THAT A LOT THAT IT IS BENEFICIAL TO THE BUSINESSES TO KNOW WHAT IS GOING ON. THE OTHER THING WE HEAR IS OUR SOCIAL MEDIA REACH. WE SHARE THE LOCAL BUSINESS POSTS ON OUR PAGE. IN THE LAST 90 DAYS, WE HAVE HAD OVER 75,000 SOCIAL MEDIA REACH ON FACEBOOK AN INSTAGRAM. IT IS SIGNIFICANT AND THEY DO APPRECIATE THAT WE DO THAT. CRITIQUE REGARDING OUR ORGANIZATION COUNCIL THEY ARE WORKING TO SUPPORT OUR ORGANIZATION. ONE THING THEY WORK ON IS THE BEER FESTIVAL. WE HELD THAT THIS YEAR ON OCTOBER 1. WE HAD 1900 ATTENDEES IT WAS ROUGHLY DOUBLE THE SIZE LAST YEAR. TWENTY-SEVEN BREWERIES AND THAT WAS VERSUS 12 LAST YEAR. WE ARE PLANNING FOR OUR NEXT LINE THE FIRST WEEK IN OCTOBER NEXT YEAR END THAT WILL BE OCTOBER 7. SO WE ARE LOOKING FORWARD TO THAT. THE PROMOTIONS COUNSEL THERE GOAL IS TO BRING PEOPLE INTO DOWNTOWN, INTO THE BUSINESSES WHETHER RESTAURANTS OR RETAIL. AT TIMES WHEN IT IS TRADITIONALLY SLOW LIKE AUGUST OR FEBRUARY, AND WHEN THEY NEED THAT LITTLE BUMP. SO WE HAVE DONE A SERIES OF EVENTS THAT IT HAS BEEN BUSY IN THE FALL WOULD TRICK-OR-TREAT AND MANY OTHERS COMING OUT. WE DID WANT TO HIGHLIGHT THE WINDOW PAINTING. WE HAVE 22 LOCATIONS THAT PARTICIPATED. BOTH ON EIGHTH STREET AND DOWNTOWN. THERE IS A MAP AVAILABLE WE ARE PUTTING ON SOCIAL MEDIA FOR THOSE LOCATIONS. BUT THIS PROGRAM IS MORE IMPORTANT THAN BRIGHTENING UP DOWNTOWN. I KNOW THIS FROM THEIR TEACHER. THEY PLAN THE DESIGN FOR THE WINDOWS. THEY WORK ON THE LAYOUT. THIS IS A GOOD PLACE FOR THEM TO SHOWCASE THEIR TALENTS SO IT IS A MULTIDIMENSIONAL PROJECT AND WE ARE HAPPY TO MAKE THAT HAPPEN. THE DESIGN COUNSEL, THEY HAVE BEEN BUSY ON STREETSCAPE ELEMENTS. AS YOU KNOW WE TALKED A LITTLE BIT ABOUT THE SIDEWALKS AND THE STREETLIGHTS, AND WE HAVE BEEN EVALUATING AN RFP ON THE STREET DESIGN STUDY AND THAT WOULD BE NEW STREETLIGHTS FOR THE DOWNTOWN DISTRICT. AND LOOKIN TOWARDS NEXT YEAR, ADDITIONAL FOCUS ON HOW WE BEAUTIFY EIGHTH STREET AND MAKE IT MORE WALKABLE AND SAFER, AND IF WE NEED TO GO BLOCK BY BLOCK WE WILL DO THAT. BUT WE ARE STARTING TO MAKE PROGRESS THERE. WE HAVE BEEN SEVERAL BUSINESS OWNERS THAT ARE NOW ON OUR BOARD OR COUNCIL SO THEY ARE GIVING US VALUABLE INPUT INTO THOSE AREAS, SO WE ARE EXCITED ABOUT THAT. AS FAR AS FINANCES GO THIS IS A GLIMPSE AT WHAT WE HAD AS A BUDGET FOR LAST YEAR. OUR FISCAL YEAR RUNS THE SAME AS THE CITY. AS YOU CAN SEE AS FAR AS REVENUE WE ENDED UP ABOUT WHERE WE PROJECTED WE WOULD. WE WERE OVER ON OUR FUNDRAISING BECAUSE THE ISLAND HOP EVENT WAS, TWICE AS SUCCESSFUL AS IT WAS LAST YEAR SO THAT GAVE US A BALL. [00:10:01] IN TERMS OF THE EXPENSES, THEY WERE PRETTY MUCH WHERE WE THOUGHT THEY WOULD END UP. SO WE HAD A LITTLE MORE SURPLUS. WE ARE WORKING RIGHT NOW ON DEVELOPING A FAƇADE AND GRANT PROGRAM THAT WE ARE HOPING TO UNVEIL IN THE 1ST HALF OF BETWEEN THREE. THE BUDGET FOR THE COMING YEAR, IT IS FAIRLY SIMILAR, A LITTLE BIT HIGHER. WE HAVE BUMPED UP THE FRONT RAISING BECAUSE OF ILAN OP AND OUR EXPECTATIONS, WHILE WE ARE NOT PLANNING TO GROW THAT IN TERMS OF ATTENDEES, WE ARE PLANNING TO EXPAND IT SO WE ARE ENCOURAGING BOTH PEOPLE THAT LIVE HERE AND PEOPLE WHO WOULD COME HERE FOR THE EVENT TO STAY FOR THE WEEKEND AND ENJOY EVENTS ON SATURDAY AND SUNDAY AS WELL. YOU CAN SEE THE OTHER ITEMS. PREVIOUSLY WE HAD A PAID INTERN AND NOW WE HAVE MOVED INTO SOCIAL MEDIA EXPRESSION. THE BUSINESSES HAVE EXPRESS HOW IMPORTANT THIS IS TO THEM FOR SHARING AND PROMOTING THEIR BUSINESSES. I TRIED TO KEEP IT QUICK AND MAKE THE HIGHLIGHTS. I AM OPEN TO ANY QUESTIONS. >> QUESTIONS OR COMMENTS. >> YOU DO A NICE JOB. [5. PUBLIC COMMENT REGARDING ITEMS NOT ON THE AGENDA OR ITEMS ON THE CONSENT AGENDA] ANYONE ELSE? >> ITEM FIVE, PUBLIC ITEM COMMENTS FOR ITEMS NOT ON THE AGENDA OR THE CONSENT AGENDA. I HAVE SEVEN SPEAKERS. >> I LIVED THERE FULL-TIME I AM HERE TO TALK ABOUT THE TOWNHOMES PROPOSED. 1ST AND FOREMOST IN THOSE 32 YEARS, NEVER HAS WATER STOOD ON THE EAST SIDE OF FOURTH STREET. YOU WILL READ THAT -- RAISE THAT AND THESE 20 INCHES. WATER WILL RUN ALL. I DON'T CARE WHAT THE PROPOSALS ARE, I DON'T CARE WHAT THEIR PLANS ARE WATER SEEPS ITS OWN LEVEL. WE WILL HAVE WATER PROBLEMS. IF NOTHING ELSE, WATER WILL BE A PROBLEM. SECOND WEEK IT IS AN ISSUE OF MAXIMIZING PROPERTY VALUES FOR THE LAND OWNER. WHETHER IT IS THE FAMILY AND THEIR ERRORS, ACCORDING TO THE CONTRACTORS NOTHING ON THE PROPERTY. THAT IS NOT PERMISSION FOR DEVELOPING THE LAND DEVELOPMENT CODE. IT DOESN'T MATTER THAT PEOPLE HAVE BEEN ALLOWED TO DO OTHER THINGS. IT CHANGES THE CHARACTER OF OUR NEIGHBORHOOD. THERE ARE FIVE SITES THERE. IT DOESN'T REVERT BACK TO THE LOT. THEY WILL HAVE TO GO THROUGH A PROCESS TO DO THAT. IF THEY DON'T, THEY WILL MAXIMIZE THEIR VALUE BY SELLING IT FOR THOSE BUILDING SITES. HOWEVER, JUST BECAUSE IT HAS BEEN ALLOWED IN THE PAST DOES NOT MEAN IT SHOULD BE ALLOWED NOW. THERE IS NO CONSTITUTIONAL LAW TO DO THAT. THE LAW OF THE LAND IS THE PLANNED DEVELOPMENT CODE HAS BEEN OVER 20 YEARS. I WAS SO THE PROPOSAL IS THEY WERE ABLE TO DO IT BEFORE. WELL THOUGH THREE GUYS THAT GOT ARRESTED EARLIER THIS WEEK THEIR CONSTITUTIONAL DEFENSE WILL BE WELL MY BUDDY DID IT A MONTH AGO AND DID NOT GET ARRESTED. THAT IS THE SAME LOGIC AND IT DOES NOT WORK THAT WAY. IF HYPOTHETICALLY, THERE WAS URANIUM UNDER THE PROPERTY IT [00:15:03] WOULD NOT ALLOW THEM TO ALTER THE GUIDELINES. IT WOULD ALTER THE WHOLE PURPOSE OF DOWNTOWN AND RESIDENTIAL NEIGHBORHOODS JUST LIKE THIS TOWNHOME DEVELOPMENT THEY WANT TO PUT IN THERE. ANYBODY WHO WENT DOWN FOURTH STREET THAT NIGHT OF THE PARADE WILL SEE YOU CAN DO IT. YOST SHOULD NOT ALLOW IT. THANK YOU. >> MISS CHRISTIAN OR. >> VICE MAYOR. , NOT. THE VICE MAYOR HAS SOMETHING TO SAY. >> I WILL MAKE THIS COMMENT NOW AND THERE MAY BE MORE. BUT BASICALLY I SAID THIS BEFORE AND I WILL SAY IT AGAIN. THAT THIS GENTLEMAN SAID THE BOARD IS VERY SPECIFIC. BUT TALK THAT WE ARE INTERPRETING IS INCORRECT. WHAT WE ARE DOING AS THE CITY IS NONCOMPLIANT WITH THE LAW. I WILL SAY THIS AGAIN BECAUSE WHATEVER THEY SAY I WON'T BE HERE AFTER TONIGHT. THE CITY SETS A STANDARD THAT WE DON'T ENFORCE THE LAW THAT IS WRONG. THIS PROJECT SHOULD GO TO THE BOARD OF ADJUSTMENTS AND THEN WE WILL SEE WHAT HAPPENS. THERE IS NO WAIT YOU CAN INTERPRET THE WORDS ANY OTHER WAY. IT'S VERY SPECIFIC. THERE HAS BEEN DISCUSSION WE WILL BRING IN A THIRD-PARTY LAWYER. WE UNDERSTAND THIS, WE ARE JUST NOT DOING IT. >> THANK YOU FOR HAVING ME. I LIVE AT 40 BEECH STREET. I AM HERE TONIGHT TO ASK YOU WHAT THE CITY IS NOT FOLLOWING ITS OWN COMPANY IT'S A PLAN AND LAND DEVELOPMENT CODE. WE HAVE TALKED ABOUT SECTION 1.035 OF THE LAND DEVELOPMENT CODE BUT ADDITIONALLY THIS ONE STATES IN CONNECTION WITH THREE PLOTS WHICH IS WHAT THEY ARE TALKING ABOUT, ALL BUILDING OR STRUCTURES LOCATED IN THESE ZONING DISTRICTS SHOULD BE ERECTED UPON ONE ZONING SITE SUCH BUILDING SITE SHOULD HAVE THE MINIMAL STREET FRONTAGE OF 50 FEET. THEY ARE ASKING FOR 40.5 FEET. ADDITIONALLY, THIS ALSO CALLS FOR 50 FEET OF STREET FRONTAGE. AND ASKING FOR 36 AND A HALF FEET. 30% LOWER THAN THE LAND DEVELOPMENT CODE. IF THIS GETS APPROVED, YOU SAID THE 50 FEET NO LONGER APPLIES. IF SOMEONE COULD MEET THIS YOU HAVE TO ALLOWED THEM OTHERWISE YOU'RE APPLYING THE LAW DIFFERENTLY TO DIFFERENT PEOPLE. STICK WITH THE LAND DEVELOPMENT CODE. AND WE JUST NEED TO STICK WITH IT. ALSO SECTION 1.0206 OF THE FERNANDINA BEACH COMPREHENSIVE PLAN REDEVELOPMENT IS COMPATIBLE AND CONSISTENT WITH THE RESIDENTIAL DEVELOPMENT PATTERN. ALSO BEING CONSIDERED IS PROTECTING THE STABILITY OF THE AREA. CAP IN A NEIGHBORHOOD THAT AS BEEN THIS WAY FOR AT LEAST 75 YEARS AND CHANGING IT DRASTICALLY DOES NOT PROTECT THE ESTABLISHED RESIDENTIAL AREA. I KNOW THINGS HAVE TO CHANGE. I'M NOT A PROPONENT OF THINKING IT WILL REMAIN THE SAME BUT IF WE DON'T APPROVE THESE REPLIED SHE WILL GET THE PROPERTIES A CHANCE TO SAY THERE. SOMEBODY MAY BUY THEM AND DECIDE TO RENOVATE THEM. WOULD THAT BE WONDERFUL FOR THE COMMUNITY IF WE AT THOSE STRUCTURES THAT ARE CONTRIBUTING TO THE ORIGINAL ASSESSMENT OF THE HISTORICAL DISTRICT. I SEE A BRIGHT FUTURE WITHOUT A REPLY AND THANK YOU FOR YOUR TIME, I REALLY APPRECIATE IT. >> MISCARRY. >> GOOD EVENING. I AM HERE ABOUT ANOTHER PROPERTY [00:20:02] YOU ARE AWARE OF. >> NAME AND ADDRESS. >> SANDRA KERRY 1255 FOREST DRIVE. I SENT A PICTURE EARLIER TODAY. THIS SITE IS CONTINUING IN VIOLATION DEMOLISHING THE DUNES, THE SAME THING THAT HAPPENS IN OTHER PLACES ON THE ISLAND YOU HAVE VERBIAGE IN THE CODE THAT IS NOT BEING ENFORCED. BUT TREES ARE BEING KILLED. THEY ARE UPROOTED. THE NATURAL VEGETATION IS GONE AND THIS WALL IS DOING NOTHING. IM HERE ONCE AGAIN TO PLEAD THAT THE CITY GET THINGS IN ORDER WITH THE DUNE PROTECTION THROUGH THE LAND DEVELOPMENT CODE ORDINANCE OR WHATEVER SO THIS KIND OF DEVELOPMENT STOPS. IT IS NOT GOOD FOR THIS ISLAND I KNOW I SOUND LIKE A BROKEN RECORD BUT MANY BEACH COMMUNITIES IN FLORIDA DO NOT HAVE PROTECTION. WE HAVE SOME BUT WE ARE NOT ENFORCING IT. I DON'T KNOW WHO OVERSEES PLANNING AND BUILDING PERMITS BUT SOMEHOW THIS SITE GOT A PRIVATE INSPECTOR WHICH IS WHY I BELIEVE THIS WAS ALLOWED TO HAPPEN. SO I AM PLEADING ONCE AGAIN FOR THE CITY TO DO SOMETHING ABOUT PROTECTING THE DUNES. WE HAVE HAD FUNDING PROBLEMS MANY TIMES. THE OTHER PROBLEM IS TO DRIVEWAYS THAT WAS APPROVED. UNBELIEVABLY TORN OUT THE LANDSCAPING. WHEN IT RAINS, THERE IS A REAL PROBLEM. WHEN YOU PUT INTO MORE DRIVEWAYS, FORGET THAT PROBLEM. YOU WILL HAVE MORE FUNDING THAN WE ALREADY DO. >> THIS GOES TO. >> THIS WAS ORIGINALLY ON FIRST AVENUE. THE CITY COMP PLAN DIRECTED THE CITY A PLAN PROTECTION ZONE WHICH THEY DID. THIS IS THE ONE EXCEPTION THAT YOU NEED THERE. AND BASED ON WHAT THE MAYOR SAID. THERE ARE SOME THAT ARE MORE STRINGENT AND I WOULD SUGGEST THAT SOMEHOW WE INVOLVE THE PLANNING DEPARTMENT, BUT WHAT WE MAY HAVE TO DO IS START AT SCRATCH AND DEVELOP OUR OWN. AND WE ARE GOING TO HAVE TO SET THE TONE AND TAKE THE LEAD ON THIS. WE CANNOT COPY OVER WHAT IS NOT THERE AND WE SHOULD CONTINUE TO MOVE FORWARD AS BEST WE CAN. AND I WILL NOT BE A CITY COMMISSION ANYMORE BUT I WILL CONTINUE TO WORK ON THIS. >> CAN YOU UPDATE US, WE MET A FEW WEEKS AGO AND TALKED ABOUT THE PROVISIONS THAT WE HAVE TO ADD TO THE CODE AND HE'S WORKING ON THAT. WE HAD A MEETING WITH ANGIE LESTER FROM THE BUILDING DEPARTMENT AND HE'S ALSO GOING TO REVIEW THE ORDINANCE MANY THINGS IN THE DEVELOPMENT CODE, [00:25:12] THEY ARE NOT BAD. WE HAVE TO CONSISTENTLY ENFORCE THEM. I THINK THE ISSUE, THAT THE LADY BROUGHT UP ABOUT OUTSIDE INSPECTORS AND I DON'T KNOW HOW TO CONTROL IT BUT THAT BECOMES A PROBLEM AND A RETENTION WALL IS BEING BUILT. AND WHAT WE TALKED ABOUT. IF I CAN QUOTE THE CITY, WHATEVER HIS JOB IS, THEY ARE WORKING ON IT. BUT THEY HAVE TO WORK HARDER I THINK. >> I UNDERSTAND THAT. I DIDN'T WANT TO MENTION ABOUT PRIVATE PROVIDER INSPECTIONS. BUT THE SITE ITSELF IS SOMETHING WE CAN DO REGARDLESS IF THERE PRIVATE PROVIDERS. THAT HAS NOTHING TO DO WITH IF THE CITY CAN PROTECT THEM. >> OKAY, THANK YOU. NEXT. >> WHICH ONE DO YOU WANT ME TOO DO? >> I HAVE ATLANTIC SEAFOOD FOR THE FIRST I'LL CALL YOUR FOR THE CYCLE APPEARED. >> AND MARIAN PHILLIPS OLIVETTE 724 SOUTH SIXTH STREET. I WOULD LIKE TO ADDRESS, PUT ON A SECOND. ONE THING I WILL TALK ABOUT TONIGHT, WE ARE TALKING ABOUT ATLANTIC SEAFOOD IS THE DESIGN OF THE NEW ATLANTIC SEAFOOD. NO ONE WANTS TO SEE IT TORN DOWN. BUT WE ALL KNOW THE BUILDING IS ABOUT TO FALL DOWN LITERALLY. I LOOKED OVER THE -- AND MY ANSWER IS NO. THIS CONCEPT DOES NOT MATCH OUR SMALL TOWN ATMOSPHERE. IT LOOKS LIKE A CHAINSTORE RESTAURANT. NOT A LOCAL FISH, BAIT AND TACKLE STORE. WHAT ABOUT THE BOAT RAMP. THIS IS OBSTRUCTIVE. THE ONLY PEOPLE WHO COULD ENJOY THE SUN SETS ON THOSE WHO TO EAT AND BY SEAFOOD THERE. IF HE WANTS TO REBUILD ATLANTA SEAFOOD BUILT IT LOOK LIKE THE CURRENT BUILDING. SO IT WILL KEEP WITH OUR WATERFRONT. WE NEED TO BUILD SOME DOCS SO THE SHRIMP BOATS CAN RETURN. I KNOW YOU GET TIRED OF ME SAYING THAT BUT THE BOTTOM LINE IS BUSY. HOW CAN YOU SAY THAT FERNANDINA BEACH IS THE BIRTHPLACE OF THE MODERN SHRIMP INDUSTRY IF WE HAVE NO PLACE FOR THE BOAT TO TIE UP. I URGE THE CITY COMMISSION TO REJECT THE CURRENT PLAN AND PROTECT OUR SMALL TOWN ATMOSPHERE. THANK YOU. >> ( INDISCERNIBLE ) I WAS GLAD TO ADDRESS THE MASTER-PLANNED. THAT IS WHAT I WAS GOING TO DO A PSA ABOUT TONIGHT. THE ITEM THAT WAS MOST CRITICAL WERE THE SUGRUE SHIP AND TRANSPORTING FERTILIZER TO RECORD LEVELS AND INCLUDING THE SECOND GATE. AT OUR SECOND STAKEHOLDER MEETING, HE SAID IT BEST PRACTICE CITY WAS AGAINST ANY ITEMS, AND THEY WOULD PULL THEM OUT. THAT SECOND MEETING IS DETERMINED NUMBER 26. IT IS WELL ADVERTISED THAT WE DO HAVE STAFF THERE AND I AM GLAD YOU GUYS WILL GET TOGETHER WITH [00:30:01] THEM BEFORE THAT. I WANT TO PIPIT OFF OF THAT AND SAY A A FEW WORDS ABOUT THE CURRENT STATE OF AFFAIRS. IT IS NOT UNCOMMON FOR ELECTIONS AND RUNOFFS TO GET HEATED. AND ( INDISCERNIBLE ) THIS IS TEARING OUR COMMUNITY APART. IT IS AS IF BUT THE QUORUM HAS ( INDISCERNIBLE ) HAD BEEN REPLACED BY IMPROPRIETY AND HATE. IT AS MADE ME QUESTION LIVING HERE. COMMUNITY ARE EMPOWERED AND BRING PEOPLE TOGETHER NOT BRING PEOPLE APART. GOOD GOVERNMENT IS WORKING TOGETHER AND FORMULATING THE BEST RESULT REGARDLESS OF POLITICAL PARTY. THIS CAN BE TO BETTER MORE CREATIVE AND INCLUSIVE OUTCOMES. ROSS IS ONE OF THE SMARTEST PEOPLE I KNOW. I DON'T ALWAYS AGREE WITH HIM AND HE CAN FRUSTRATE ME. BUT I KNOW UNDERNEATH HIS LARGER-THAN-LIFE EXTERIOR HE HAS THE HEART THE SIZE OF TEXAS. I DON'T ALWAYS AGREE WITH HIM AND HE CAN FRUSTRATE ME BUT HE CAN ALSO MAKE ME LAUGH AND LOOK AT SOMETHING IN A WAY I NEVER THOUGHT TO LOOK AT IT PREVIOUSLY. MY POINT IS WE ARE ALL DIFFERENT AND THAT IS GOOD. WHAT WE HAVE IN COMMON IS WANTING FERNANDINA BEACH TO BE THE BEST PLACE IT CAN BE NOW AND FUTURE GENERATIONS. WHO ARE WE REALLY. AND HOW CAN WE BE BETTER. HIGH CHESS ASKED EACH OF YOU TO THINK ABOUT WHAT YOU CAN DO PERSONALLY AND COLLECTIVELY TO HELP US HEAL. YOU CAN BE EXAMPLES THROUGH YOUR VOICES AND YOUR ACTIONS OR YOUR SILENCE. PLEASE SET THE TONE AS LEADERS AND LEVERS IT -- APPEAR IN THE NEXT MONTH BEAT THE SOUND VOICE FOR OUR COMMUNITY. THANK YOU. >> TONIGHT IS MY LAST COMMISSION MEETING, FOR SEVEN YEARS. THAT FOLLOWED SIX YEARS ON THE PLANNING ADVISORY BOARD. THIRTEEN YEARS IN THIS CITY. I DEBATED, I WANTED TO SPEAK ON WHAT TAMMY TALKED ABOUT IN THE PERIOD OF 13 YEARS. IT SEEMS WE ARE BECOMING A CITY OF HATE AND DIVERSITY. THIS IS REALLY DISTURBING TO ME AND WHAT IS HAPPENING WITH THIS ELECTION WE HAVE HAD DEATH THREATS AND PERSONAL ATTACKS ON PEOPLE. IT REALLY BOTHERS ME BECAUSE I SPENT TWO YEARS AND COMBAT FOR THIS COUNTRY AND THAT'S WHAT WE ARE ABOUT. WE NEED TO RETURN WHERE WE ARE AS A COMMUNITY. CHANGES. SHE'S -- WE SHOULD MOVE FORWARD THE WAY WE HAVE BEEN. IT IS JUST DISCUSSING WHAT IS GOING ON TO ME. >> THANK YOU SERVER. >> MARION PHILLIPS, I WANT TO ADDRESS THE WELCOME SIGN AT THE LAST MEETING MRS. F GAVE A SPEECH ON CHANGING THE CURRENT SIGNAGE. SHE SAID THE ORGANIZATION SIGNED WOULD BE REMOVED. WHEN ASKED BY A COMMISSIONER WHERE THE SIGNS WOULD GO SHE SAID THEY CAN BE PLACED SOMEWHERE ELSE AROUND THE CITY. THIS IS VERY DISTURBING. FIRST OF ALL LET'S TALK ABOUT THE SIGN. THE CITY FAILED TO DO MAINTENANCE SO WAS IN DISREPAIR. THE WOOD THAT HELD IT WAS DAMAGE FROM HURRICANE IAN. SO THAT IDEA TO REPLACE THE WELCOME SIGN WAS SUGGESTED PAYING FOR THE NEWLY DESIGN ONE. WHO APPOINTED THOSE. HOW AND WHY WHERE THE RESIDENTS NOT ASKED ABOUT SERVING. I SENT ALL OF THE CITY COMMISSIONERS AND A COPY OF THE WELCOME SIGN AND A PICTURE OF THE COMMENTS -- MOST OF THE COMMENTS WAS THAT THE SIGN [00:35:08] SHOULD BE FIXED WITH #SPICE RACK WHERE THEY BELONG. PERSONALLY I DO NOT THINK WE NEED A NEW SIGN. THE CURRENT ONE IS ECLECTIC AND RESEMBLES OUR SMALL TOWN ATMOSPHERE. THEY NEED TO BE PUT BACK WHERE THEY BELONG. THEY MAKE FERNANDINA BEACH THE CITY THAT THEY IS. THIS IS A PART OF WHO WE ARE. I AM A MEMBER OF THE EASTERN STAR AND A PILOT CLUB MEMBER. EASTERN STAR SHOWS THE SIGN WAS THERE. THE PARIS CLUB HAS RECENTLY REPAINTED THEIR SIGN. IF IT NEEDS TO BE REPAINTED, WE HAVE SOMEONE WHO WOULD BE GLAD TO PAINT THE SIGN FOR A NOMINAL FEE. UNLIKE BOOK COSTS OF A MAJOR OVERHAUL. REPLACE THE WOODEN FENCE THAT HOLD SIGNS WITH PLASTIC THAT IS. THIS IS SUPPOSED TO BE LIT UP BUT IT IS NOT I WOULD LIKE THIS I REALLY APPRECIATE THE COMMENTS BECAUSE THIS IS A PARTISAN ELECTION TAKING PLACE. WE SHOULD BE ABLE TO GO FREELY. >> MISS HER. >> JULIE PERERA 501 DATE STREET. I JUST WANT TO SAY THIS IS A SAD DAY FOR ME. I REALLY APPRECIATE THE FIVE INDIVIDUALS WORKING ON THE COMMISSION BECAUSE AFTER YEARS OF PARTICIPATION, YOU FIVE ARE THE MOST RESPONSIVE. AND FOR THOSE OF YOU WHO WON'T BE HERE IN THE NEXT YEAR, I AM REALLY SAD. I WILL SAY THEY HAVE WHAT IS HAPPENING IN THIS COMMUNITY, THIS IS WHAT IT STATES, IN THE CITY CHARTER. AND, I JUST WANT TO ASK YOU TO BRING RESPECT BACK TO THE COMMUNITY BECAUSE IT IS LACKING. THAT IS NOT WHO WE ARE AS A COMMUNITY. THIS PARTNERSHIP HAS NEVER HAPPENED AND ANYONE WHO IS PARTICIPATING IN IT, SHAME ON YOU. ABSOLUTELY SHAME ON YOU. I WANT TO TALK ABOUT THE LEGISLATIVE REVIEW. FLORIDA STATUTE 613, THIS WAS WRITTEN AS A PREEMPTIVE LAW. THE ABILITY TO HAVE A TREE ORDINANCE. WHEN IT WENT INTO EFFECT IT DIDN'T TAKE LONG FOR PEOPLE TO COME AND RELENTLESSLY ABUSE THE LAW THERE IS NO STATE LICENSING AND FILING AN ETHICAL COMPLAINT AGAINST ONE WHO DOCUMENTED THIS SPIRIT WE HAVE WITNESSED A LOT OF LOCAL ABUSES AND WHAT I REMEMBER, YOU ARE ASKED THE CITY ATTORNEY TO RESEND THE STATUTE. [00:40:12] ARE WE MOVING FORWARD AND LET'S NOT LET THIS FALL THROUGH THE CROOKS. >> WOULD ANYONE ELSE LIKE TO COME TO THE PODIUM? >> WHY DON'T YOU COME UP AND THEN WE WILL FOLLOW. WE ACTUALLY HAVE LEGISLATIVE AGENDAS AND I WILL ADDRESS IT. THERE ARE TWO STATUTES AT THAT POINT. >> MY NAME IS JOYCE I LIVE AT 2120 BEACH STREET. I WILL BE REALLY FAST. I HAD THE PRIVILEGE OF HEARING LAST YEAR'S NOBEL PEACE PRIZE WINNER'S BEAK. SHE'S A JOURNALIST FROM THE PHILIPPINES. SHE GREW UP IN THE U.S. ONE OF THE MAIN MESSAGES SHE SPOKE ABOUT, SHE HAD ALL SORTS OF DEATH THREATS ON HER AS A JOURNALIST. THEY WORKED TO HELP US BE MORE SOCIAL. THESE ARE BUILT BY DESIGN, THIS IS TO SPREAD SIX TIMES FASTER. WHEN WE ALL GREW UP, THAT A JOINED YOUR SHOULDER SAYING DON'T SAY THAT IT WAS AN ARGUMENT WITH YOURSELF AND HOPEFULLY THE ANGEL ONE. THE WAY SHE PUT IT, NOT ONLY HAS SOCIAL MEDIA PGH THE ANGEL WITH THE DEVIL HAS GROWN INTO A MONSTER AND WE SAY THINGS ON SOCIAL MEDIA THAT WE WOULD NOT SAY IN PERSON. WHAT SHE SAID IS TROUBLING IN THE U.S. THAT OUR THE LONG-TERM SOLUTION IS EDUCATION, KIDS REALLY NEED TO GROW UP AND LEARN HOW TO USE SOCIAL MEDIA PROPERLY SO WHEN THEY ARE ADULTS THEY KNOW HOW TO USE IT. AND WE HAVE FEDERAL LEGISLATION TO PROTECT US. U.S., JAPAN THEY ARE BEHIND ON SOCIAL MEDIA RULES. AND THE LAST OFFENSE WHEN WE DON'T ANSWER BACK, BECAUSE WE DON'T WANT IT TARGETED ON US, I GIVE US ALL HOPE. BECAUSE SHE GAVE ME HOPE. >> >> VICE MAYOR YOUR LIGHT IS STILL ON. [00:45:18] >> WHEN I WANT TO SAY TO YOU ALL IS, THEY HAVE NO RIGHT TO -- I KNOW THERE ARE RIGHT-OF-WAY ISSUES. THEY CAN'T ALTER THE AMBIENCE OF OUR CITY. THESE PALM TREES WERE AT THE MINIMUM $1,000 EACH. I WOULD LIKE THE CITY TO STAND UP AND SAY YOU ARE NOT DOING THIS AND IF YOU ARE YOU ARE PAYING US WON THOUSAND DOLLARS FOR EVERY PALM TREE YOU REMOVED. ALSO, A YEAR AGO I CAME HERE TALKING ABOUT THEY HAD REMOVED THE LIGHT IN MY NEIGHBORHOOD. MY STREET TURNED FROM THIS TO SOMETHING ON AN ATHLETIC FIELD. WHEN I CAME TO SPEAK I TALKED ABOUT THE CITY GETTING INVOLVED AND TRYING TO MAKE A LIGHT DESIGN. IT HAS BEEN A HERE. NOTHING HAS HAPPENED. I DON'T THINK THEY UNDERSTAND THE GRAVITY THAT WHEN YOU DRIVE DOWN ATLANTIC AND YOU HAVE COLORS THAT ARE GOLDEN AND YELLOW OR GREEN, SOME OF THEM ARE BLUE, THEY KNOW IT IS A PROBLEM WHEN THE WORKER REPLACE MY LIGHT HE SHOWED ME WE NEED TO DECIDE WHAT IS OUR STANDARDS FOR LIKE QUALITY AND WE WILL MOVE FORWARD. I DON'T KNOW IF THAT IS APPROPRIATE HERE BUT THERE ARE A LOT OF THINGS TO BE RESEARCHED AND I WANT YOU TO MAKE THIS HAPPEN BECAUSE IT HASN'T HAPPENED TODAY. THANK YOU. >> IF YOU WILL RECALL, I MADE THE STATEMENT THAT THE FIVE OF US ARE NOT LIGHTING EXPERTS. AND WHAT WE NEEDED WAS A LIGHTING PLAN FOR OUR NEIGHBORHOODS AND DOWNTOWN. THE REALITY OF THE BOARD, IT TAKES THREE OF US TO PUSH THAT FORWARD. IT TAKES THREE OF US. AND AS YOU KNOW, HERE WE ARE A YEAR LATER AND ASKED COMMISSIONER ROSS LIKES TO SAY, THE CAM AS BEEN KICKED DOWN THE ROAD. THE VICE MAYOR BROUGHT IT UP. AND ONCE AGAIN WHAT IS THE PLAN FOR THE CITY. THAT IS THE QUESTION I HAVE. ( INDISCERNIBLE ) THE SIXTH -- THE DECISION WAS WE WOULD LOOK AT THE RENTAL AGREEMENT AND WHAT KIND OF LIGHTS THERE ARE AND WHAT WAS HANDED OUT TO THE MEDIA. AND THAT THE CITY WOULD TAKE THE INITIATIVE, AND WE WOULD TAKE CONTROL AND LOOK AT THE LIGHTING ISSUE. COMMENTING ON THE PALM TREES, THE PALM TREES THAT WERE CUT DOWN, THE INITIAL RESPONSE WAS THE CITY ASKED THEM TO CUT THE PALM TREES DOWN. I THINK YOU SAW THAT. THAT ACTUALLY DIDN'T HAPPEN. THE CITY WAS ADVISED THEY WERE CUTTING THEM DOWN. WHICH THEY HAVE THE RIGHT TO DO. WHETHER WE CAN DO SOMETHING ABOUT THAT, I DON'T KNOW. THE PROBLEM WITH THAT, MUDDIED [00:50:02] THE WATERS ANYWAYS. SO IF THEY COME IN AND SAY THEY WILL CUT THE TREE THAT'S THE CITY GO OUT AND LOOK AT THAT AND THOSE ARE THINGS THAT SHOULD BE DISCUSSED WHEN WE ARE DEALING WITH SOME OF THE OTHER TREES THAT ARE PART OF THE CANOPY WE [6. CONSENT AGENDA] ARE TRYING TO SAY. >> ALRIGHT, THE CONSENT AGENDA [7.1 VOLUNTARY ANNEXATION PETITION FOR WATER SERVICES - 200 BONNIEVIEW ROAD] SIX-POINT ONE IS BEING PULLED. SO NO ACTION ON THE CONSENT AGENDA. ITEM SEVEN RESOLUTIONS, 7.1. VOLUNTARY ANNEX. WATER SERVICES. >> THIS IS A LITTLE OVER A QUARTER OF AN ACRE. STAFF RECOMMENDS APPROVAL. >> A MOTION AND A SECOND, ANY DISCUSSION. I SEE NONE. MENTAL CLERK, PLEASE CALL THE VOTE. >> THE MOTION PASSES 5-0. THE HISTORIC THERE WE -- WE [7.2 FIRST AMENDMENT - AMELIA HISTORIC TOURS, LLC FRANCHISE AGREEMENT ] CHANGE THIS CITY LAW WITH REGARD TO CONSUMPTION OF ALCOHOL ON A TOUR VEHICLE TO COMPLY. THE STATE ALLOWS THAT FOR A VEHICLE FOR HIRE AND AS A PASSENGER YOU CAN CONSUME ALCOHOL. WE CHANGE THE CITY CODE. SO THE TOUR OPERATOR WE AMEND THE FRANCHISE AGREEMENT TO ALIGN WITH CITY CODE. >> MOVED TO APPROVE. >> DISCUSSION? I SEE NONE, MADAME CLERK PLEASE CALL THE VOTE. >> AUTHORIZING CITY STAFF TO [7.3 AUTHORIZING CITY STAFF TO SUBMIT A PRE-APPLICATION FOR THE LOCATION OF AN AMELIA RIVER BULKHEAD] DUPREE APPLICATION FOR THE LOCATION OF FAMILIAR RIVER. >> THANK YOU. ON THOSE THREE PROPERTIES. >> I MOVED TO APPROVE. >> VICE MAYOR. WHAT ABOUT THE OTHER PROPERTIES WHERE THEY DID NOT RESPOND. >> WE WILL CONTINUE TO WORK THOSE. BUT -- FOR THE PROPERTY WHICH IS ON FRONT STREET, THE -- YOU BUILD A WALL THERE, WE WILL HAVE THE AREA WIDE OPEN, CORRECT? >> THIS IS A PRE-APPLICATION TO GET FEEDBACK FROM AGENCIES ABOUT WHERE CAN WE PUT THE ACCOUNT. THEY MAY SAY CLOSER TO SHORE OR FURTHER OUT. >> IDEALLY, IF IT IS APPROVED, MOST LIKELY IT WILL BE APPROVED -- >> AGAPE APPROVES IT ON HIS OWN BECAUSE HE IS NOT PART OF, THEY ARE NOT PART OF THIS COLLABORATIVE APPLICATION. SO THEY WILL HAVE TO DO THAT ON THEIR OWN. >> MY CONCERN IS WE HAVE A GAP [00:55:04] IN THE WALL. >> STAFF WILL WORK ON OPTIONS ON HOW TO ADDRESS THAT. >> MY ONE QUESTION FOR THE WALL IS, WE HAVE A GRANT FOR THE WALL OR IS IT ONLY FOR DESIGN? >> WE ARE ASKING FOR $1 MILLION. THAT CAN ONLY BE ON PUBLIC >> ANY OTHER DISCUSSION. >> THANK YOU COMMISSIONER ROSS. >> IN THE LONG RUN AND LONG HAUL I DON'T WANT TO SEE THE CITY IMPROVING PRIVATE PROPERTY OWNERS OF PROPERTIES SO THAT THOSE PROPERTIES PROPERTIES NOW, EITHER AT EXPANDED SOME OR, THAT -- I JUST THINK WE SHOULD NOT BE APPROVING PROPERTIES SO IN THE FUTURE THEY CAN SELL THEIR PROPERTY FOR MORE. I DON'T THINK THAT IS THE CITY'S RESPONSIBILITY AND I THINK FOR THOSE WALLS IN FRONT OF PRIVATE PROPERTY OWNERS THERE SHOULD BE SOME TYPE OF CAUTIONARY. >> IN OUR AGREEMENT, THEY ARE TO PAY UP TO 7 FEET. >> IS IT 5050? >> >> THIS WAS PART OF THE PACKAGE THESE PROPERTY OWNERS WILL BE RESPONSIBLE FOR THAT IN FRONT OF THE WALL. RIGHT NOW WE ARE JUST TRYING TO SEE WHERE THEY WILL LET US BUILD THE BALL. BUT SOME OF THE DISCUSSION WAS THE PROPERTY OWNER WOULD BE RESPONSIBLE FOR TAKING IT TO ELEVATION NINE. THOSE ARE THE DISCUSSIONS. ONCE THEY TELL US WHERE WE CAN PUT THE WALL, WE WILL KNOW THE CONCEPT SPIRIT. >> WHAT WE ARE GOING FORWARD, AND THE CITY ENGINEER CAN ANSWER THIS. IF WE WERE TO PUT THE CURRENT SEAWALL ON THE WATERLINE, WE DON'T NEED TO APPLY FOR THIS APPLICATION. BUT BECAUSE WHAT WE ARE PUSHING OUT THAT IS WHY WE ARE GOING TO WATER MANAGEMENT AND THE ARMY CORPS OF ENGINEERS TO ASK THEM FOR PERMISSION TO FILL THE WATERS THE STATE, IS THAT CORRECT? >> WERE NOT ASKING ANYTHING ABOUT THE FIELD. WE ARE STAYING WITHIN THE LINE WHICH WAS PREVIOUSLY DEVELOPED. BUT WITHIN THE LINE. >> MADAME CLERK PLEASE CALL THE VOTE. (ROLL CALL). [7.4 SINGLE SOURCE VENDOR APPROVAL - HORTON INC. ] AND THE MOTION PASSES 50. >> THIS SINGLE SOURCE REQUESTS THIS WAS A FEW YEARS AGO. THIS INCLUDES A REVIEW, THIS LED [01:00:15] US TO THE SPECIFIC DOOR WHICH HAS A RECESS WHEN YOU PUSH THE DOOR OUT. AND MR. (ROLL CALL). >> BUDGET AMENDMENT TO REFLECT AWARD OF FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION GLAD. >> WE HAVE ALREADY RECEIVED THE AWARD. BUT WE NOW NEED TO INCORPORATE THE BOARD INTO THE CITY BUDGET. THIS IS INCREASING THE BUDGET BY WHAT I TALKED ABOUT EARLIER. >> RECOMMEND APPROVAL. >> ANY DISCUSSION? I SEE NONE. MADAME CLERK, PLEASE CALL THE VOTE. [7.7 BUDGET AMENDMENT - PARKS AND POLICE DEPARTMENTS] >> BUDGET AMENDMENT PARKS AND POLICE DEPARTMENT. >> THESE PROJECTS WERE BELIEVED TO BE CAPITAL PROJECTS. UPON FURTHER REVIEW THEY ARE NOT. THIS MONEY THAT WAS RECENTLY TRANSFERRED IS BEING MOVE. THIS IS FOR THE ASSESSMENT SO THESE ARE MORE PROFESSIONAL SERVICES RATHER THAN CAPITAL. >> RECOMMEND APPROVAL. >> ANY DISCUSSION? I SEE NONE. MADAME CLERK, PLEASE CALL THE VOTE. [7.8 LEGISLATIVE PRIORITY RECOMMENDATION AND SUPPORT ] >> THE MOTION PASSES 5-0. 718 LEGISLATIVE PRIORITY RECOMMENDATIONS. >> MOVED TO APPROVE. ( INDISCERNIBLE ) I THOUGHT THESE TWO WOULD BE IN THEIR AND THEY ARE NO-BRAINERS. I DON'T KNOW IF WE WILL GET SUPPORT BUT IF WE ARE NOT ASKING FOR IT WITH OTHER PEOPLE I DON'T KNOW HOW WE WILL GET CHANGES. IT WAS THE SECOND ON THE MOTION. >> I WAS. >> ACTUALLY, COMMISSIONER ROSS MADE THE ORIGINAL MOTION. AND THIS IS A MOTION TO AMEND SO >> I AGREE WITH YOU ON THE TREE ORDINANCE, BUT I AM UNABLE TO [01:05:05] SPEND TIME ON SOMETHING I KNOW IS DOOMED TO FAILURE. THERE IS NO APPETITE THE LEAK OF THE CITY NOT WANTING TO SUPPORT THAT AND I DON'T THINK WE SHOULD SPEND TIME ON THAT WE HAVE BEEN DOWN THIS ROAD BEFORE IF WE DON'T HAVE NO LEGISLATIVE DELEGATION AND THERE'S NO APPETITE FOR THAT. I AM NOT WILLING TO SPEND TIME AND EFFORT ON THAT, THAT IS MY FEELING. >> AND I HAVE SAID FROM DAY ONE IT WOULD BE DIFFICULT SO WE WILL SIT BACK AND THERE ARE PEOPLE OUT THERE TRYING TO DO IT. WHY TAKE THE EFFORT, IT JUST DOES NOT MAKE SENSE TO ME ALL YOU HAVE TO DO IS SAY AS A DELEGATION WE WANT YOU TO RESEND THE LAW. IT COSTS US NOTHING TO SUPPORT WHAT WE HAVE BEEN DOING HERE. THIS PROBABLY DOES NOT MAKE ANY DIFFERENCE. I DON'T EVEN KNOW. IT WAS JUST AN IDEA. BUT THE ONE 65, IT COSTS US NOTHING. BUT TONIGHT ASKED, THERE'S NOTHING WE SAID WE WOULD DO IT, WE NEED TO LOOK CLOSE AT WHAT WE ARE DOING BECAUSE, WHEN THE BEACH WALK COMMITTEE MET THEY WERE NOT DIRECTED, THEY DID NOT LOOK AT RESILIENCY. HOPEFULLY WE CAN LOOK AT THE WALKOVER'S WE ARE DOING. WE WANT TO DO ONE PARENT IS IN THEIR. TO GIVE PEOPLE AN IDEA OF WHAT THE PUBLIC PURPOSE, LIKE I SAID I CAN'T FIND IT. IT WAS ADDED IN HERE, UNDER THE DISCUSSION OF WHAT A PERMIT APPLICATION WOULD ASK FOR, AND PUBLIC PURPOSE FOR EXAMPLE IS HOW DOES THIS APPROVE THE RIGHT-OF-WAY. WE ADDED THAT TO PROVIDE CLARIFICATION. PLEASE OPEN PUBLIC HEARING. >> PUBLIC HEARING IS OPEN. I DO HAVE ONE SPEAKER. >> CAN YOU CLARIFY FOR ME, IF THIS ENCROACHMENT AND THE RIGHT-OF-WAY INVOLVES PARKING IN THE CITY? >> CITY ATTORNEY. >> WE HAVE ANOTHER ORDINANCE THAT DEALS WITH PARKING. THIS DOES NOT. >> I WAS GOING TO SPEAK TO THAT ISSUE. MY OTHER CONCERN, IN MY NEIGHBORHOOD THERE ARE PEOPLE WHO HAVE LARGE BOULDERS IN THEIR YARDS AND I WOULD LIKE TO KNOW, I GUESS THAT IS THEIR FENCE. WOULD LIKE TO KNOW HOW WE WILL CLARIFY WHAT BEAUTIFICATION IS AND WHO MAKES THAT DECISION. >> CAN YOU PROVIDE AN ANSWER. >> I CAN. THAT IS ONE OF THE ITEMS WE DID SO WE COULD GET ON THE SAME PAGE. THIS IS ANYTHING THAT DOES NOT BELONG TO THE CITY OR AUTHORIZE. WILL BOULDERS FOR EXAMPLE, WHAT WE'RE GOING TO LOOK AT IS NUMBER ONE, PERMIT APPLICATIONS FOR [01:15:04] ANYONE WHO DOES NOT ALREADY HAVE A COMMENT. IN THAT PROCESS PRODUCT THE CRITERIA THAT CITY STAFF WILL LOOK AT IS COULD IT CAUSE A SAFETY ISSUE FOR ANYONE. AND BOULDER SITTING RIGHT NEXT TO THE ROAD COULD CAUSE THIS. YOU COULD TAKE YOUR CAR OUT. THOSE TYPES OF THINGS, THERE ARE OTHER THINGS BUT A RETAINING WALL FOR EXAMPLE. IF YOU HAVE A RETAINING WALL AND IF IT IS SERVING A PURPOSE WE DON'T WANT THAT IN OUR STREETS. IF YOU HAVE LANDSCAPING AND IT'S BEAUTIFYING THE RIGHT-OF-WAY THAT'S FINE. IF YOU HAVE PAPERS THAT YOU PUT OUT, AND TO LOOK OUT INTO A CONSERVATION AREA, WE DON'T THINK THERE IS A PUBLIC PURPOSE FOR YOU. THAT ONLY SERVES THE PURPOSE OF THE PROPERTY OWNER. BOTH ARE THE TYPE OF THINGS, IF THAT ANSWERS YOUR QUESTION. >> WOULD ANYONE ELSE LIKE TO SPEAK ON THIS MATTER? >> MOVED TO APPROVE. >> LET ME CLOSE THE PUBLIC HEARING. >> WE HAVE A SECOND PERIOD VICE MAYOR. >> WE WILL CHECK RECORDS -- IF WE CANNOT FIND EVIDENCE OF A PERMIT, WE WILL NOT SAY EVERYONE'S GOING TO GET AN APPLICATION. WE HAVE NOT SAID A FEE FOR THAT. >> OKAY. >> AND IF IT IS IT WOULD BE A NOMINAL FEE. >> ANY OTHER COMMENTS? >> I AM NOT GOING TO SUPPORT THIS. I WON'T BECAUSE IT IS VAGUE AND WILL NOT BE ENFORCED. IF WE CANNOT DEFINE THAT FAR OFF OF THE ROAD WHERE BOULDERS SHOULD BE, LEAVING THAT UP TO SOMEONE'S INTERPRETATION, I AM NOT GOING DOWN THAT ROAD. SO I WILL NOT SUPPORT IT. >> THERE IS NO DEFINITION FOR HER FALL OFF THE BOULDERS. >> ONE OF THE CRITERIA IS THAT WE HAVE LOOKED AT, NOTHING GREATER THAT WOULD BE HIGHER THAN 8 INCHES. 2 FEET, 6 FEET OR 12 INCHES. WE DO APPLE CRITERIA. WE WILL LOOK AT CHECK. OF THINGS. >> THANK YOU FOR THAT DEFINITION >> I WILL REITERATE WHY I AM SUPPORTING THIS WE HAVE A GREAT REASON TO CHANGE THIS. THAT IS THE ACCESS TO THE GREENWAY. THAT WAS INFRINGED BY PEOPLE BUILDING PATIOS AND USING RIGHT-OF-WAY'S AS A PUBLIC TRAIL AND INFORMATION UPON PEOPLE ENCROACHING ON THAT RIGHT-OF-WAY. I THINK IT IS A WAY TO PROTECT OUR WORKING WATERFRONT AND I WANT YOU TO CONTINUE TO HAVE THE MARINE ADVISORY BOARD. >> CERTAINLY BY APPLYING, WE WILL APPOINT JOE TO THE BOARD. >> COMMISSIONER BEING. [11. CITY MANAGER REPORTS] >> THAT PASS MY FROM ONE. CITY MANAGER. THE FIRST THING I NEED YOUR DIRECTION ON, WITH REGARDS TO THE RESTAURANT. I DID, MS. BOCK MET WITH THE CURRENT LEASEHOLDER AND I PREVIOUSLY REACHED OUT TO INTERESTED PARTIES AND DISCUSS IT WITH THEM A PRIVATE PARTNERSHIP. I DO HAVE THREE SPECIFIC LETTERS OF INTEREST. WORKING WITH THE CITY TO REDEVELOP THAT SITE. I TOO HAVE THREE AND WOULD WELCOME PUBLICLY ANYONE ELSE IF THEY WANT TO DO THAT. BUT I WANT TO REACH OUT AND ADVISE THEM PATIENT PUT TOGETHER A 20 PAGE, PACKET THAT I WOULD PRESENT TO YOU AT THE FIRST MEETING IN MARCH AND HAVE YOU RATE AND AT THE CITY ATTORNEY NEGOTIATE A NEW LEASE WITH THE INTERESTED PARTY AND COMING UP WITH THE LEASE. IF YOU FAILED TO DO THAT YOU MOVE ON TO THE 2ND AND ANYONE ELSE THAT IS INTERESTED. JUST LOOKING FOR GUIDANCE ON HOW TO MOVE FORWARD WITH THAT. THIS INVOLVES THE DEMOLITION AND REDEVELOPMENT. >> IF THAT IS WHAT WE ARE GOING TO DO WOULD PREFER TO -- IT IS OPEN, BUT I HAVE THREE PEOPLE THAT HAVE BEEN WILLING TO COMMIT FOR THE REDEVELOPMENT AND TO GO THROUGH A FORMAL RFP WOULD EXTEND THAT. THAT IS WHY I SAY IT IS OPEN TO ANYONE AND EVERYONE. AND THESE CONVERSATIONS HAVE BEEN GOING ON FOR SEVERAL MONTHS. >> OTHERWISE TO ME, IT SPEAKS UP DISCUSSIONS THAT ARE NOT PUBLIC. THIS IS THE ACCEPTABLE WAY TO GO OUT IN MY MIND. >> I AM AGAINST THIS FOR TWO REASONS. [01:30:06] NUMBER TWO, THIS IS PHENOMENAL. AS A BUSINESS OWNER I THINK IT IS BAD BUSINESS. AS A MATTER OF FACT, I GOT A PHONE CALL FROM A PROMINENT INDIVIDUAL THAT HAD NO IDEA THAT THESE PROPERTIES WERE AVAILABLE. AS A CITY WE HAVE TO PUT THIS OUT THERE. EVERYONE CAN TAKE ADVANTAGE OF THIS. IF THEY WANT TO BID ON THIS, I WON'T SAY WHAT I THINK ABOUT IT. AND THE BUILDING AS NOT MOVE. IF YOU PUT A MARKER, I SPENT THAT TIME, AN HOUR AND A HALF, AND YES THERE IS DETERIORATION GOING ON. HOWEVER, NO ONE CAN ANSWER THE QUESTION OF WHEN THE LOWER STRUCTURE FALLS, WHAT IT WILL DO. THOSE ARE MASSIVE BEAMS UNDER THEIR THAT WE HAVE HAD REPORTS ABOUT AND IT HAS NOT MOVED 1 INCH. IF YOU PUT THIS ON THEIR IN MAY NOT MOVE. IN MY OPINION, THIS WILL BE A SLOW MOVEMENT DOWN AND YOU WILL SAY I DON'T THINK WE CAN INHABIT THAT BUILDING, BUT WHEN WE DO LEASE IT OUT WE FINISHED OUR OBLIGATION TO THOSE WHO BUILT THE BUILDING AND SUPPLIED SOMETHING FOR OUR CITY TO FULFILL. THAT IS HOW I FEEL ABOUT IT. AND IN A YEAR FROM NOW PEOPLE WHO WANT TO JUMP IN AND INTERESTED JUMP ON IT. THAT IS JUST MY OPINION. I MIGHT GET OUTVOTED. IT DEPENDS. BUT I THINK THAT IS THE PROCEDURE THE CITY NEEDS TO TAKE. NOW AT THAT TIME, LET'S SAY SIX MONTHS FROM NOW THE BUILDING DOES MOVE WHETHER IT IS HURRICANE OR A YEAR FROM NOW, EVERYONE HAS TO BE FORCED TO EVACUATE AT THAT POINT AND IT IS OBVIOUSLY A PROBLEM, THAT IS ALL I'M SAYING. >> I WILL REMIND YOU THE CITY ENGINEER AS DECLARED IT UNSAFE. IF YOU WANT TO OVERWRITE THE CITY ENGINEER, THEY CAN VOTE TO TO THAT. I WILL NOT DO THAT. I TOO HAVE BEEN UNDER THE BUILDING. WE HAVE THREE PEOPLE WHO HAVE CASH AND ARE WILLING TO PARTICIPATE IN THE PROJECT. I DON'T QUITE -- LET ME ASKED THE QUESTION TO THE CITY ATTORNEY. WHAT IS THE DIFFERENCE BETWEEN THE RFP, WHAT DO WE NEED TO DO. CAN WE DO ONE PARAGRAPH. >> YOU DON'T HAVE, THERE ISN'T A TEMPLATE THAT WE HAVE TO USE. >> WE JUST HAVE TO PUT IT OUT WE WANT. A ONE PARAGRAPH STATEMENT THAT WE ARE OPEN FOR WHAT THEY WILL GIVE US. IS THAT SOMETHING POSSIBLE TO DO? >> THAT IS NOT WISE IF YOU DO AN RFP, YOU ARE SUPPOSED TO GIVE THEM THE OPPORTUNITY TO SEE WHAT THE CRITERIA WOULD BE. AND YOU ARE SUPPOSED TO HAVE EVERYONE ON THE SAME PLAYING FIELD KNOWING EXACTLY HOW IT WILL BE EVACUATED -- EVALUATED. SO IF YOU DO AN RFQ YOU ARE JUST [01:35:02] STARTING OUT IF SOMEBODY HAS CAPITAL EXPERIENCE. >> EXPLAINED THE DIFFERENCE. I THINK I UNDERSTAND IT BUT EXPLAIN IN A LITTLE MORE. >> FOR THOSE UNFAMILIAR, YOU WILL SAY WE WILL BILL 27 YOU TELL US WHAT YOU ARE GOOD AT. WHAT ARE THE QUALIFICATIONS TO REDEVELOP A WATERFRONT PROPERTY. >> THEN YOU ENTERED NEGOTIATIONS ON WHO YOU DECIDE IS THE MOST QUALIFIED. >> >> WHAT YOU ARE PROPOSING IS RFQ >> IT WOULD GIVE US SOMETHING BACK BY THE END OF JANUARY THAT WE COULD DISCUSS SOME OF THOSE. THIS IS FOR FEBRUARY 8. SO IT MAY BE NICE TO HAVE SOMETHING BACK TO SEE WHAT YOU WANT TO DO. IF YOU REJECT THE QUALIFICATIONS, NOTHING HAPPENS. >> LISTEN MY FELLOW COMMISSIONERS. >> YOU ACTUALLY CAN PUT AN RFP WITH CERTAIN GUIDANCE IT IS NOT DIFFICULT. IN A WHEREWITHAL TO COMPLETE IT YOU ARE LIKELY TO GET AN RFQ. I JUST THINK IT NEEDS TO GO PUBLIC. >> I AM PERFECTLY FINE WITH IT. BUT I WILL REITERATE I THINK WE NEED TO REITERATE, I DISAGREE THAT IS MY OPINION BUT IF WE DO THAT, AND THAT IS THE WILL OF THE COMMISSION, WHEN IT GOES OUT IT SHOULD BE AFTER TIES THAT WHOEVER IS INTERESTED -- AND IT COULD BE THE SAME THREE PARTIES THAT WE HAVE RIGHT NOW. >> WHEN WE ADVERTISE, WHAT IS AVAILABLE, EVERYONE THAT AS AN INTERNET CONNECTION. >> BOTH THE VICE MAYOR AND BROUGHT UP SOME INTERESTING POINTS. AND NUMBER ONE, WE DON'T KNOW WHO WILL BE SITTING THERE. WE KNOW THERE IS AT LEAST ONE COMMISSIONER WHO WILL BE JOINING US. I WOULD HATE TO CHECK AROUND THESE OFFERS. THERE COULD BE A POTENTIAL FOR US TODAY, TO GO FOR IT AND TO ASK ABOUT THE COMMISSION WOULD REVERSE ITS OWN COURSE, AND I WOULD SAY IN TWO WEEKS WE WILL KNOW MUCH MORE. SECOND I THINK AN RFQ IS THE RIGHT MOVE -- MOVE. I AM REALIZING SOMETHING THAT COULD BE A BIG ISSUE. >> FROM WHAT I UNDERSTAND WITH THIS DEAL, WITH THE WILL WE SEE I DON'T KNOW IF THIS IS THE RIGHT DEAL FOR THE FUTURE. WE ARE LOOKING 30 YEARS IN THE PAST. I THINK I HAVE TO AGREE WITH COMMISSIONER STURGIS ON THIS ONE. >> COMMISSIONER ROSS. ( INDISCERNIBLE ). >> THIS IS A RENT REDUCTION, I [01:40:05] WOULD NEVER TELL SOMEONE TO GO TO MY PLACE AND SAY I TELL YOU WHAT, I WILL LET YOU MOVING AS LONG AS YOU GIVE ME $5,000 UPFRONT. AND YOUR RENT WILL BE $10 PER MONTH FOR THE NEXT 20 YEARS. IT MAKES NO SENSE TO ME. WE WAIT THIS OUT AND PEOPLE, IT TAKES A LONG TIME COMMERCIALLY IF WE JUST WAIT, THEY CAN BE ON THE BOARD AND HAVE THEIR PLANNING AND AS SOON AS THE LEASE EXPIRES MOVE IN AND WE HAVE 0 RENT REDUCTION. SEEK IN MY OPINION AND WE DON'T HAVE TO PAY OUT $1 MILLION. THIS SAVES US FROM OUR DATE. >> YOU JUST POINTED OUT, A YEAR END A HALF TO GET SOMETHING GOING. TO GET THESE THINGS LINED UP. AND WE HAVE A HARD DATE FOR WHEN BRATS WILL HAVE TO VACATE THE BUILDING. AT THEY ARE SUPPOSED TO DO THAT. AND IT WILL BE IN THE CONDITION THEY FIRST GOT A PAIR. >> SO WHY NOT, GET THE BALL ROLLING WITH A RFQ, COME BACK AT THE NEXT MEETING WITH WHAT THE RFQ WOULD SAY. COME BACK -- WE HAVE THIS THAT COULD BE SOONER OR LATER. WHAT ARE YOU WILLING FOR WHATEVER REASONS I GET THAT. WE GET RID OF BREATH AND WE HAVE MORE. WHAT I AM LOOKING FOR, WE HAD PEOPLE LEFT CAPITAL AND ARE WILLING TO COMMIT TO MOVING FORWARD WITH THIS. WHO WE WANT AS A DEVELOPER GOING FORWARD WITH WHATEVER WE DECIDE TO DEVELOP. DOES THAT SEEM REASONABLE? COME BACK IN TWO WEEKS. >> IS ALSO THE CITY'S RESPONSIBILITY TO MAINTAIN THIS. I AM NOT TALKING ABOUT UNDERNEATH, TALKING ABOUT THE TOP PART. >> THAT IS THE PART THAT IS CONCERNING TO EVERYONE. >> SO, WE CAN DO IN RFQ BUT IT MAKES 0 CENTS UNLESS THEY ARE GOING TO PAY FOR THE DEMOLITION. >> WITH NO RENT REDEMPTION PERIOD. >> WE CAN SEE. >> WE GOT PEOPLE WITH MONEY WHO WANT TO DEVELOP SOMETHING. WHAT ARE YOU WILLING TO OFFER US. WHAT IS YOUR DEAL. WHAT ARE YOUR QUALIFICATIONS. >> I WOULD BE WILLING TO ENTERTAIN IT. >> I AGREE. IT NEEDS TO BE ADVERTISED FOR A TIME. I WOULD ALSO SAY THE QUALIFICATIONS NEED TO BE THERE. >> OKAY. [01:45:09] YOU ARE WILLING TO DO AN RFQ. COME BACK IN TWO WEEKS WHEN WE WERE AVENUE COMMISSION. ON THE 12TH. AND AT THAT TIME WE CAN PUT OUT THE RFQ, SO AND I WANT TO REITERATE. I DON'T WANT TO PUT WORDS IN THEIR MOUTH. THE LONGER WE WAIT, THE NUMBER KEEPS GOING DOWN. >> I WOULD BE WILLING TO ENTERTAIN AN RFQ AFTERWARDS AT THE NEXT MEETING. >> I HAVE THREE VOTES. >> MY POINT AND SPEND ACKNOWLEDGE THAT WE GO PUBLIC. >> A YEAR END A HALF WORRIES ME. WHAT DO YOU THINK THE PEOPLE WHO INSPECTED THE CONDO IN MIAMI BEACH SAID, THIS IS GOING TO FAIL. WE ARE ALSO ENGINEERS. THE BUILDING IS UNSAFE. THEY SAID IT OVER AND OVER AGAIN. A YEAR END A HALF DO YOU WANT PEOPLE IN THEIR FOR ANOTHER YEAR END A HAPPIER THE CITY HAS RULES. AND ONE OF THE RULES ARE RFPS AND RFQ AS WE ARE WHO CONTACTS THE CITY MANAGER FIRST. BECAUSE IF WE DO IT THAT WAY THE BLOWBACK IS, IT IS A SWEETHEART DEAL. YOU HAVE TO OPEN IT UP TO EVERYONE. AND THAT IS THE PROCESS. WE HAVE TO FOLLOW PROCESS. SO COMMISSIONER ROSS, YOUR LIGHT IS ON. >> NUMBER ONE, YOU ARE RIGHT. BUT THE JUDGE DID NOT AGREE WITH US SO WE HAVE A PROBLEM WHERE WE HAVE THE TOOLING ENGINEERS, AND TO RESOLVE THAT WE HAVE TO GO BACK TO COURT AND ON AND ON IT GOES. THEY HAVE PUT UP A BOND THAT WE HAVE DONE OUR DUTY. AND DO I THINK WE SHOULD BE EATING IN THEIR. THE CITY MANAGER SAID IT IS NOT SAY. I AGREE WITH YOU BUT THE REALITY IS WE WILL NOT MOVE THIS AND THIS IS PROBABLY THE FASTEST WAY FORWARD. NUMBER TWO, WE ARE FOLLOWING BELL PROCESS WITH AN RFQ. IF WE VOTE ON IT AND APPROVE IT. >> SO WE COME BACK INTO WEEKS WITH A NEW COMMISSION AND OFF WE GO TO THE RACES. >> WHAT IS THE CITY COMMISSION'S DIRECTION. WE DON'T HAVE TO MOVE FORWARD WITH ANY FURTHER ACTION SO WHAT IS THE DIRECTION OF THE CITY COMMISSION. >> AND TO REFRESH EVERYONE'S MEMORY, HOW THE CODE BOARD, THE PROCESS THEY USE FOR THE RULING, HIS RULING WAS NOT ON HOW SAFE THE BUILDING WAS. WE HAVE NOT PURSUED IT. JUST TO REFRESH EVERYONE'S MEMORY. COMMISSIONER STURGIS AND ROSS, I [01:50:06] WANT TO MAKE TWO POINTS. NUMBER ONE I DISAGREE. I WILL BE EATING THERE TOMORROW NIGHT. I THINK THAT'S JUST MY OPINION. REGARDLESS, I THINK WE HAD A COUPLE OF PEOPLE, I HAVE A COUPLE OF PEOPLE WHO WOULD ENTERTAIN THAT BUT UNFORTUNATELY , WHEN YOU WANT TO DO. >> HE WILL PUT IT ON THE AGENDA. >> DO WE THE CITY ENGINEER AS PUT HIMSELF OUT THERE PROFESSIONALLY AND WILL WE IGNORE WITH THE CITY ENGINEER SAID AND I THINK YOU NEED TO VOTE ON THAT FOR PROTECTING MR. GEORGE, HE NEEDS DIRECTION FROM THE CITY COMMISSION. >> I WANT HIM TO WRITE A LETTER. >> IS THE BUILDING SAFE ARE NOT SAFE. >> WE CALL ESSAY. >> BASED ON MY 35 YEARS LOOKING AT THE STRUCTURES. YOU CAN'T JUST LOOK AT IT AND DECIDE IF IT IS SPACE BAR NOT -- SAFE OR NOT. YOU HAVE TO DO AN ANALYSIS. THIS PROVIDES STABILITY. WE HAVE MULTIPLE REPORTS SAME IT IS NOT SAFE. AND SOME SAYING IT IS. I'M STILL STANDING BY IS NOT SAY. >> WE SHOULD BE PROCEEDING WITH THE ACTION IT IS UNSAFE BASED ON WHAT WE HAVE SAID SO FAR. >> I MOVED TO REINSTATE THE CODE. WE NEED TO FOLLOW-UP. AND A LOT OF ENGINEERS HAVE SAID, WE STARTED THE ACTION WE NEED TO FOLLOW-UP. AS YOU SAID THE JUDGE DID NOT TALK ABOUT THE ENGINEERING ISSUES WILL BE SHOULD MOVE FORWARD. >> I MOVED TO REINSTATE. >> COMMISSIONER STURGIS. I WILL PURSUE THIS AND IF THE CITY COMMISSION CHANGES INTO WEEKS, IT MAY CHANGE OR CARREON, WHO KNOWS. WE COULD BE JUMPING AND PUTTING THE CART BEFORE THE HORSE. THAT IS ALL I'M SAYING. >> MY QUESTION IS FOR TAMMY IF THAT IS OKAY. I WANT TO ASK HER SPECIFICALLY ABOUT AND I'VE HEARD SOME THINGS ABOUT THE COURT CASE AND OUT THAT CAME TO BE. I GUESS NUMBER ONE, WHAT ARE WE VOTING ON. WHAT DOES THAT MEAN. WHAT WILL THAT DO. >> HE WILL START THE PROCESS OF, JUST LIKE IT DID IN JULY 2021. THE CITY ENGINEER RECEIVED A REPORT FROM AN OUTSIDE ENGINEER, INSPECTED THE SET HIMSELF AND DEEMED IT TO BE UNSAFE. PREPARED A NOTICE UNDER THE ABATEMENT CODE THAT IT IS UNSAFE. GIVING THE LESSEE, THE GROUP 60 DAYS-30 DAYS TO APPEAL THE DECISION WHO HEARS THE APPEAL OR MAKE THE REPAIRS. FOR VACATE THE BUILDING. IN THIS CASE, THEY APPEALED WITHIN 30 DAYS, THE JUDGE [01:55:07] BASICALLY THROUGHOUT THE DECISION. SAYING, ABOUT FINDINGS OF FACT WERE NOT ARTICULATED AT THE MEETING. TECHNICALITY. THIS NOW AND WHAT THE MANAGER IS ASKING, HE BELIEVES IT IS UNSAFE, AND DO WE GO AHEAD AND RE- ISSUE THE NOTICE EFFECTIVE NOW AND START THE 60 DAY WINDOW WHERE WE COULD APPEAL TO THE BOARD OF ADJUSTMENTS AGAIN. >> SO THE JUDGE RULING NULLIFIED THE LAST TIME WE DID IT. IT IS AS IF NOTHING HAPPENED. AND SO US DOING THIS WOULD RESTART THE PROCESS. WOULD FOLLOW THAT PROCESS BUT THIS TIME WE NOW. WE KNOW WHAT THE JUDGE COMMENTED ON AND THAT CAN BE APPEALED. >> SO THERE IS NOTHING THAT SAYS, AND SOMETIMES RULINGS LIKE THAT INDICATE WE CANNOT GO AGAIN. >> THAT MEANS YOU CAN TO IT AND PEOPLE CAN CONTINUE TO APPEAL THE BOARD'S DECISION. NUMBER ONE, I THINK -- NOTHING WILL HAPPEN BEFORE DECEMBER 20. I'M HOPING YOU ALL WILL DEFERRED THIS DECISION UNTIL THAT MEETING. WE KEEP HEARING ABOUT NEW COMMISSIONERS WHENEVER. LET'S JUST NOT DO ANYTHING UNTIL THE 20TH. I WANT YOU TO THINK BEFORE THAT TIME, WHAT I SUSPECT AND I HATE TO DO THIS, BECAUSE IT IS JUST BEING VULNERABLE HERE BUT WE HAVE A GOOD RELATIONSHIP WITH CENTER STREET RESTAURANT IN TERMS OF US TALKING TO THE OWNER AND THE ATTORNEYS, THE THING I FEAR ABOUT THE CLOCK AND GOING BACK THERE IS BASED ON WHAT COMMISSIONER STURGIS HAS SAID. THE CITY HAS TWO THIRDS OF THE RESPONSIBILITY FOR THE UNSAFE PORTION. SO IF WE TAKE IT BACK TO THE BOARD OF ADJUSTMENT, WE ARE BETWEEN A ROCK AND A HARD PLACE. THE CITY HAS EXTREME LIABILITY, OR IF IT IS A CATASTROPHIC COLLAPSE. WE HAVE A LOT OF LIABILITY. AND I RESPECT WHAT THE CITY ENGINEER IS SAYING. I KNOW WHAT COMMISSIONER STURGIS DOES TOO. IF WE READJUST AGAIN I THINK WE RISK A BREACH AND THEY BELIEVE, IT WILL COST $20,000 TO FIX THEIR PORTION OF THE SUBSTRUCTURE AND I AM NOT SAYING THIS IS TRUE. OUR ENGINEERS SAY IT IS ABOUT $780,000. IT IS A TERRIBLE SITUATION. DO WE SPEND $1 MILLION OR $1,000,005 NOW OR $780,000 AND OF THESE IS UP ANYWAY IN DECEMBER. I AM AFRAID, IF WE GO BACK TO THE BOARD OF ADJUSTMENTS WE WILL BREACH THE LEASE AND IT IS CLEAR WHO HAS WHAT RESPONSIBILITY. WE HAVE ALWAYS AGREED WITH THEM. THIS IS CAUSING REALLY THEM TO HAVE TENS OF THOUSANDS OF DOLLARS IN ATTORNEY FEES. PROBABLY NOT THE WISEST MOOD -- MOVE. AND WE PROBABLY JUST NEED TO THINK ABOUT THAT. >> THE FURTHER QUESTION, HOW MUCH DID WE SPEND. AND DID THEY PAID 0 AS WELL? >> I DON'T KNOW WHAT THERE'S OUR. >> AND WE PAID BECAUSE I WAS HERE REPRESENTING CITY STAFF. IT WAS ABOUT $2,000 TO COVER THE BOARD OF ADJUSTMENT. IF THE CITY GOT SUED FOR BREACH [02:00:17] OF CONTRACT. >> I THINK TAMMY BROUGHT UP A GREAT POINT, THIS COULD BE VERY WELL DISCUSSED. >> I KNOW IT IS PUTTING YOU OFF BUT I AM NOT SURE WHAT ELSE TO DO. >> WORKED ALL OF THESE IN PLAY WHEN WE STARTED IN 2021? >> WE HAVE THE SAME RISK AND LIABILITIES AND POSSIBILITY OF BEING SUED. >> AND WE DECIDED TO PRESS FORWARD. >> THE DID NOT UNDERSTAND NOR DID WE. I THINK THEY WILL PUT IT IN THEIR FAVOR. THEY HAVE ENGINEER WHO IS QUALIFIED. I THINK GOING AROUND THIS TIME, THEY HAVEN'T SENT THIS TO ME I AM JUST SAYING IT IS A RISK. >> VICE MAYOR, YOUR LIGHT IS ON. >> IT SEEMS LIKE WE ARE MISSING THE POINT HERE. IS THE BUILDING UNSAFE. WE ARE NOT TALKING ABOUT EXPOSURE. WE ARE NOT TALKING ABOUT, WE ARE TALKING ABOUT IS THE BUILDING UNSAFE. THE ENGINEER SAID IT WAS UNSAFE. SO WHATEVER WE CAN DO. YOU KNOW, LOOKING, WE JUST PUT THIS IN LIMBO, IT COULD GO TO THE 20TH, MAY BE. BUT THE EXPOSURE, IT'S NOT THE EXPOSURE IT IS THE SAFETY. >> THANK YOU, VICE MAYOR. >> >> OUR MOVE WE DIFFERENT THIS UNTIL THE NEXT MEETING. >> SO YOU WANT TO WITHDRAW YOUR MOTION? >> >> ANY DISCUSSION? >> HAVE TO SAY IT'S OKAY. >> OKAY. MOVING ON. >> DO WE HAVE TO VOTE ON THAT? >> OKAY, MADAME CLERK PLEASE CALL THE VOTE TO POSTPONE UNTIL THE NEXT MEETING. >> DECEMBER 20. (ROLL CALL). [12. YOU CAN TAKE CARE OF THAT YOURSELF. >> THANK YOU, SIR. >> CITY ATTORNEY HAVE NOTHING. >> CITY CLERK. >> HOW LONG ARE YOU GOING TO TAKE? IN YOUR CLOSING STATEMENT CRACKS. >> LESS THAN 10 MINUTES. >> I WOULD LIKE TO TAKE A BREAK. >> AT THE REQUEST O >> OKAY, WE ARE BACK IN SESSION. I, MUCH TO THE CHAGRIN OF MY WIFE, OFTEN ASKED, DO YOU LIVE HERE, OR WHAT DO YOU THINK ABOUT THE CITY. I HAVE PROBABLY DONE THIS, 200 TIMES IN THE LAST SEVERAL YEARS. AND 95% OF THE TIME PEOPLE SAY THIS IS A GREAT PLACE TO LIVE CITY SERVICES ARE FINE -- AND I THINK IT IS A REAL TESTAMENT TO THE CITY MANAGER AND OUR CITY STAFF. THANK YOU. >> I JUST HAVE TO THINGS THIS EVENING. I WORKED COMMUNITY AT A GREAT LOSS THIS LAST WEEK. SHE WAS A GREAT WOMAN AND A FORCE AND A PILLAR IN THE COMMUNITY. I KNEW THE OWEN'S FAMILY FOR MANY YEARS AND IT IS SAD WHEN WE HAVE SHARED THIS LAST WEEK AS A COMMUNITY. AND SO, I WILL KEEP THE OWEN'S FAMILY IN MY PRAYERS. ANOTHER THING WAS, ON AN UPBEAT NOTE, MY DAUGHTER WAS ON THE FRONT PAGE OF THE PAPER, AND THAT WAS MY DAUGHTER THIS LAST FRIDAY. IT WAS AMAZING. SHE IS AN AMAZING DAUGHTER, AND I CANNOT WAIT TO SEE WHAT SHE DOES AS SHE TRIED OUT IN THE MISS TEEN USA. SHE WILL BE REPRESENTING FERNANDINA AS OUR REPRESENTATIVE IN THE STATE COMPETITION IN MAY 2023 COMING UP. I JUST WANT TO GIVE A SHOUT OUT TO HER EVEN THOUGH SHE IS MY DAUGHTER AS A COMMISSIONER I WOULD SEE IT THE SAME AS HER BEING ON THE FRONT PAGE WE ARE VERY PROUD OF HER THIS WAS A GREAT MEETING, THANK YOU. >> , COMMISSIONER BEAN. >> I HAVE TWO THINGS. THIS WEEKEND I'M GETTING MARRIED, IM EXCITED TO DO THAT. THIS IS MY LAST MEETING SO I WILL BE MARRIED THE NEXT TIME YOU SEE ME. >> HOW DO YOU FEEL ABOUT THAT? >> I FEEL GREAT. >> WE WILL SEE REAL SOON. AND NUMBER TWO, I WANT TO SAY, VICE MAYOR YOU HAVE SERVED THE CITY WITH DISTINCTION. IT IS AN HONOR TO BE YOUR NEIGHBOR. THANK YOU. THAT IS ALL. >> THANK YOU SIR. >> VICE MAYOR. >> WHEN I CAME TONIGHT I HAD A LIST OF SO MANY THINGS I WANTED TO DISCUSS. MOST I HAVE DISCUSSED AND I WILL GO OVER AGAIN. THE NUMBER ONE THING, IT WAS WHERE WE HAVE COME AS A CITY IN FAR -- AS FAR AS HATE AND [02:10:08] DIVISIVENESS, THAT NEED NOT BE. I SHOULDN'T SAY WE SHOULD NOT TOLERATE IT BUT IT IS NOT US DOING IT. IT IS SAD AND HOPEFULLY WE CAN TURN THAT AROUND. THE POSITIVES OF THE LEGISLATIVE REQUESTS, THE PREEMPTIVE BLOG, AND THAT DISCUSSION WE ARE DOING IS INFORMATION AND MOVING FORWARD. THE STREETLIGHTS IT APPEARS WE WILL MOVE FORWARD AND GET THAT UNDER CONTROL. TO ME, WE ARE NOT APPLYING OUR LAWS AND HOPEFULLY THE BOARD WILL ADDRESS IT APPROPRIATELY AND REFER IT TO THE BOARD OF ADJUSTMENTS. THE OTHER THING I WANTED TO TALK ABOUT REORGANIZATION OF THE CITY. WE ARE CONSTANTLY DOING THAT. TONIGHT WE WILL REFER TO THE CITY ENGINEER AND I'M NOT SURE WHAT HIS JOB IS EASY CITY ENGINEER OR COMMUNITY SERVICE OR DEPUTY. AGAIN, IF YOU LOOK AT OUR STRUCTURE, THIS BUDGET HAS CHANGED AGAIN. THAT IS FINE. BUT I AM NOT SO SURE, AND IF YOU REMEMBER SIX MONTHS AGO I POINTED OUT THE ISSUES. ALL OF THESE PEOPLE. PEOPLE DIDN'T REALLY KNOW WHAT THEIR JOBS WHERE. WE FOUND OUT WE DON'T HAVE JOB DESCRIPTIONS. I WOULD EMPHASIZE TO THIS COMMISSION AND THE NEW COMMISSION, IT IS CRITICAL THAT WE DEFINE WHAT THE STRUCTURE WILL BE AND WHAT THEY ARE SUPPOSED TO DO TO BE EFFECTIVE. I DON'T DISAGREE WITH CHIP. PEOPLE LIKE TO LIVE HERE BUT THAT DOES NOT MEAN WE HAVE TO BE INEFFICIENT. THAT IS THE WAY THEY OPERATE IN THE REAL WORLD. AND I UNDERSTAND GOVERNMENT IS DIFFERENT BUT I WOULD EMPHASIZE THE CITY -- THE COMMISSION NEEDS TO LOOK AT WHERE WE MOVE GOLF COURSES AND WHOSE JOBS AND WHAT THEY ARE DOING, WE HAVE BROUGHT PEOPLE OVER WHAT ARE THEIR JOBS. AND WHAT ARE THE JOB DESCRIPTIONS. I THINK THOSE ARE MORE EFFECTIVE COXWELL. THE ONLY OTHER THING I WANTED TO BRING UP FERTILIZER. I NOTE TAMMI WAS LOOKING INTO THAT. FOR ME IT IS BEEN FUN. I WILL BE AROUND A LITTLE BIT, YOU WON'T SEE ME FOR LITTLE WHILE. AM I GOING TO GET A BLACK? >> AND YOU'RE GOING TO GET A LUMP OF COAL. >> AND THE FOOD GIVEAWAY IS SATURDAY. 0800 HOURS. AND THE CHRISTMAS PARADE WAS GREAT. >> THANK YOU, SIR. ALL RIGHT, CONDOLENCES TO THE FAMILY AND LOVED ONES OF STEVE L. THOSE OF US WHO KNEW STEVE, A WONDERFUL PERSON. GAVE A LOT OF HIS TIME TO CHARITABLE ORGANIZATIONS AND IT WAS A WONDERFUL PHOTOGRAPHER. I'M GOING TO READ WHAT THE AMELIA MUSICAL PLAYHOUSE WROTE ABOUT STEVE REGARDING HIS PASSING. WE LOST OUR GREAT ARTISTS AND A TRUE FRIEND. STEVE'S PHOTOGRAPHY BROUGHT CHARACTERS TO LIFE EVERY DAY. HE BELIEVED EVERYONE HAD A DEEP AND UNSEEN BEAUTY. HE LOVED TO ELEVATE THEIR CHARACTERS IN HIS PHOTOGRAPHS. WE WILL MISS HIS JOY. ALL RIGHT, BUT DICKENS LANTERN SESSION IS THURSDAY NIGHT. EVERYONE GATHERS ON THE WATERFRONT WITH LANTERNS AND YOU MARCH DOWN FRONT TO ASH EAST, TO ABOUT SEVEN AND BACK DOWN. IT IS A WONDERFUL EVENT IF YOU [02:15:01] HAVE NOT DONE IT. IT BEGINS FRIDAY. SO, PLEASE ATTEND. WE HAD THE EMPLOYEE SERVICE AWARDS BREAKFAST WHICH WAS THE 30TH, LAST WEDNESDAY. AND, CONGRATULATIONS TO THE HR DIRECTOR DENISE FOR BEING THE SUPERVISOR OF THE YEAR. THE MAINTENANCE TECHNICIAN FOR BEING SELECTED AS DIRECTOR OF THE YEAR. I ESPECIALLY ENJOYED READING GEORGE'S JOURNEY OF LEARNING AND PROGRESS. THAT WAS VERY INSPIRING. PARKS AND RECREATION MEET AND GREET ON THURSDAY. IS THAT CORRECT THAT IS AT 6:00 P.M. AND THEN THESE ARE POSTED ON THE CITY WEBSITE, THE SCHEDULE. SO PLEASE ATTEND THAT. CITY MANAGER PLEASE TURN ON THE MERRY CHRISTMAS LIGHTS AT THE ENTRANCE IF YOU WOULD PLEASE. THERE WOULD BE TERRIFIC. FRONT OFFICE ON TUESDAY. PLEASE GET OUT AND VOTE. VERY IMPORTANT. AND FINALLY, AS YOU MAY HAVE NOTICED I'VE BEEN HACKING AND COUGHING MY WAY THROUGH THIS MEETING. BUT IT IS MY LAST MEETING AS MAYOR.
