GOD BLESS FERNANDINA FLORIDA AND GOD BLESS THE DICES AMERICAN ALL GOD'S PEOPLE SAID AMEN. [4.1 PRESENTATION - NASSAU HUMANE SOCIETY] >> PRESENTATION FOR THE -- IS OUR DOG OF THE MONTH HERE? >> FIRST TIME OFF OF A LEASH. >> JUST A LITTLE SHY. >> YES. HE LIKES THE OUTSIDE NOT THE INSIDE. SO THIS IS LOUIS. HE HAS HIS BROTHERS AT THE SHELTER. HE IS FROM THE LITTER FOUND UNDER THE BRIDGE IN THE BOX. WE PUT THEM IN FOSTER GAVE THEM THE MEDICINE AND MEDICAL THEY NEED. AND THEY ARE SPAYED AND NEUTERED AND UP TO DATE ON ALL OF THEIR SHOTS. HE IS A BOXER MIX ANY IS HUGE. HE CAME IN FROM FOSTER AT 16 POUNDS AND HE IS ALREADY UP TO 20. THEY ARE EATING AND DRINKING. AND NOW HE JUST NEEDS TO FIND A HOME. SUPER CUTE. THEY ALL JUST GOT BACK FROM SPAYING AND NEUTERING. THEY HAVE JUST BEEN PLAYING AND THEY ARE ALREADY FOR ADOPTION. >> ONCE AGAIN WILL YOU TAKE THE PUBLIC THROUGH THE ADOPTION PROCESS PLEASE. >> IF YOU HAVE ANOTHER DOG IN YOUR HOME BRING THEM SO WE CAN MAKE SURE EVERYONE WILL HOPEFULLY GET ALONG. IF YOU HAVE ANOTHER CAT JUST LET US KNOW IF THEY ARE GOOD WITH OTHER ANIMALS. [4.2 PRESENTATION - FERNANDINA OBSERVER] >> THANK YOU SO MUCH. ITEM 4.2 TWO PRESENTATION BY THE FERNANDINA OBSERVER. >> SUITLAND FORM FOUR GROOM STREET FERNANDINA BEACH, FLORIDA 42304. THIS IS VERY UNUSUAL FOR ME TOO BE STANDING UP HERE. NORMALLY I AM SITTING OVER THERE AND TAKING ALL OF YOUR COMMENTS INTO CONSIDERATION. I JUST WANTED TO SAY THAT THE FERNANDINA OBSERVER WAS STARTED TEN YEARS AGO BY TWO PEOPLE, SUSAN AND DOUG. THE REASON THEY DID IT WAS TO MAKE SURE REAL INFORMATION WAS AVAILABLE TO PEOPLE IN THE [00:05:01] COMMUNITY WHO WANTED TO KNOW ABOUT HOW THEIR GOVERNMENT WORKS. WE HAD JUST COME THROUGH A CHANGE ELECTION AND AS PART OF THE CHANGE, MANY ISSUES THAT YOU ARE DEALING WITH RIGHT NOW, WERE KICKED DOWN THE ROAD BECAUSE THE NEW COMMISSION DID NOT WANT TO HAVE TO LIVE. AS SPOKE WITH PEOPLE IN THE COMMUNITY, THEY TOLD US THEY DID NOT KNOW. THEY HAD NO WAY OF KNOWING WHAT WAS ACTUALLY GOING ON WITH GOVERNMENT. SO ONE OF THE PEOPLE THEY RECRUITED TO JOIN THEIR TEAM EARLY ON WAS YOURS TRULY. I HAVE SACRIFICED MY TUESDAY NIGHTS SO THEY DON'T HAVE TO COME HERE TO DO THIS. BUT I DO WANT TO SAY THAT, IT HAS BEEN AN INTERESTING TEN YEARS FOR ME AND I WILL MISS MY TUESDAY NIGHTS OUT WITH THE BOYS. BUT, THE MAIN PURPOSE FOR ME TOO BE HERE TONIGHT IS TO ASSURE YOU AND MEMBERS OF THE COMMUNITY THAT OUR MISSION IS NOT GOING AWAY. WE WILL BECOME BIGGER, BETTER, AND COVER MUCH MORE THANKS TO OUR INCOMING EDITOR, MIKE PHILLIPS WHO HAS A TREMENDOUS BACKGROUND IN NEWSPAPER PUBLISHING. HE ALSO HAPPENS TO BE MY NEXT-DOOR NEIGHBOR SO HE CAME AT THE RIGHT TIME FOR SUSAN AND I TO CONVINCE HIM THAT SHOULD BE HIS NEXT PROJECT. WITHOUT FURTHER DO LET ME INTRODUCE MIKE PHILLIPS. >> WELCOME SIR. >> THANK YOU. I HAVE ALREADY MET A FEW OF YOU AND I HOPE TO GET TO KNOW THE REST OF YOU PRETTY QUICKLY. THIS PROCESS THAT WE ARE GOING THROUGH INVOLVES DEALING WITH THE IRS TO GET NONPROFIT STATUS. SO I AM DEALING WITH TWO BUREAUCRACIES THE SECRETARY OF STATE AND THE IRS IF THERE WERE A THIRD ONE I WOULD REALLY BE IN TROUBLE. BUT WE ARE GOING TO GET IT DONE. THIS WILL MAKE THE NEWS OPERATION LESS STURDY BECAUSE THIS IS A MAJOR TREND IN COMMUNITY JOURNALISM ACROSS THE COUNTRY GOING TO NONPROFIT STATUS. IT PUTS BETTER LEGS UNDER WHAT CAN BE A DIFFICULT OPERATION AT ANY TIME OF INCREDIBLE CHANGING MEDIA CIRCUMSTANCES. AND IF YOU THINK WE HAVE SEEN A LOT OF CHANGE IN THE LAST TEN YEARS, YOU JUST WAIT. THAT IS ALL I HAVE TO SAY. IF YOU HAVE ANY QUESTIONS I WILL BE HAPPY TO ANSWER THEM. >> I HOPE WE DO MEET AND HAVE A DISCUSSION. >> THIS IS SUE ANSWER LAST CITY COMMISSION MEETING, COVERING IT FOR THE OBSERVER. I WOULD LIKE TO STAND AND THANK HER FOR HER SERVICE. [4.3 PROCLAMATION - MR. JOHN M. COTNER] A RARE FOR PROCLAMATIONS. LET ME MAKE SURE THAT I HAVE THEM. THANK YOU VERY MUCH. >> THANK ALL OF YOU. [4.4 PROCLAMATION - "PEACE OFFICERS MEMORIAL DAY" AND "NATIONAL POLICE] >> WITH THE OPTION -- COME FORWARD. >> I WANT TO THANK ALL OF OUR OFFICERS FOR THEIR SERVICE AND JOB WELL DONE. WHEREAS THE CONGRESS AND PRESIDENT OF THE UNITED STATES DESIGNATE MAY 15, 2022 AS PEACE OFFICERS MEMORIAL DAY AND THE WEEKEND WHICH IT FALLS NATIONAL POLICE WEEK. THE MEMBERS OF OUR LAW [00:15:06] ENFORCEMENT AGENCIES PLAY SUCH ESSENTIAL ROLES SAFEGUARDING THE RIGHTS OF THE CITIZENS OF OUR COUNTRY. IT IS IMPORTANT THAT ALL CITIZENS RECOGNIZE THE UNIQUE CHALLENGES AND RESPONSIBILITIES OF THE POLICE DEPARTMENT PERSONNEL WHO TAKE A SOLEMN OATH TO SERVE THE PEOPLE BY PROTECTING LIFE AND PROPERTY, BY STANDING AND BY SHIELDING THE INNOCENT AND THE WEAK AGAINST OPPRESSION OR INTIMIDATION. FLORIDA, POLICE DEPARTMENT'S ARE PROPERLY EVOLVED INTO PROFESSIONAL ORGANIZATIONS, UTILIZING SCIENTIFIC AND COMPUTERIZED METHODS AS THE BASIS FOR EFFECTIVE STRATEGIES AND MANAGEMENT. WHILE EMBRACING DIVERSITY AND FAIRNESS IN THE UNITED STATES, 106 POLICE OFFICERS TRAGICALLY DIED FROM AN ACT OF VIOLENCE IN 2021 WHILE SERVING THEIR COMMUNITIES. IN 2020 OVER 60,000 POLICE OFFICERS WERE INJURED WHILE SERVING THEIR COMMUNITIES. FROM 1955 TO 19543 DIED BUCHER -- AND SADDENED WHEN ON SEPTEMBER 26, 2021, DEPUTY JOSHUA WAS SKILLED IN THE LINE OF DUTY WHILE CONDUCTING A TRAFFIC STOP. BUT THERE FAITHFUL AND LOYAL DEVOTION TO DUTY OUR LOCAL POLICE OFFICERS HAVE ESTABLISHED AN HONORABLE AND ENDURING LEGACY OF PUBLIC SERVICE WHICH IS CHERISHED WITHIN OUR COMMUNITY AND WOVEN INTO THE FABRIC OF OUR DISTRICT. THEREFORE LET IT BE RESOLVED BY THE CITY COMMISSION OF THE CITY OF FERNANDINA BEACH, THAT WE CALL UPON ALL FOUR POLICE AGENCIES AND MUNICIPALITIES TO OBSERVE SUNDAY MAY 15, 2022 AS PEACE OFFICERS DAY AND THE WEEK OF MAY 16 AS NATIONAL POLICE WEEK. THANK YOU. >> LET'S GIVE THEM A HAND. >> THIS IS KIND OF TOUGH. WHEN YOU LOOK AROUND, WHILE WE HAVE A PORTION OF THE AGENCY THIS MAN JUST GOT OUT OF TRAINING TODAY. HE HAS BEEN SERVING FOR 45 YEARS THE FIRST GROUP OF MEN AND WOMEN. MR. MAYOR, AND MEMBERS OF THE COMMISSION I WANT TO THANK YOU ON BEHALF OF THE MEN AND WOMEN FOR RECOGNIZING PUBLICLY POLICE MEMORIAL WEEKEND POLICE OFFICERS MEMORIAL DAY. I WANT TO THANK YOU AND THE CITY MANAGER FOR THE SUPPORT AND MAKING THIS A SAFE AND WONDERFUL PLACE TO LIVE. YOUR SUPPORT WITH A REASONABLE BUDGET HELPS US HIRE PEOPLE AND GET TOP NOTCH TRAINING AND THE EQUIPMENT WE NEED TO DO OUR JOB. THE ENCOURAGEMENT YOU GIVES US MAKES THE OFFICERS FEEL VALUED AND A SENSE OF SELF-WORTH. IT MAKES THEM UNDERSTAND THEIR EFFORTS ARE APPRECIATED. THANK YOU FOR THE SUPPORT. WE ALSO WANT TO THANK THE AMAZING COMMUNITY. WE HAVE HAD THEM STOP IN ALMOST DAILY. AND THE COMPLIMENTS AND THUS SUPPORT OUR 101 IN RELATION TO COMPLIMENTS AND COMPLAINTS. IF WE FOCUS ON HIS PROCLAMATION AND WHAT IT REPRESENTS, I THINK IT IS IMPORTANT THAT WE REMEMBER THE PROFESSION IN WHICH THE MEMBERS ARE SUBJECTED TO BE THREATENED, ASSAULTED, KARSTADT, AND SOMETIMES EVEN KILLED IN THE LINE OF DUTY. 1930 MARKS THE LAST TIME -- 1954 WAS LAST TIME A POLICE OFFICER WAS KILLED IN CITY LIMITS OF [00:20:02] FERNANDINA BEACH. WE KNOW ALL TOO WELL HOW QUICK A TRAGEDY CAN OCCUR AND WE ARE STILL REELING AS A COMMUNITY AND COUNTY FOR THE DEPUTY BACK IN SEPTEMBER. MORE RECENTLY THE DEATH OF STATE AGRICULTURAL OFFICER JUSTIN WHO PASSED AWAY IN FEBRUARY WHILE SERVING AS A STATE POLICE OFFICER. WE KNOW THE SACRIFICES THAT THESE OFFICERS MADE AND THE ONES -- AND THE SACRIFICES MADE BEFORE THEM. WE WANT TO THANK YOU FOR RECOGNIZING THOSE SACRIFICES. I WOULD BE REMISS IF I DIDN'T SHOW APPRECIATION TO THE MEN AND WOMEN BEHIND ME HERE. THESE ARE THE MEN AND WOMEN OF THE FERNANDINA BEACH POLICE DEPARTMENT. THERE ARE SEVERAL THAT ARE NOT HERE THEY ARE WORKING RIGHT NOW. IT IS MY HONOR TO BE PART OF THIS AGENCY. THESE ARE PEOPLE COME TO WORK EVERY DAY TRYING TO MAKE A DIFFERENCE IN TRYING TO MAKE IT A BETTER PLACE TO BE AND THEY ARE TOTALLY DEDICATED. I AM CLOSING WITH THREE QUICK THINGS. THANK YOU TO THE POLICE OFFICERS FOR SERVING, WE APPRECIATED. THANK YOU TO THE COMMISSION FOR YOUR SUPPORT. THANK YOU TO OUR COMMUNITY FOR ALLOWING US TO SERVE IT IS MUCH APPRECIATED. [4.6 PROCLAMATION - "MUNICIPAL CLERKS WEEK"] >> WHEREAS IN THE UNITED STATES, THE MUNICIPAL CLERK HAS EXISTED FOR CENTURIES AND IS THE EARLIEST KNOWN LOCAL GOVERNMENT PUBLIC SERVANT. PRIOR TO BIBLICAL TIMES, THEY WERE REFERRED TO AS REMINDERS OR REMEMBRANCE AND THE COURT'S MEMORY SERVED AS PUBLIC RECORD. THE MUNICIPAL CLERK IS THE HISTORY OF THE CITY. FOR THIS REASON COURTS REMAIN UNEQUIVOCALLY NEUTRAL AND GOVERNMENTAL AFFAIRS AND UNMATCHED PROFESSIONAL CASHBACK AND PROVIDE EQUITABLE SERVICE. FROM THIS TIME HONORED FOUNDATION, THE MULTIFACETED FUNCTIONS OF LOCAL GOVERNMENT ADMINISTRATION AND SERVICES WHICH ARE PRESCRIBED AND DEFINED BY CHARTER STATUE COURT OF ORDINANCE AND COMMISSION DIRECTNESS. AS SUCH IT IS DIFFICULT TO FULLY DESCRIBE THE COURT'S ROLE IN RESPONSIBILITIES AS THERE ARE HUNDREDS OF TASKS THEY FULFILL ON ANY GIVEN DAY. THE EMINENT POLITICAL SCIENTIST WRITING ONE OF THE FIRST TEXTBOOKS NO OTHER OFFICE IN MUNICIPAL GOVERNMENT HAS SO MANY CONTRACTS, SERVES THE MAYOR, THE CITY COMMISSION AND ALL ADMINISTRATIVE DEPARTMENTS WITHOUT EXCEPTION. ALL OF THEM CALLED UPON THE WORK IS NOT SPECTACULAR BUT IT DESERVES VERSATILITY, ACCURACY, THESE WORDS WRITTEN 88 YEARS AGO ARE STILL RELEVANT TODAY. THEREFORE BY VIRTUE OF THE AUTHORITY INVESTED IN ME AS MAYOR OF FERNANDINA BEACH DUBAI RECOGNIZE ALONG WITH MY CITY COMMISSIONERS, THE WEEK OF MAY'S 1ST-MAY 10. NOTE CAROLINE AND I MEET FREQUENTLY. I COULD NOT DO MY JOB WITHOUT HER. SHE IS MY RIGHT HAND. SHE IS MY STEADY RIGHT HAND AND [00:25:02] WHEN I AM OUT ANYONE THAT HAS INTERACTION WITH CAROLINE, I ONLY SEE THE TIP OF THE ICEBERG OF WHAT YOU DO SO CONGRATULATIONS. >> WE ARE HERE FOR NATIONAL CARE [4.5 PROCLAMATION - "NATIONAL TRAVEL & TOURISM WEEK"] -- NATIONAL TRAVEL AND TOURISM WEEK THEY HAVE A NEW VIDEO WHICH I WILL YET LET MR. LIKELY INTRODUCED. >> AS YOU KNOW THE YEAR 2020 WAS A TERRIBLE YEAR FOR ALL OF US IN THE COMMUNITY AND THE CITIZENS AND OUR PARTNERS. GET 2021 WE SAW A GREAT RECOVERY. WE HAVE A VIDEOTAPE IT WILL SPEAK FOR ITSELF. ( VIDEO PLAYING ). >> 2021 LOSERS STAYED OVERNIGHT ON THE ISLAND HER POSITIVE ECONOMIC IMPACT TO DELIVER $1 BILLION THIS TRANSLATE INTO VERY REAL AND PERSONAL METRICS. >> WE ARE PROBABLY AROUND 30% LOCAL AND 70% OF THE ANSWERS AND PEOPLE WHO OWN SECOND HOMES ON THE ISLAND. THATCHERISM IS A BIG PART OF THE BUSINESS FOR ALSO WE HAVE A LOT OF CLIENTS THAT WERE ONE SOURCE AND THEY CAME HERE AND FELL IN LOVE THE AREA AND ENDED UP PURCHASING A HOME THEATER. >> 1% OF JOBS ARE DIRECTED AND SUPPORTED BY TOURISM DOLLARS. THAT TRANSLATES TO 13,000 JOBS ACROSS THE COUNTY. ADDITIONALLY 29% OF THE GDP IS DIRECTLY SUPPORTED BY VISITORS. WITHOUT PEOPLE VISITING AND SPENDING MONEY AT RESTAURANTS, MOTELS AND SERVICE PROVIDERS, AND OVERALL REDUCTION IN A QUALITY OF WOULD BE EXPERIENCED BY EVERYONE ACROSS THE COUNTY. >> YOU WON'T HAVE THE GREAT RESTAURANTS AND ROUTINES YOU DON'T HAVE SOMEONE TO KEEP THE BUSINESS DRIVING. >> THIS IS WHERE WE ARE TODAY. EACH HOUSEHOLD SAVE $3,700 ANNUALLY ON ALL STATE AND LOCAL TAXES. THAT IS HUGE. WE CAN'T THINK LOSERS WERE HELPING TO KEEP OUR TAX BURDENS LOCATED. >> SOMETIMES YOU DON'T STOP TO THINK HOW IT REALLY OF FACTS EVERYTHING HERE. >> IS A HUGE IMPACT ON THE LOCAL [00:30:02] ECONOMY. IT PROVIDES FOR EDUCATION AND PARKS AND EVERYTHING WE LOVE IN THE AREA. >> ADDITIONALLY VISITS THAT ONE OF THE 40 EVERY 1 DOLLAR INVESTED IN MARKETING FROM THE DEVELOPMENT COUNCIL CARE FOR EVERY 1 DOLLAR SPENT ON MARKETING $10 WENT BACK TO THE PUBLIC SCHOOL SYSTEM. FIFTY-FIVE DOLLARS WENT TO PAY FOR VITAL SERVICES LIKE POLICE, FIRE AND EMS AS WELL AS INFRASTRUCTURE PROJECTS THAT MAKE THE COUNTY SUCH A GREAT PLACE TO BE. THE THEY PUT US ON A SUSTAINABLE PATH TO CREATE OPPORTUNITIES FOR SMALL BUSINESSES AND FAMILIES TO THRIVE AND ENRICH THE QUALITY OF LIFE WE ALL ENJOY ACROSS THE COUNTY. IN SHORT TOURISM REALLY WORKS FOR NASSAU COUNTY. THE PLACE WE CALL HOME, I HOPE THIS HAS BEEN INFORMATIVE AND SHED A POSITIVE LIGHT ON WHAT EACH VISITOR BRINGS WITH IF YOU WANT TO LEARN MORE I WILL GET YOU THE FULL REPORT ON BEHALF OF THE DEVELOPMENT COUNCIL I WANT TO THANK YOU FOR YOUR TIME AND HELPING TO MAKE A MILLION ISLAND IN NASSAU COUNTY SUCH A GREAT PLACE FOR VISITORS AND LOCALS TO COME MAKE MEMORIES. >> NOW THEREFORE BY THE AUTHORITY VESTED IN ME AS MAYOR OF THE CITY OF VERNON NINA BEACH. -- I'M GLAD WE HAVE DIVERSITY. PROCLAIM THE WEEK OF MAY 1, 2022 AS NATIONAL TRAVEL AND TOURISM WEEK. >> CONGRATULATIONS. . >> THAT TELLS A PRETTY GOOD STORY, AND THE IMPORTANT THING IS WHAT MAKES OUR DESTINATION WELCOME AND WARMING IS THE CITIZENS OF OUR COMMUNITY. I WANT TO THANK YOU AND WE COULD NOT DO OUR JOB WITHOUT THE SUPPORT OF POLICYMAKERS. I WANT TO RECOGNIZE THE CITY COMMISSION AND COUNTY COMMISSION WHO ARE SPONSORS. MR. MAYOR, THANK YOU AGAIN. >> THANK YOU, SIR. . [5. PUBLIC COMMENT REGARDING ITEMS NOT ON THE AGENDA (Part 1 of 2)] COMMENT FOR ITEMS NOT ON THE AGENDA. JAMES R. SAY YOUR NAME AND ADDRESS FOR THE RECORD. >> MY NAME IS JAMES THAT I LIVE AT 2738C GROVE LANE I'M A MEMBER OF THE GOLF ADVISORY BOARD I WANT TO SPEND A FEW MINUTES TALKING ABOUT THE GOLF COURSE. I'M NOT HERE TO BEG FOR MONEY BECAUSE I KNOW THAT WOULD BE AN UPHILL BATTLE RIGHT NOW. BUT WHAT I WANTED TO DO WAS TO COMMEND DALE MARTINSON DEPARTMENT FOR THE COLLABORATION WITH THE CITY AND SUGGEST INSTITUTIONALIZING GOING FORWARD PERHAPS A WAY FOR THE GOLF COURSE TO BENEFIT FROM THE CITY'S RESOURCES AND NOT USE AS MUCH FUN SPIRIT A RECENT EXAMPLE TO HIGHLIGHT THAT THE GOLF COURSE RECENTLY DID A LOT OF TREE WORK, IT COULD HAVE BEEN DONE BY THE CITY BUT IT WASN'T AND THE GOLF COURSE SPENT I THINK $15,000 OR SOMETHING LIKE THAT. THAT IS JUST ONE EXAMPLE THE WAY THE GOLF COURSE COULD BENEFIT FROM BEING PART OF THE CITY AND INSTITUTIONALIZE THE PLANNING PROCESS WITH THE SUPERINTENDENT OR MANAGER, TO TRY AND PROVIDE A WAY FOR THE GOLF COURSE TO GET WORK DONE. WE KNOW THEY HAVE A LOT OF DEFERRED MAINTENANCE THAT HAVE BEEN IGNORED. AND THE OTHER WAY THE GOLF COURSE COULD BENEFIT WHICH IS WHY WE SUGGESTED NOT HAVING A MANAGEMENT COMPANY MANAGE THE COURSE. THAT IS JUST ANOTHER EXPENSE. THERE'S NO REASON FOR THAT EXPENSE. WE JUST LOOK FOR WAYS THAT SUGGEST WAYS TO SAVE MONEY FOR THE GOLF COURSE FOR THE DEFERRED MAINTENANCE THAT HAS BUILT UP OF THE YEARS. THANK YOU VERY MUCH. >> THANK YOU SIR. >> ITEM SIX RESOLUTIONS, 641 [00:35:01] VOLUNTARY ANNEXATION AGREEMENT. >> ACTUALLY MR. MAYOR I RESPECTFULLY REQUEST THAT WE RECOGNIZE OUR BUILDING OFFICIAL AND THE FLORIDA BUILDING CODE ASK THAT THE CITY COMMISSION MAKE THE FORMAL APPOINTMENT OF THE BUILDING OFFICIAL BUT OUR CITY CHARTER STILL APPLIES WITH REGARD TO SECTION TEN IN DIRECTING OR HIRING AND FIRING THE DAILY STUFF. BUT THE LOCAL GOVERNMENT AGENCY SHOULD MAKE AN APPOINTMENT. >> I AM ASKING FOR A MOTION BUT ( INDISCERNIBLE ) I WOULD LIKE TO ASK JIMMY TO COME UP AND SOMEBODY MAKE A MOTION POLICE TO APPOINT JAMES P AS THE BUILDING OFFICIAL. >> I MOVED TO APPOINT. SECOND. >> AS. >> YOU DON'T NEED TO SAY ANYTHING ELSE. >> THANK YOU ALL. >> MADAME CLERK WILL YOU PLEASE CALL THE VOTE. (ROLL CALL) IT PASSES 5-0. NOW ONTO SIX-POINT ONE. [6.1 VOLUNTARY ANNEXATION AGREEMENT - 1467 S. 4TH STREET] VOLUNTARY ANNEXATION AGREEMENT. >> THIS AGREEMENT, IT IS WHAT I WOULD LIKE TO DO FIRST ASKED STAFF AND IF YOU WANT TO INTRODUCE IT AND WHAT IT IS FOR IT IS FOR APPROXIMATELY 5 ACRES ON SOUTH FOURTH STREET LOCATED ON THE MARSH NEAR THE RIVER. WHAT I WOULD ASK OF COMMISSION TO DO IS TO POSTPONE THIS CONSIDERATION OF THIS ANNEXATION AGREEMENT AND A MOTION AND A SECOND FOR THAT WILL ALLOW YOU TO DISCUSS IT IF YOU WISH BUT WE ASKED YOU TO DO THIS BECAUSE THIS AGREEMENT, BEEN DOING RESEARCH. THE NORMAL PROCESS FOR WATER AND SEWER & THE STANDARD AGREEMENT, I HAVE DONE RESEARCH BASED ON THE HOW MUCH CITIZENS AND COMMISSIONERS THAT ARE FRUSTRATED WITH PROVIDING WATER AND SEWER AND AN ANNEXATION AGREEMENT AND THEN HAVING PROPERTIES DEVELOP UNDER THE REGULATIONS OF THE COUNTY. MIGHT RESEARCH AS REVEALED, BUT I WANT IT IN WRITING, IT SAYS THAT THE CITY COULD ASK PROPERTY OWNERS THAT WISH TO CONNECT WATER AND SEWER AND HAVE IN OUR ANNEXATION AGREEMENT THAT THEY DEVELOP UNDER THE REGULATIONS OF THE CITY. THE LAND DEVELOPMENT CODE IN REGARD TO DENSITY AND ALL OF THE OTHER THINGS THAT GOT BUFFERS. NOW THE ANSWER BACK TO ME FROM OUTSIDE COUNSEL, IT WAS AS LONG AS THE CITY'S REGULATIONS ARE STRICTER THAN THE COUNTIES. SO THERE IS SOME GUIDANCE TO GET THERE THAT PROVISION IS NOT IN DISAGREEMENT. I ASKED THAT YOU POSTPONE IT. I HAVE NOT SPOKEN TO THE PROPERTY OWNER MYSELF BUT I ASK THAT YOU POSTPONE IT UNTIL JUNE 21 AND HOPEFULLY I CAN WORK WITH THE PLANNING DEPARTMENT AND THE OWNER TO GET THE AGREEMENT AND HAVE THEM RE-SIGNED IT AND SUBMIT IT TO YOU SO THE DEVELOPMENT WOULD BE UNDER THE CODE. >> RECOMMEND -- I MOVED. >> WHAT THE VICE MAYOR WAS MAKING A MOTION? >> TO POSTPONE UNTIL JUNE 21. >> I DID NOT KNOW WHAT YOU WERE DOING IT FOR WAS IT TO MAKE A MOTION? >> COMMISSIONER ROSS LIGHT WAS ON SO -- >> I MOVED TO POSTPONE CONSIDERATION OF THIS VOLUNTARY ANNEXATION AGREEMENT UNTIL THE JUNE 21 COMMISSION MEETING THAT THE CITY ATTORNEY IS WORKING WITH OUTSIDE COUNSEL ON RESEARCHING ON DEVELOPMENT OF PROPERTY UNDER THE CITY'S COMPREHENSIVE PLAN AND THE DEVELOPMENT CALLED. ANNEXATION AGREEMENT UNTIL WE GET LANGUAGE CHANGE INCLUDING DEVELOPMENT. IT MUST OCCUR UNDER THE CITY'S REGULATIONS. >> SECOND. >> I HAVE A MOTION AND A SECOND. ANY DISCUSSION? COMMISSIONER STURGIS. >> THANK YOU MAY APPEAR IF THE HOMEOWNER OR HOMEOWNER WOULD LIKE TO SPEAK AND DISCUSS IT, I THINK WE CAN ALL POSTPONE AND I THINK WE ALL WOULD AGREE, THAT IS THE WHOLE REASON WE WANT ANNEXATION IS TO CONTROL THE MANNER AND DEVELOPMENT AND THE BUFFER'S OF THE ZONING. I DON'T KNOW IF THEY WANT TO SPEAK THIS EVENING OR NOT BUT THEY PROVIDE A PRESENTATION MAY BE HELPFUL IN THE PROCESS TO SPEEDED UP IN THE PROCESS, SINCE THEY ALREADY HERE. THAT IS MY ONLY THOUGHT. >> WAIT A MINUTE. [00:40:02] COMMISSIONER ROSS, WHEN YOU MAKE A MOTION TO POSTPONE,. >> YOU CAN'T DISCUSS IT, THAT MEANS IT IS UP TO THE CITY COMMISSION ON HOW MUCH YOU DISCUSS AND HOW MUCH YOU WANT INFORMATION ON. >> VICE MAYOR. DANCE CERTAINLY I THINK WE SHOULD HAVE THE OPPORTUNITY TO PRESENT AND DISCUSS, FOR SURE. I ASSUME THIS IS TO EVERYONE'S BENEFIT. THE POSTPONEMENT. >> YES. IN FAIRNESS TO THE APPLICANT, THIS CAME UP JUST RECENTLY, SO IT IS NOT A I GOTCHA KIND OF THING. >> MICHAEL -- JACKSONVILLE, FLORIDA. THIS WILL BE QUICK JUST A FEW SLIDES. I DON'T MIND DOING THIS IN JUNE IF WE POSTPONE. FIVE-POINT 45 ACRES SOUTHWEST OF YEAR PERIOD SOUTH OF THE FACILITY. SOUTH OF ( INDISCERNIBLE ) STREET. A HISTORICAL BLACK 19 PROVIDED LOTS CONFIRMED UNDER FLORIDA ADMINISTRATIVE CODE 64 -- C6. YOU CAN SEE THE HISTORY OF THE SITE, IT IS A JUNKYARD IT HAS BEEN CLEANED UP OVER THE YEARS. VERY LIMITED VEGETATION. AND SPECIES OF ANIMALS. THE BOARD WAS ISSUED -- WE OBTAINED AN ENVIRONMENTAL FOR FOUR UNITS. NO WETLAND IMPACTS ARE REQUIRED. THERE'S A LOT OF OF NASSAU LAND USE USING EIGHT UNITS PER ACRE, WE INITIALLY DESIGNED CONSISTENT WITH NASSAU COUNTY REGULATIONS. WE MET WITH THE COMMISSIONERS TO TALK ABOUT THIS AND WE MET WITH PEOPLE IN THE COMMUNITY. THE BIGGEST PUSHBACK WAS THE DENSITY. WE ALSO GOT PUSHBACK ON RESTRICTING THE VIEWPOINT. AFTER THAT THIS IS A DUPLEX CONCEPT THAT HAS ONLY NINE UNITS MORE THAN OUR VESTED DENSITY. OUR VESTED 19TH THIS SHOWS 28. THIS IS A 35% DECREASE AND A DECREASE FROM THE COMPARABLE THE COMPARABLE DENSITY UNDER THE FERNANDINA BEACH ZONING. THROUGH THE ANNEX AGREEMENT ALLOWING US TO TIE-IN, WE WERE ABLE TO CLOSE LOOPS. THIS IS THE BENEFIT TO THE UTILITY AT OUR EXPENSE. THE PROPERTY IS 13 HUNDRED FEET. WATER MAN AND RUN IT ALL OF THE WAY UP THROUGH FORT STREET. WE WOULD ALSO COLLECT A SEWER MAIN, THESE WOULD ALL BE AT OUR EXPENSE. UNDER THE ANNEX AGREEMENT WE CAN AVOID THE SEPTIC TANKS AND BY EXTENDING YET THE STRENGTH THAT UTILITIES THE CITY HAS THE ABILITY TO REMOVE MORE SEPTIC TANKS WITHOUT ADDITIONAL EXPENSE. JUST A QUICK BULLET POINT. THIS WAS CONTAMINATED AND THEN CLEANED OUT. NINETEEN LOTS THESE WERE MINDFUL. WE WANT TO TAKE THAT APPROACH. THIS DESIGN AFFECTS THE WETLANDS, WILDLIFE AND TREES. [00:45:05] THIS IS ONLY 65% OF THE DENSITY AND ONLY NINE UNITS ABOVE THE DENSITY. THIS IS ONLY 14 STRUCTURES ONLY FIVE FEWER STRUCTURES WOULD BE BILLED UNDER. SO THE INCREASED VIEWPOINT. I ALSO LIMIT THE DENSITY. I -- AGAIN, EXTENDING THE UTILITIES TO CLOSE LOOPS AND REDUCE THE FUTURE COSTS OF ELIMINATING FUTURE SEPTIC TANKS IN THE AREA. THANK YOU. >> ANY DISCUSSION. >> I AM DISAPPOINTED THAT THEY DID KNOW THIS WOULD HAPPEN. WE KNEW YOU WERE AWARE OF IT. >> IF THERE'S NO OTHER DISCUSSION, I'M GOING TO WAIT FOR THE CITY CLERK. >> ESPECIALLY IF THE APPLICANT IS WILLING TO DEVELOP UNDER THE CITY'S RULES AND REGULATIONS, I HAVE NO PROBLEM WITH THIS PLAN. THE BIGGEST ISSUE IS WHAT I DON'T WANT, A LONG LIST OF VARIANCES THAT WE END UP IN THE SAME SITUATION. IF THIS WERE TO DEVELOP, I SEE NO PROBLEM WITH THIS PLAN. >> I JUST WANT TO APOLOGIZE TO THE PROPERTY OWNERS I UNDERSTAND WE ARE TRANSITIONING, BUT AS WE ANNEX MORE PROPERTIES IT WILL HAPPEN. WE EXPECT THEY WILL ONLY DEVELOP 28 APARTMENTS AND UNDER OUR GUIDELINES ARE BUFFERS IN OUR ZONING. >> SO THE MOTION IS TO POSTPONE (ROLL CALL). [5. PUBLIC COMMENT ON REGARDING ITEMS NOT ON THE AGENDA (Part 2 of 2)] >> THAT MOTION PASSED 5-0. WE HAVE A GROUP OF RESTAURANTS -- RESIDENCE ON 15TH STREET, AND WE PROBABLY SHOULD GET IT PROACTIVE TO MAKE SURE WE UNDERSTAND WHAT KIND OF COMMERCIAL ACCESS WE WOULD HAVE THAT WOULD BE I'M SURE GOING FORWARD IT WILL BE APPLICANTS WHO WANT TO DO COMMERCIAL ACCESS ON 14TH STREET. THIS IS FINE. THIS IS WHAT 14TH STREET IS. IT IS 15TH STREET THAT WE ARE CONCERNED BECAUSE IT IS HARD TO IMAGINE BUT WITH EVERYONE BEING FAMILIAR BUT 15TH STREET DOES HAVE COMMERCIAL USE. IT JUST DOESN'T HAVE ENCROACHMENT AFFECTS. [00:50:02] BUT BASICALLY WE ARE TRYING TO DRAW ATTENTION TO THE COMMISSIONERS, WHEN YOU LOOK AT THE COMMERCIAL USE OF 14TH STREET AND THE APPLICANTS ASKING TO DEVELOP THEIR, THERE IS A POSSIBILITY OF BUFFERING THE COMMUNITIES OF THE SINGLE-FAMILY HOMES THAT ARE BEHIND THE 15TH STREET USE OF THAT PROPERTY. IF ANY OF THAT IS OF INTEREST TO YOU, I THINK IT IS GOOD FOR US GOING FORWARD, WITH THE APPLICANTS WANTING TO USE COMMERCIAL THERE WOULD NOT BE A CUT FOR ANY COMMERCIAL INTERESTS OR EGRESS THAT WOULD BE DISRUPTED. [6.2 VOLUNTARY ANNEXATION AGREEMENT - 2112 S. 8TH STREET] >> ALRIGHT ITEM 6.2, VOLUNTARY ANNEXATION. >> THANK YOU MR. MAYOR THIS IS AN AGREEMENT FOR VOLUNTARY ANNEXATION IT INVOLVES THE PROPERTY AT 2112 SOUTH EIGHTH STREET. IT CURRENTLY HOUSES THE FIVE-POINT LIQUOR STORE. HAVE A FAILING SEPTIC SYSTEM THAT CONNECTS TO THE CITY WATER. >> I MOVED TO APPROVE. >> SECOND. >> I HAVE A MOTION AND A SECOND. ANY DISCUSSION. MADAME CLERK PLEASE CALL THE VOTE. TRAN SEVEN (ROLL CALL). [6.3 TEMPORARY EASEMENTS - UNITED STATES ARMY CORPS OF ENGINEERS (USACE) BEACH RENOURISHMENT] >> ITEM 6.7. >> THIS IS IN PREPARATION FOR THE 2024 BRANDING PROJECT. AS THEY HAVE DONE IN THE PAST THEY NEED ACCESS TO CERTAIN AREAS OF THE BEACH SO THEY ARE REQUESTING TEMPORARY EASEMENTS AT DAUPHIN STREET AND OCEAN AVENUE. >> RECOMMEND APPROVAL. >> SECOND. >> I HAVE A MOTION AND A SECOND. ANY DISCUSSION? SEE NONE MADAME CLERK PLEASE CALL THE VOTE. (ROLL CALL). [6.4 BUDGET TRANSFER - WASTEWATER DEPARTMENT] >> IT PASSES 5-0. >> ITEM SIX MORE FOR BUDGET TRANSFER WASTEWATER DEPARTMENT. >> THIS IS DUE TO THE RECENT INCREASE IN COSTS ASSOCIATED WITH MACHINE AND EQUIPMENT CITY STAFF IS REQUESTING A BUDGET TRANSFER IN THE AMOUNT OF $10,000 INTO THE WASTEWATER EQUIPMENT. >> I RECOMMEND APPROVAL. >> MOTION UNDER SECOND. ANY DISCUSSION? MADAME CLERK, PLEASE CALL THE VOTES. >> IT PASSES 5-0. [6.5 BUDGET AMENDMENT - MARINA RATES] >> ITEM 6.5 BUDGET AMENDMENT. MARINA RATES. >> THANK YOU AS PART OF THE SESSION CONDUCTED BY THE CITY COMMISSION ON JANUARY 26, REPRESENTATIVES INDICATED THEY WILL PROVIDE A PROPOSED RATE STRUCTURE, ON APRIL 1, THEY HAVE DONE THAT. THE RATE STRUCTURE IS IN YOUR PACKET WAS PRESENTED TO THE MARINA ADVISORY BOARD AT ITS MAY AND APRIL MEETING. THEY ARE ASPECT THEIR RECOMMENDATION WAS TO MOVE FORWARD WITH THE TRANSIT RATES AND THERE WERE THREE OPTIONS, OPTION A, OPTION B AND OPTION C AND AN INCREASE IN VALUE -- IN THE AMOUNT OF REVENUE TO BE GENERATED. THE PRINCIPAL NEED FOR INCREASED REVENUE IS FOR ( INDISCERNIBLE ) OPERATIONS AND FOR OTHER CAPITAL IMPROVEMENTS AT THE MARINA. THE MARINA ADVISORY BOARD DID [00:55:01] RECOMMEND OPTION B, WHICH IS A RATE INCREASE OF APPROXIMATELY 20% FOR LONG-TERM SUPPORT. >> MR. TAYLOR, -- >> LEVEL MOTION. >> I MOVE THAT WE ACCEPT RESOLUTION 2022-76 AND REVENUE. >> I SECOND THAT. >> MR. MAYOR, I KNOW THAT LATE IN THE DAY WE DID RECEIVE INFORMATION WITH REGARD TO THE RESOLUTION THERE WAS OTHER LANGUAGE WE CAN OFFER THAT. >> YOU MAY ADDRESS THE FLOOR. >> I DON'T KNOW IF I WANT TO JUMP, I REVIEWED THE INFORMATION I DO AGREE WE NEED MORE MONEY AND OPERATING CAPITAL, BUT I'M NOT SURE I'M READY TO. >> WE DON'T HAVE ENOUGH MONEY. THE MARINA'S FACE WHEN WE HAVE $750,000 PER YEAR IN PRINCIPAL AND INTEREST. RIGHT NOW WE ARE PAYING $360,000 FOR ACTION INSURANCE WHICH IS LIKELY TO GO UP TEN OR 20%. THEN THE FIRST -- THIRD CAUSES DREDGING. WHEN WE GET A DREDGING STUDY WERE NOT AND IT SHOWS WAYS TO REDUCE THAT, WE WILL NEED CAPITAL TO INSTITUTE WHATEVER IS RECOMMENDED IN THE STUDY. AND THAT WE NEED MORE MONEY. AND THE BOARD IS ADVISING US ON THE BEST WAY TO RAISE RATES THAT ARE SUSCEPTIBLE AND WILL GENERATE MORE HEARD -- REVENUE FOR THE CITY.% AND WE ALSO WANTED, WE WANTED TO CHANGE THE BATHROOMS DOWN THERE. WE DON'T HAVE THE REVENUE TO DO THAT. WE THOUGHT WE TOOK THE MONEY TO DO THAT, AND CHANGE THAT INTO DREDGING. JUDGING COST WILL ONLY GO UP. WE GOT A ONE-TIME GREAT DEAL BECAUSE ALL OF THE CASES, CORRECT ME IF I'M WRONG WERE MORE FOR DREDGING. THE NEXT LINE WE WILL NOT BE SO LITTLE KEY. WE NEED MONEY TO PAY FOR THESE THINGS. BY CONTINUALLY CUTTING BACK ON THESE RATES, 85 PEOPLE WAITING TO GET SLIPS. WE NEED TO INCREASE THE RATES TO PAY FOR IT. >> I WILL SAY SOMETHING CRAZY. I WILL SAY I AGREE WITH BOTH OF THEM AND YOU MAY SAY HOW COULD THAT BE. WE HAVE OPTIONS A, B AND C. I WANT OPTION B.5. RIGHT IN THE MIDDLE OF THOSE [01:00:02] TWO. IT IS A WAY THAT WILL GENERATE THE SAME REVENUE. I WILL TELL YOU WHY DON'T LIKE OPTION C. THE INCREASE ON COMMERCIAL IS 50%. AND RECREATIONAL IS ONLY 4%. I THINK WE SHOULD SHARE THAT MORE EQUALLY. IF YOU LOOK AT OPTION B, EVERYONE HAD AN EQUAL INCREASE OF 20%. YES THAT RESULTED IN MORE MONEY OVERALL, BUT IT WAS FAIR. AND THIS WAS PICKED BY THE MARINA ADVISORY BOARD. WHAT IF, EARS OPTION B.5 BECAUSE WE WILL MEET IN THE MIDDLE AND RAISE THE PERCENTAGE FOR EVERYONE FROM 20% TO TRACK 25%. THAT WOULD MAKE THE REVENUE ALMOST EQUAL TO OPTION C TO BEGIN WITH. BUT IT WON'T BE AS DRASTIC. I THINK THIS IS A FAIR WAY TO DO IT. THIS IS MOVING, IT IS 25% CHANGES THAT WOULD RESULT ON THE GOOGLE CALCULATOR, THIS IS ALMOST THE SAME REVENUE IS OPTION C. >> DID YOU SAY 103? >> $103,000 WOULD BE THE AVERAGE. >> BEFORE I MAKE THE COMMENT ABOUT THE MARINA. I JUST WANT TO COMMENT ON THE PERCENTAGE INCREASE AND I WE LOOK AT OPTION C. THIS IS A BIG INCREASE. WHEN WE LOOK AT, WHEN WE LOOK AT THE LONG-TERM WE HAVE 42 HAS THE TOTAL NUMBER. THIRTY COMMERCIAL OPERATORS. SO IT IS BASED ON LINEAR FOOTAGE. THE BUSINESS OWNERS ARE PROFITING OFF OF THE MARINA, THERE'S MORE WEAR AND TEAR ON THE FACILITY FROM THE. WHEN WE LOOKED AT THE RATE STUDY, THIS CAME UP AND THIS IS WHAT THEY ARE CHARGING. 1950 IS THE ONLY ONE HIGHER THAN US ON THE MARINA. WHAT WE LOOKED AT AND THIS IS SOMETHING WE DO ACROSS THE PORTFOLIO. ON THE EAST COAST THEY ARE DOING THIS. WE BREAK IT UP WHERE YOU HAVE A SLIPPED RIGHT IN COMPARISON WITH YOUR COMMERCIAL OPERATORS AND THEY PAID TWO TIMES THE AMOUNT OF THE RECREATIONAL BOATERS. THAT IS WHERE OPTION C CAME IN. IT IS WARRANTED AND HE KEEPS THE RATES MORE IN FAVOR. I WOULD BE HAPPY TO ANSWER ANY QUESTIONS AS WELL. >> I WOULD LIKE TO REFLECT ON WHAT HE SAID. THIS IS BEING SUBSIDIZED IN THE MARINA. I THINK THEY SHOULD PAY MORE. WHEN YOU LOOK AT THE PERCENTAGE, IT GENERATES MORE MONEY. THEY USE MORE MORAL AND THEY SHOULD BE ABLE TO PAY FOR. I WILL.OUT ON THE ADVISORY BOARD MOSTAR COMMERCIAL OPERATORS. AND SO, WE HAD THE SAME ARGUMENT ABOUT TEN YEARS AGO PEOPLE ON THE ADVISORY BOARD DID NOT WANT TO INCREASE THE RATE SPIRIT WE NEED MORE MONEY. IF THIS IS THE WAY TO GET MORE MONEY, I SUPPORT IT. >> THANK YOU. YOU ARE SAYING THESE COMMERCIAL RIGHTS, AT THIS INCREASE REFLECTS WHAT OTHER MARINAS ARE CHARGING, MY QUESTION IS WITH THAT, AND EVERYONE SAYS WEAR AND TEAR, WHAT IS THE DIFFERENCE WHY SUCH A HIGH PERCENTAGE VERSUS IF YOU SAY THERE IS A BACKLOG FOR LONG-TERM RENTERS. -DON'T KNOW WHY IT WOULD MAKE A DIFFERENCE, COULD THERE BE A HAPPY MEDIUM WHERE YOU CAN BRING UP THE RATES. MY QUESTION IS IF YOUR GOAL IS [01:05:05] 56%, ARE YOU GOING WITH THE 20% INCREASE FOR OPTION D AS WELL OR JUST 50% INCREASE COMMERCIALLY. AND RECREATIONAL IS 4%. >> IT IS ALL A SLIPPED RENTAL WHETHER COMMERCIAL OR RECREATIONAL. WE ARE JUST DIFFERENTIATING THE RATE. IT IS A LESSER INCREASE. >> IS THAT OF ALL ACROSS THE BOARD. THAT IS ONE AND A HALF TIMES MORE FOR JUST THE COMMERCIAL. IF THEY CLAIM THIS IS WHAT I DO AS A BUSINESS. >> IF THIS IS SOMETHING, IT IS NOT A NEW CONCEPT. IF YOU RECALL ALMOST ONE YEAR AGO WE HAD A CONVERSATION ABOUT RATES. THERE WAS OF GREAT THAT WAS MOSTLY COMMERCIAL OPERATORS PAYING. AND WHAT WE DID WAS THIS. THIS IS A CONCEPT THAT WAS IN PLACE BEFORE WE DID THIS AND NOW WE ARE REVISITING THE CONCEPT. >> I AGREE, WE CAN'T KEEP EVERY DOLLAR WE TAKE OUT WE DEFER SOMETHING ELSE. THIS IS AS CLOSE AS IT CAN BE WHAT IT IS SUPPOSED TO BE. >> WE ARE INCREASING THE RATES ON THE RECREATIONAL BOATERS TOO. YOU ARE JUST INCREASING IT MORE. >> I JUST WANT TO POINT OUT TWO THINGS. AT 4% AND THE COMMERCIAL IS 56%. THIS IS DRAMATIC. I DON'T WANT TO MAKE SUCH DRASTIC CHANGES RIGHT AWAY. I FURTHER WOULD LIKE TO POINT OUT, THERE ARE SOME BUSINESSES ON THE MARGIN AND A PRICED OUT, I THINK 25% IS DRASTIC. FINALLY, ONE OF THE REASONS WE ARE DOING THIS, BECAUSE OF THE WEIGHT THIS SPIRIT IF WE ARE TRYING TO ADDRESS THAT, I'M NOT SURE WHY WE WOULD INCREASE THE RECREATIONAL TO MEET THAT POINT. WHY ARE WE NOT INCREASING AT A HIGHER POINT THAT IS MY POINT. I THINK WE DO WANT THE MARINA TO PAY FOR ITSELF. IT LOOKS LIKE WE ARE INCREASING MORE THAN THAT PERCENTAGE SPIRIT >> WE DO HAVE THE LAST WORD. >> OKAY, BOTH COMMISSIONER ROSS AND I, WERE AT THE ADVISORY BOARD MEETING SPIRIT AND COMMISSIONER ROSS IS CORRECT. THE FINANCIAL MODEL OF THE CITY IS NOT SUSTAINABLE. PEOPLE WHO USE THE FACILITIES NEED TO PAY FOR USE AND NOT BEYOND THE BACKS OF THE CITY TAXPAYERS. HAVING SAID THAT, HAVING LOOKED. >> I AGREE WITH EVERYTHING YOU SAY COMMISSIONER ROSS. THE MARINA NEEDS MONEY. MY ONLY PROBLEM WITH THIS PROPOSAL, WITH THE MOTION ON THE FLOOR IS THE INCREASE SPIRIT THAT IS BIG. MY COST JUST WENT UP SUBSTANTIALLY. AND I KNOW OF TWO BUSINESSES THAT JUST OPENED OUT THERE. AND WHAT I HEARD THE MARINA SAY IS, THE MARINA HAS NOT BEEN UNDER OASIS, FUEL OPERATION -- FULL OPERATION. WE HAVE NOT HAD A FULL YEAR YET. I DON'T AGREE WITH THEM WAITING. I AGREE WE NEED TO RAISE THE [01:10:06] RATE. WE NEED TO GENERATE INCOME. I WOULD FEEL MORE COMFORTABLE RAISING IT 25%, GETTING THE HYDROLOGY STUDY, DETERMINING WHAT THAT WILL COST OR IF WE WILL KEEP DREDGING, COMMISSIONER ROSS IS CORRECT ON THE INSURANCE, THAT IS NOT GOING AWAY. AND THEN AFTER KNOWING THAT, I'M SORRY, THAT IS TOO BIG OF A BITE OF AN APPLE IN THE FIRST YEAR. AND NEXT YEAR, LOOK AT ALL OF THE FACTORS THAT I'VE MENTIONED AND SAY DO WE NEED TO ADJUST IT AGAIN. GO AHEAD SIR. >> YOU KEEP TALKING ABOUT BOOK COSTS GOING UP THEY ARE GOING UP. THEY ARE GOING UP FOR THESE BUSINESSES, I UNDERSTAND THAT. WHO WILL BEAR THE COSTS WILL OURS GO UP. WILL BE THE CITY TAXPAYER, OR WILL YOU NOT FUND THE MARINA, WHERE WILL IT COME FROM. ARE THERE COMMERCIAL VENTURES THERE? IT'S UNREALISTIC WHAT THEY ARE CHARGING. AND CHARGING LESS THAN IT COSTS. AND ALL OF THE DECREASING, SUBSTANTIAL AMOUNTS OF MONEY AND I'M TALKING HUNDREDS OF THOUSANDS OF DOLLARS TO DO THAT. THAT MONEY HAS TO COME FROM SOMEWHERE. IT'S NOT REALISTIC AND IN MY OPINION IT IS FISCAL RESPONSIBILITY NOT TO GET AS MUCH MONEY AS WE CAN TO PAY FOR THE MARINA. >> THANK YOU. >> THANK YOU. AM TIRED OF HEARING IT. I -- THAT IS ALL WE ARE AT THE MEETING SPIRIT THAT IS WHAT I'VE BEEN HERE FOR THE LAST MONTH. I AGREE THERE ARE SOME THINGS THAT CITIZENS NEED TO BETTER BUT 56% IS AN ABNORMAL AMOUNT I THINK IF WE FOLLOW THROUGH IT WILL COST US HUNDREDS OF THOUSANDS OF DOLLARS. BUT IF THERE IS A SYSTEM THAT WILL HAPPEN. WE DON'T HAVE TO HAVE WAVE ACTION INSURANCE. THAT IS ANOTHER THING THAT IS AN OPTION. THAT IS A GOOD RATE TO START WITH. WE CAN RAISE THE RATES ANYTIME WE WANT WE CAN RAISE THEM NEXT MONTH OR TWO MONTHS FROM NOW. WE HAVE THE OPTION TO DO ANYTHING WE WANT TO DO. 25% IS A GOOD START, AND THAT IS WHERE I SIT. >> VICE MAYOR. >> I AGREE WITH WHAT CHIP WAS SAYING,. >> SO I'M GOING TO CALL THE BOAT ON THE MOTION IT IS TO ACCEPT OPTION C WITH THE AMENDMENTS INTRODUCED AND READ BY COMMISSIONER ROSS. WITH THE% CHANGE I THINK ALL OF [01:15:23] THE BOAT SLIPS WOULD CAUSE $25 PER BOAT PER MONTH. THAT IS WHAT WE ARE GOING FOR. WE ARE GOING FOR THE ROUND NUMBER OF $25 PER BOAT -- VOTE. >> I HAVE A MOTION AND A SECOND. THAT IS WHAT YOU BASED YOUR COPULATION OF $103,000 ON. >> WE ARE INCREASING ALL SLEEP USAGE. SLIGHTLY ABOVE A 25% INCREASE. IT WOULD BE 100 30,000 DOLLARS IN CHANGE. CHANCE JUST TO BE CLEAR WE ARE GOING TO $25? >> THAT IS -- I JUST WANT TO BE CLEAR $25.25'S PERCENT. >> AND COMMISSIONER ROSS, YOU HAVE THE FLOOR. >> THEY WILL INCREASE THE TRANSIENT RATES AS RECOMMENDED. AND FOR THE SLIP OLDER RATES WHERE THERE ARE MORE COMMERCIAL, MORE COMMERCIAL THAN JUST A BIG SHOUT OUT TO THE MARINA OPERATOR. >> PEEKING FOR THE COMMISSIONER THAT IS A CLOSE APPROXIMATION OF 25% NOT 20%. >> THE COMMISSIONER IS PROPOSING IS YOU MAKE THE PERCENTAGE CHANGE BUT HE SAYS MAKE IT $25 PER MONTH, THE FEE HAS CHANGED. >> HOW MUCH MONEY WOULD $25 PER MONTH -- APPROXIMATELY $104,000. >> >> THE TOTAL BUDGET WILL CHANGE BECAUSE OF INCREASE REVENUES. >> SEE NO MORE DISCUSSION. MADAME CLERK CAN YOU CALLED THE VOTE. (ROLL CALL). [6.6 BUDGET AMENDMENT - AMERICAN RESCUE PLAN ACT] >> THE MOTION PASSED 4-1. >> ALL RIGHTS ITEM 6.6 BUDGET AMENDMENT AMERICAN RESCUE PLAN ACT. >> THANK YOU THIS IS A PROPOSED BUDGET TO REMOVE THE CALLS ASSOCIATED WITH THE CONSULTING SERVICES FOR THE CITIES YOU SENT REPORTING FROM THE GENERAL FUND TO MAKE USE OF ACTUAL AMERICAN RESCUE ACT FUNDS. THE AMOUNT IS APPROXIMATELY $3,300. >> MOVED TO APPROVE. DO I HAVE A SECOND. >> I HAVE A MOTION AND A SECOND. ANY DISCUSSION? I SEE NONE MADAME CLERK PLEASE CALL THE VOTE. (ROLL CALL). [6.7 BUDGET AMENDMENT - WATERFRONT ROADWAY IMPROVEMENTS/CHANGE] >> THAT PAST 5-0. ITEM 6.7 BUDGET AMENDMENT WATERFRONT ROADWAY IMPROVEMENTS MOVED TO APPROVE. >> SECOND. >> I HAVE A MOTION AND A SECOND. >> MR. MAYOR THIS A REQUEST FOR A BUDGET AMENDMENT THERE HAS BEEN INCREASED COSTS DUE TO THE RAILROAD REQUIREMENTS FOR SAFETY. CITY STAFF IS RECOMMENDING WE [01:20:03] UTILIZE A PORTION OF THE $140,000 WHICH WAS PREVIOUSLY BUDGETED FOR APPROVAL AT THE PROJECT. AND $109,000 OF THAT PROJECT. THE CITY THEY CAME IN SUBSTANTIALLY HIGHER. AND IT WILL BE ON NEXT YEAR'S BUDGET. >> I HAVE A MOTION AND A SECOND. MY QUESTION IS WHAT STATE IS THE ROOF AND. HOW LONG WILL IT LAST? >> IT WAS PUT IN THE BUDGET BECAUSE IT WAS NEEDED BUT NOT URGENT. >> IT WAS PRIORITY A AND AND YEAH THOSE PRIORITIES SAY IT IS TO PREVENT PUBLIC HEALTH ET CETERA, ET CETERA. I THOUGHT THERE WAS MORE TO IT. BECAUSE IT WON'T GO DOWN NEXT YEAR MOST LIKELY. THE FIRST QUESTION IS THE CONDITION OF THE ROOF. >> THAT BRINGS THE QUESTION OF, WHEN WE LOOKED AT OUR NUMBER ONE GOAL IS THE ASSESSMENT OF THE BUILDINGS AND IS THE TIER ONE BUILDINGS AND THIS IS IN THAT. WE ARE ONLY MISSING IT BY A FEW MONTHS. >> ANY OTHER QUESTIONS? OKAY I SEE NONE. MADAME CLERK WILL YOU PLEASE CALL THE VOTE. [7. CITY MANAGER REPORTS] >> CITY MANAGER REPORTS. >> THIS EVENING WE DO HAVE RELATED TO THE PROCLAMATION EARLIER ABOUT THE POLICE MEMORIAL THE COUNTY DOES HAVE THE ANNUAL MEMORIAL SERVICE TOMORROW AT THE NASSAU COUNTY SHERIFFS OFFICE AT 10:00 A.M. TOMORROW MORNING. IF YOU DO PLAN ON GOING OUT I RECOMMEND YOU GET THERE AT 9:00 A.M. IT IS HEAVILY PARTICIPATED IN. THERE ARE A LOT OF PEOPLE. IT IS A CHALLENGE I RECOMMEND IF YOU GO PLAN TO ARRIVE AROUND 9:00 A.M. A REMINDER, WE DO HAVE ONE MORE MEETING, THE LEAGUE OF CITY EVENT THURSDAY, MAY 19. I WOULD LIKE TO THINK THERE ARE FOUR SPONSORS FOR THAT. WHAT A WASTE MANAGEMENT AND THE TOURIST DEVELOPMENT COUNCIL AS WELL. WE HAVE FOUR SPONSORS. THERE WILL BE AN OUTDOOR DINNER SERVED. AND WE WILL TRANSITION TO A SUNSET RIVER CRUISE, I WANT TO THANK EVERYONE WHO SUPPORTED THIS EVENT. AND COMPLIMENTS TO THE RESORT. THANK YOU TO ALL OF THE LOCAL BUSINESSES AND THANK YOU FOR PROVIDING SUPPORT TO THIS EVENT. SPONSORS ARE INVITED AND WE MAY HAVE CITY STAFF THERE AS WELL. HAVE AN ENJOYABLE EVENING. >> UPDATE ON ATLANTIC SEAFOOD. >> I DID SPEAK WITH HER TODAY. SHE'S WORKING ABOUT GETTING PLANS. SHE WANTED TO SEE A SKETCH OF THE PARCEL THEY WOULD BE LEASING AND I SAID THERE HAS BEEN NO SUBDIVISION OF A PARCEL BUT I GAVE HER WHAT WAS PROPOSED BEFORE, IT SHOWS THE SQUARE FOOTAGE. SHE HAS NO INTEREST IN THE PARCEL SO SHE WAS LOOKING AT [01:25:03] ACTUALLY LOOKING AT LEASING 2500 SQUARE FEET. SHE ACKNOWLEDGED YOUR LIMITATIONS ARE ON THE BUILDING A 500 SQUARE-FOOT DECK. SO, SHE IS FULLY AWARE OF THE [8. CITY ATTORNEY REPORTS] PARAMETERS. >> ALL RIGHTS CITY ATTORNEY REPORTS. >> WE ARE STILL WAITING ON THE JUDGE TO GIVE US A HEARING DATE AND WE HAVEN'T HEARD FROM VALCOURT ON THAT. OTHER THAN THAT, I WILL BE ATTENDING TOMORROW AFTERNOON THROUGH SUNDAY THE CONFERENCE IN NAPLES FLORIDA. I AM AVAILABLE BY CELL PHONE AND E-MAIL AS ALWAYS. THAT IS ALL I HAVE THE LESS YOU HAVE QUESTIONS. >> VICE MAYOR. >> YESTERDAY YOU WERE SENT OUT THE PAST. I WANTED TO POINT OUT, THERE IS ONE ENVIRONMENTAL ONE AND THE CRITICAL WETLANDS THAT BASICALLY SAYS THE WATER MANAGEMENT DISTRICTS WILL USE ACQUISITION USING FUNDS FROM THE TRUST FUND. >> THIS IS THE ONE THAT WILL ACTUALLY AFFECT US. ONE OTHER THING BECAUSE I TALK TO EACH OF YOU AND THAT IS AFFORDABLE HOUSING. I'M JUST GOING TO SEE IT HERE. VACAVILLE, 962, IS A CLARIFICATION OF WHAT WAS ALREADY IN THAT BILL. IT IS UNDER 166, AND THAT IS AFFORDABLE HOUSING. IT PROVIDES LOCAL GOVERNMENTS, CITIES AND COUNTIES CAN PROVIDE INCENTIVES TO DEVELOPERS THOUGH -- SO WHEN YOU READ THE ENTIRE SECTION, YOU WILL SEE BECAUSE WE ARE SEEING SNIPPETS OF WHAT WAS ADDED. IT BASICALLY SAYS IF YOU HAVE A PROPERTY ZONED COMMERCIAL OR INDUSTRIAL IT IS AT THE OPTION OF THE CITY AND NOT MANDATED. A DEVELOPER COULD NOT USE THIS STATUTE THAT HAS EXISTED TO SAY YOU HAVE TO ALLOW ME TOO BUILD MY AFFORDABLE UNITS IN THIS INDUSTRIAL -- ON THIS PARCEL OR PROPERTY. I WANT TO MAKE IT CLEAR, WE HAVE HEARD ABOUT THAT. BUT WHEN YOU READ THE SECTION IN TOTAL IT IS A PROGRAM THAT THE CITY DRIVES AND CONTROLS AND IN THE INTEREST OF GETTING HOUSING AS FEW AS 10% OF THE UNITS THEY'RE GETTING IT READY FOR DEVELOPMENT OF THE DEVELOPER BIRTH CANNOT CELEBRATE THE UNITS, THEN THE CITY HAS TO PROVIDE INCENTIVES TO OFFSET THE COST BUT THE CITY DOES NOT HAVE TO DO THAT. NOTHING DETERMINES IF WE CAN OR SHOULD PROVIDE INCENTIVES. AND WITH THAT I WANTED TO APOLOGIZE TO THE DEVELOPERS. I DID NOT SEE ANYTHING BUT I SAW THE VISION AND THE COMMISSIONERS AND I DID NOT WANT A POSSIBILITY TO BE TURNED DOWN AND WE ENDED UP WITH SEPTIC TANKS. HERE IS MY CARD, PLEASE CALL ME. THANK YOU. >> THAT IS A GOOD THING. >> I DON'T KNOW IF THIS FALLS TOWARDS YOU OR MR. GEORGE, WHAT DID THE INSPECTION SHOW WHERE THEY REQUIRE PERMITS AND WHAT IS [01:30:06] THE FOLLOW-UP ACTION? >> I DON'T KNOW. >> I'LL DO IT. JIMMY AND I ALONG WITH OUR INTERIM BUILDING OFFICIAL, WENT TO THE SITE, WENT TO THE SECOND IN COMMAND. WE INSPECTED THE STRUCTURE. IT IS TEMPORARY. DATE SUBMITTED FOR IT, AND THE BUILDING CODE ALLOWS 180 DAY TEMPORARY PERMIT. THE WAY THEY EXPLAINED IT, I WILL SAY IT THE WAY THEY EXPLAINED IT. AND THEY NEED TO JUST PICK IT UP. >> THEY DID NOT REQUIRE THE PERMIT UNTIL YOU ( INDISCERNIBLE ). >> A TEMPORARY PERMIT WAS REQUIRED. >> THAT WAS PUT ONE WAY. >> MAYBE THIS WOULD PAVE THE WAY -- >> THERE WAS STERN DISCUSSION AT THE SITE MAY BE THE NEXT STRUCTURE WAS. >> >> THEY ARE SUPPOSED TO COMPLY. >> THERE IS DISCRETION BECAUSE IT WAS LATE. DID WE IMPOSE THAT. IT DOESN'T GET IMPOSED UNTIL THEY PICK THE PERMIT. THAT'S WITH ANY BUILDING OFFICIAL. >> THE ANSWER IS NO WE DID NOT. IT WAS UPON THE COMPANY TO PUT IT UP. THEY DIRECTED THEM TO DO SO BUT -- WE ALLOW THEM TO DO THIS. WE CHARGE THEM A REGULAR PERMIT FEE. IF IT WAS MORE. >> IT IS $150. YOU ARE TALKING LESS THAN $1,000. THIS IS SMALL. >> WHAT THE BUILDING OFFICIAL SAID MAKES SENSE. >> YOU TAKING ACTION LED TO THE INSPECTION CAN YOU ADDRESS BACK? >> IT WAS INCORRECT. [9. CITY CLERK REPORTS] [01:35:03] >> ITEM NUMBER NINE. >> THANK YOU SO MUCH FOR YOUR DEDICATION AND SERVICE. AND YOUR INTEGRITY. WE WILL MISS YOU. >> [10. MAYOR/COMMISSIONER COMMENTS] MAYOR AND COMMISSIONER COMMENTS, VICE MAYOR. >> LAST WEEK, WE FINISHED THE SIX WEEK TRAINING PROGRAM WHICH WAS A JOINT VENTURE. THE MAYOR SAID THE FIRST WAS TO PROVIDE TRAINING ALONG WITH AND TRAINING FORMER PEOPLE. IT WAS A $4,000 -- IT ALSO SHOWED US HOW EFFECTIVE AND SOME -- AND HOW EFFECTIVE OUR STAFF IS. THIS WILL LEAD TO SOME SIGNIFICANT MINOR CHANGES WHICH WILL IMPROVE A LOT OF THE MANAGEMENT ABILITIES. I THINK IT WAS A GOOD THING. IT WAS A PARTNERSHIP WHERE PEOPLE CAME UP WITH MONEY TO DO SOMETHING. OTHER THAN THAT, LIFE IS STILL GOOD. >> COMMISSIONER. >> THANK YOU MR. MAYOR. I HAVE A COUPLE OF QUICK THINGS. NUMBER ONE GREAT JOB WITH EVERYONE INVOLVED IN THE SHRIMP FESTIVAL. WHAT A GREAT TIME WE HAD. I WANT TO SAY THANK YOU TO THE COMMITTEE AND CITY STAFF. SPEAKING OF CITY STEP WE ALL GOT AN E-MAIL FROM A CONCERNED CITIZEN THAT WAS THANKING AND PRAISING OUR STAFF. I WILL READ A SMALL EXCERPT. IT IS FROM SOMEONE WHO LIVES ON LOS ROBLES DRIVE, THIS WAS ABOUT ONE OF THE RECENT STORMS WE HAD. IT KNOCKED OUT POWER AND AFFECTED THE UTILITIES AND OUR STAFF INCLUDING ANDRE, TREY, JASON INTO OTHER CITY STAFF. THEY CAME OUT TO RESPOND AND REPLACE A SHRUB THAT WAS DAMAGED BY DIGGING AND THEY WERE SO COURTEOUS. THIS RESIDENT COULD NOT SPEAK ENOUGH ON OUR COURTEOUS THE STOP WAS. MISSILE AND WE WILL MISS YOU, THANK YOU FOR BEING WITH US AND WE APPRECIATE ALL THAT YOU DO FOR THE CITY. WITH THAT BEING SAID, I WANT TO HIGHLIGHT A LOCAL BUSINESS JUST A FEW DOORS DOWN FROM US. I WANTED TO THANK THE BOARD FOR THEIR VOLUNTEERING AND THE NASSAU BEAUTIFUL AND WASTE MANAGEMENT FOR ORGANIZING THE EVENT AND GETTING THE TRASH TO THE LANDFILL, THEY REMOVE MORE THAN 60 TONS OF TRASH SO THE BOATERS WON'T HIT IT. SO KUDOS TO THEM. WITH THE MENTION ABOUT THE STORMWATER YOU TOOK TOOK MY THUNDER ON THAT. FINALLY, I SAW A PRESS RELEASE [01:40:04] FROM THE GOVERNOR. HE AWARDED THE CITY A RESILIENCY GRANT 484 -- $82,000. SO KUDOS TO THE STAFF FOR DOING THAT. THANK YOU. >> FINALLY BUESCHER OFFENSE. A SHOUT OUT TO THEY HAD TO DIRECT TRAFFIC FOR THREE DAYS. AND THAT IS A LARGE UNDERTAKING. I THINK THAT SHE TOLD ME THERE WERE 25,000 CARS IN TOTAL THAT CAME ONTO THE ISLAND. SO, THANKS TO POLICE EXHILARATE. TO THE FESTIVAL VOLUNTEERS, THERE IS LITERALLY HUNDREDS. AND TO THE PIRATES. THE PIRATES WALKING THE STREETS, MADE SHRIMP BEST SHRIMP FEST. I ALSO WANT TO COMPLIMENT MARION PHILLIPS. BECAUSE SHE NOTED, A MENTIONED BY THE SHRIMP FESTIVAL, THEY HAD NOT INVITED ANY SHRIMP BOATS. AND SHE WAS PROACTIVE, REACHED OUT TO HER CONTACTS AND WHERE WE HAVE THE BLESSING OF THE FLEET ON SUNDAY MORNING, WE HAD SHRIMP BOATS AND THAT IS WHAT THE FESTIVAL IS ALL ABOUT. THE HISTORY OF SHRIMPY IN THIS COMMUNITY. SO, SHUTOUTS ARE. >> TAYLOR, I RAN INTO COMMISSIONER ROSS ONE MORNING, HE WAS RIDING HIS BIKE AT THE MARINA. I HAD MY COFFEE AND MY BAGEL. AND A WOMAN WAS IN DIRE NEED OF HELP. HER SAILBOAT HAD SUFFERED AN ANGER PROBLEM OFF OF CUMBERLAND. SO SHE HAD A FORCED STAY AT THE MARINA.
