OUR DECORUM IS TO TREAT EVERYONE WITH DIGNITY AND RESPECT. AND WE ARE UNFORTUNATELY UNDER COVID-19 GUIDELINES. AS I MENTIONED AT THE WORKSHOP NASSAU COUNTY HAS THE HIGHEST INFECTION RATE IN THE COUNTRY, NOT THE STATE, THE COUNTRY. SO WE'RE FOLLOWING COVID-19 PROTOCOLS. I KNOW COMMISSIONER ROSS, AND THE VICE MAYOR WOULD LIKE TO MAKE SOME COMMENTS.

VICE MAYOR, WHY DON'T WE START WITH YOU.

>> AS THE MAYOR SAID, WE'RE RUNNING IN FIRST PLACE ALONG WITH THE NORTHEAST FLORIDA. OUR HOSPITALS ARE FULL AND ARE GETTING FULL WITH LOTS OF UNVACCINATED PEOPLE.

SO I'M GOING TO BE ASKING THE CITY MANAGER HOW WE CAN LOOK AT MANDATORY VACCINATIONS AND TO LOOK AGAIN AT MASKING REQUIREMENTS IN CITY BUILDINGS. ALSO I'M GOING TO TRY TO ADDRESS IF WE CAN DEAL WITH EVICTIONS AS A LOCAL GOVERNMENT.

YOU KNOW, THE EVICTION PROTECTION HAS EXPIRED AND I THINK WE NEED TO TAKE A LOOK AT THAT.

COMMISSIONER ROSS, SO BASED ON MY TRAINING OF 40 YEARS WORKING IN INTERNAL MEDICINE, REVIEW OF THE NASSAU COUNTY CURRENT COVID NUMBERS AND MOST IMPORTANTLY WORKING 11 HOUR SHIFT IN THE LOCAL EMERGENCY ROOM TWO DAYS AGO, THIS IS WHAT I BELIEVE, I BELIEVE THAT THE COVID VACCINES ARE SAFE AND EFFECTIVE. THE VAST MAJORITY OF PATIENTS WHO ARE BEING HOSPITALIZED AND WHO ARE OVERFLOWING HOSPITALS WITH COVID ARE NOT FULLY VACCINATED.

WHEN I LOOKED UP, THERE'S A THING CALLED UP TO DATE WHICH GIVES YOU THE LATEST INFORMATION, I'VE BEEN LOOKING AT THAT FOR YEARS AND I'VE NEVER SEEN THIS WRITTEN BEFORE WITH A DISEASE. IT SAYS QUOTE, GIVEN THE POTENTIAL SEVERITY OF COVID-19 ALL PATIENTS SHOULD HAVE UPDATED, THAT'S COVID PATIENTS SHOULD HAVE UPDATED HEALTH CARE PROXY AND ADVANCED DIRECTIVE INFORMATION IN THEIR HEALTH CARE REFERENCE. IN OTHER WORDS THEY'RE TELLING YOU IF YOU'RE NOT VACCINATED AND YOU COME IN WITH COVID, THAT YOU SHOULD GET ALL OF YOUR AFFAIRS STRAIGHTENED OUT.

THAT'S RIGHT OUT OF MEDICAL LITERATURE, I'VE NEVER SEEN THAT IN 40 YEARS OF DOING THIS. I'M WEARING AN N95 MASK AT THIS MEETING. I'D ADVISE ANYONE ATTENDING THIS MEETING TO DO LIKEWISE. IT'S MY PLEASURE TO PRESENT TO YOU THE FINDINGS AND FINAL REPORT OF THE CITY TREE COMMITTEE.

MANY OF OUR MEMBERS WERE UNFORTUNATELY UNABLE TO ATTEND IN PERSON TONIGHT. AND MANY ARE WATCHING ONLINE.

I WOULD LIKE TO EXTEND A SPECIAL THANK YOU TO EACH OF OUR MEMBERS FOR THEIR TIME AND DEDICATION TO THIS COMMITTEE ESPECIALLY GIVEN THEIR DAY-TO-DAY RESPONSIBILITIES.

OUR MEMBERS INCLUDE LINDA BELT WITH KEEP NASSAU BEAUTIFUL, LINDA, JOHN HILLMAN, DAVID JENSEN, MARGARET KIRKLAND, MATT WITH MCG HOMES, AND THE NEWEST ADDITION TO OUR PLANNING AND CONSERVATION DEPARTMENT, DAVID NAVILLE OUR URBAN FORESTER.

IN 2019, THE CITY COMMISSION ESTABLISHED A GOAL OF EXPANDING OUR TREE CANOPY BY 5% IN FOUR YEARS OR BY THE YEAR 2024.

THE DEPARTMENT OF PLANNING AND CONSERVATION WAS THEN ASSIGNED THE TASK OF INFORMATION GATHERING TO CREATE A REPORT THAT OFFERS A FRAMEWORK EMPHASIZING THE HEALTH, PROTECTION, AND MAINTENANCE OF OUR EXISTING TREE CANOPY.

AND MOST IMPORTANTLY, THE LAYOUT STRATEGIES FOR REPLACEMENT IN PLANTING A NEW DIVERSE TREE SPECIES.

TO ACCOMPLISH THIS GOAL, THE COMMITTEE HELD BIMONTHLY MEETINGS THAT INCLUDED PANEL DISCUSSIONS WITH DESIGN PROFESSIONALS, TREE SPECIALISTS, AND GIS PROFESSIONALS.

THIS ALLOWED A WELL ROUNDED EXCHANGE OF QUESTIONS AND PROVIDED FEEDBACK. AS A RESULT THE COMMITTEE GAINED A CONSENSUS ON THE SUSTAINABILITY OF THE 5% GOAL BY 2024 AND RESEARCH ACTIONABLE SOLUTIONS INCLUDING IDENTIFYING AVAILABLE PLANTING LOCATIONS AND COMMUNITY OUTREACH.

>> IN ORDER TO DEVELOP AN ACTION PLAN, THE COMMITTEE FIRST HAD TO ESTABLISH A NUMBER OF BASELINE VALUES.

SO WHAT DOES A 5% CANOPY INCREASE BY 2024 LOOK LIKE? WELL THE CITY OF FERNANDINA BEACH IS A TOTAL OF 8,051 ACRES.

AND USING THE 2019 AERIAL IMAGERY PROVIDED BY THE NASSAU COUNTY PROPERTY APPRAISER'S OFFICE, IT IS ESTIMATED THAT 39% OF THE CITY HAS CANOPY COVERAGE WHICH IS EQUIVALENT TO 3,140 ACRES. A 5% INCREASE OF THIS WOULD REQUIRE AN ADDITIONAL 157 ACRES OF TREE CANOPY.

FACTORING IN THE AVERAGE MATURE CANOPY SPREAD OF FOUR PRESELECTED NATIVE SPREAD TREES WHICH IS EQUIVALENT TO 41 SQUARE FEET, IT WAS DETERMINED THAT THE MEETING OF THIS GOAL WOULD REQUIRE THE SUCCESSFUL ESTABLISHMENT OF 5,181 TREES IN UNDER THREE YEARS. HERE WE HAVE A VISUAL REPRESENTATION OF WHAT A 5% INCREASE LOOKS LIKE WHEN COMPARED TO OUR AIRPORT. IT IS ALSO IMPORTANT TO NOTE THAT THESE NUMBERS DO NOT ACCOUNT FOR AN AVERAGE TREE MORTALITY RATE OF 7%. FACTORING IN THIS ESTIMATION WOULD REQUIRE AN ADDITIONAL 11 ACRES OF CANOPY COVERAGE OR 363

TREES TO BE PLANTED. >> AS OUR CITY CONTINUES TO GROW IN DEVELOPMENT, LONG TERM PLANNING AND MAINTENANCE IS CRITICAL TO PROTECTING AND RESTORING OUR URBAN FORESTS.

THE RECOMMENDATIONS OF THE CITY TREE COMMITTEE IS FOR THE PLANNING AND CONSERVATION DEPARTMENT TO INITIATE AND OVERSEE THE FOLLOWING ACTION PLAN.

LARGE AND SMALL SCALE PLANTINGS, CODE BASED AMENDMENTS, A WEBSITE REVAMP, COMMUNITY OUTREACH, AND CITY TREE STORAGE.

PART ONE OF THE ACTION PLAN, LARGE SCALE PLANTING INCLUDES PLANTING OF OVER TEN TREES AND MORE AT ONCE AND CRITICAL AREAS IDENTIFIED INCLUDE THE CITY SCHOOLS, PARK AND CITY RIGHT OF WAYS, RETENTION PONDS, AND CONTINUED COLLABORATION WITH KEEP NASSAU BEAUTIFUL THROUGH TREE GIVEAWAY EVENTS WHICH SUPPORT OUR ACTION PLAN THROUGH LARGE SCALE PLANTINGS.

ALSO THE COMMITTEE RECOGNIZES THE NEED FOR PARKS AND RECREATION AND PLANNING AND CONSERVATION TO FACILITATE EMPLOYEE TRAINING, IMPLEMENTATION OF OUTREACH, TREE PLANTING, AND VOLUNTEERING EFFORTS.

>> PROGRAMS WHICH INCLUDE FREE TREE REPLACEENTS, PERSONALIZED TREE DEDICATIONS, AND THE CONTINUATION OF ANNUAL STATE AND NATIONAL ARBOR DAY PLANTINGS ARE DESIGNED TO ENCOURAGE COMMUNITY INVOLVEMENT, EDUCATION, AND ADVOCACY.

>> THE CITY COMMISSION SET A GOAL IN 2021 TO ENHANCE TREE PROTECTION MEASURES THROUGH CODE AMENDMENTS.

IN RESPONSE TO THAT GOAL THE COMMITTEE PROPOSES THE FOLLOWING AMENDMENTS, AN ADMINISTRATIVE PROCESS TO ALLOW FOR TREE PRESERVATION, EXPANSION OF THE PROTECTED TREE DEFINITION TO INCLUDE NEWLY PLANTED TREES, STRENGTHENING OF REQUIREMENTS FOR RETENTION POND PLANTINGS, AN INCREASE OF THE TREE REMOVAL FEE BY $50 A REDUCTION OF THE IMPERVIOUS SERVICE RATIO FROM A MAXIMUM OF 60% TO A MAXIMUM OF 45%.

AND CONCRETE AND PAVER PERMITTING EXCEEDING 50 SQUARE

FEET. >> ADDITIONAL CODE AMENDMENTS INCLUDE AN INCREASE IN MINIMUM LANDSCAPE REQUIREMENTS FOR SINGLE AND MULTIFAMILY DEVELOPMENT, ON SITE RELOCATION OF HEALTHY TREES TO BE COUNTED TOWARDS MITIGATION REQUIREMENTS.

THE EXTENSION OF MINIMUM TREE HEALTH GUARANTEE FROM ONE YEAR TO THREE YEARS. A REQUIRED THREE YEAR ASSESSMENT OF ALL PRESERVED, RELOCATED OR NEWLY PLANTED TREES.

AND THE INCORPORATION OF SPECIFIC LANGUAGE TO THE LAND DEVELOPMENT CODE REGARDING THE TREE TRUST FUND.

ANOTHER COMPONENT OF THE ACTION PLAN IS THE WEBSITE REVAMP.

BECAUSE COMMUNITY INVOLVEMENT, EDUCATION ARE CRITICAL COMPONENTS TO GROWING AND PROTECTING OUR CANOPY, WE WANT TO PROVIDE CITIZENS WITH A USER FRIENDLY WEB PAGE.

INFORMATION FROM THE USER DEVELOPMENT CODE HAS BEEN BROKEN DOWN INTO CLEARLY DEFINED CATEGORIES, PHOTOGRAPHIC ICONS CREATE A VISUALLY INTERESTING PAGE.

OVERLAPPING INFORMATION CAN BE ACCESSED FROM MULTIPLE ICONS AND ALL TREE RELATED APPLICATIONS ARE READILY AVAILABLE IN ONE

LOCATION. >> THE RECOMMENDATIONS AND SOLUTIONS BROUGHT FORTH TO THIS COMMITTEE ARE UNIQUE IN THAT IT'S NOT JUST A CITY PLAN BUT A COMMUNITY WIDE COLLABORATION THROUGH PARTNERSHIPS. THESE INCLUDE CONTINUED PARTNERSHIPS WITH LOCAL CONSERVANCY GROUPS, SOCIAL MEDIA AND PROMOTION, INFO GRAPHICS, LOCAL SCHOOL OUTREACH THROUGH THE ESTABLISHMENT OF A VOLUNTEER PLANTER PROGRAM, A BIANNUAL TREE WORKSHOP HOSTED BY OUR URBAN FORESTER AND A CITY TREE UNIT CONSISTING OF A SMALL NUMBER OF CITY EMPLOYEES TO BETTER MAINTAIN AND CARE FOR NEWLY PLANTED TREES.

IN ORDER TO SUPPORT THE RECOMMENDATIONS OF THE COMMITTEE, A DESIGNATED SPACE AND ROUTINE STORAGE IS NEEDED FOR FUTURE TREE GIVEAWAY EVENTS IT'S THE COMMITTEE'S RECOMMENDATION TO UTILIZE A SHARED SPACE.

FUNDS HAVE ALREADY BEEN ALLOCATED WITHIN THE 2021-22 BUDGET AND INTERDEPARTMENTAL CONVERSATIONS HAVE ALREADY TAKEN PLACE FOR THE POSSIBILITY OF UTILIZING EXISTING SPACE.

THREE MAJOR AREAS IDENTIFIED FOR LARGE SCALE PLANTINGS TO BEGIN THIS FALL. IDENTIFYING CURRENT AND FUTURE FINANCIAL PARAMETERS ARE CRITICAL WHEN BUDGETING FOR AN ACTION PLAN. HERE WE HAVE WHAT THE CURRENT ESTABLISHED GOAL IS PROJECTED TO COST OVER THE NEXT 2.5 YEARS.

IN ORDER TO ACHIEVE A 5% INCREASE BY 2024, OVER 1900 TREES WOULD NEED TO BE PLANTED PER YEAR AT A COST OF MORE THAN $500,000. IT IS IMPORTANT TO NOTE THAT THIS NUMBER DOES NOT INCLUDE TIME, LABOR, AND ADDITIONAL MATERIALS SUCH AS MULCH AND WATER BAGS.

HOWEVER THE PROJECTED 2021-22 FISCAL YEAR BUDGET IS IN HARMONY WITH A RESTRUCTURED GOAL OF A 5% CANOPY COVERAGE INCREASE OVER A 15 YEAR PERIOD. IN ORDER TO TRACK CONTINUED PROGRESS, THERE ARE A NUMBER OF METHODS THAT CAN BE UTILIZED INCLUDING AERIAL IMAGERY PROVIDED BY THE NASSAU COUNTY PROPERTY APPRAISER'S OFFICE, A CONTRACTED TREE INVENTORY, REGULAR TREE REMOVAL PERMITS, AND HANDHELD GPS UNITS FOR TARGETED TREE SURVEY. PROS AND CONS CAN BE FOUND IN EACH METHOD AND SHOULD ALWAYS BE TAKEN INTO CONSIDERATION WHEN DETERMINING WHICH ONE IS MOST APPROPRIATE.

>> IN CONCLUSION WE WOULD RECOMMEND MAINTAIN THE 5% TREE CANOPY GOAL BUT EXTEND THE TIMELINE TO 15 YEARS.

ESTABLISH A CITY TREE LIMIT, DEDICATE A SPECIFIC SPACE FOR TREE STAGING AND PROCEED TO THE PLANNING ADVISORY BOARD FOR CONSIDERATION OF THESE CODE BASED CHANGES.

NOT PROCESS I WAS SURPRISED TO DISCOVER THAT THERE WAS NO MORE BROAD UNDERSTANDING OF THE BACKGROUND OF THIS REQUEST. I APPRECIATE THE OPPORTUNITY TO SHARE THE HISTORY AND CONTEXT OF THIS REQUEST WITH YOU THIS EVENING. THE ATLANTIC SEAFOOD LEASE CLEARLY STIPULATES THAT I HAVE THE RIGHT TO BUILD A NEW FACILITY JUST SOUTH OF OUR CURRENT LOCATION. THE ATLANTIC SEAFOOD MANAGEMENT TEAM MET WITH THE CITY MANAGER AND THE CITY ATTORNEY TO DISCUSS NEXT STEPS INCLUDING THE NECESSARY UPDATE OF OUR LEASE IN LIGHT OF THE NEW SIDEWALK PLAN. THE PLAN STIPULATED THAT TWO STRUCTURES WOULD BE ERECTED SOUTH OF THE CURRENT ATLANTIC SEAFOOD BUILDING. WE WERE INFORMED ONE OF THOSE WOULD BE THE NEW LOCATION OF THE ATLANTIC SEAFOOD MARKET AND RESTAURANT. AS ADDITIONAL BACKGROUND IN 2019, THE CITY OF FERNANDINA BEACH MET TO ASSESS THE APPRAISAL VALUE. AT THIS TIME WE HOPED TO EXTEND OUR LEASE AND INVESTED IN HIRING AN ARCHITECT TO DRAW UP PLANS TO ENHANCE AND MODERNIZE THE WATERFRONT WHILE REMAINING TRUE TO THE ARCHITECTURAL STYLE IT IS KNOWN.

THE LEASE HAS BEEN UPDATED. WITH A DECLINE OF THE LOCAL SHRIMPING INDUSTRY OVER THE LAST 3 TO 4 DECADES, THE CENTRAL ROLE OF ATLANTIC SEAFOOD IN OUR COMMUNITY HAS SHIFTED.

SINCE 1985 OUR PLANS AND REQUESTS HAVE BEEN COMPRISED OF A MARKET AND RESTAURANT. AS WE BUILD FOR THE NEXT PHASE OF OUR FUTURE AS A BUSINESS AND A KEY COMPONENT OF A FINANCIALLY HEALTHY AND VIBRANT WATERFRONT SCENE, THIS COMBINATION WILL OPTIMIZE THE NEEDS OF OUR RESIDENTS AND OUR TOURIST INDUSTRY. THE PLANS THEMSELVES ARE VERY MINIMAL IN TERMS OF SUPPORT, REVIEW, AND MONITORING THE PRIMARY ACTIVITIES TO ENSURE THE ACTIVITIES OUT THERE AS WELL AS MAINTENANCE.

I DO WANT TO POINT OUT THAT ON THE EPISCOPAL PROPERTY, THERE WAS AN OVERSIGHT AND A LACK OF INFORMATION REALLY BEING PROVIDED ABOUT IF HISTORY AND THE IMPORTANCE OF THAT PROPERTY OF THE PROMINENCE IN OUR COMMUNITY.

BUT WE HAVE THE ISSUE OF ATTORNEYS FEES WE'RE DEALING WITH. IN THESE CASES THE BOTH SIDES CAN STIPULATE OR AGREE TO WHAT THE ATTORNEYS FEES WOULD BE, BUT THE BILLS AND RECEIPTS WE GOT FOR THE ATTORNEYS FEES WE THOUGHT WERE FRANKLY OUTRAGEOUS. SO WE ARE GOING TO FILE A MOTION IN COURT. THEY'RE ABOUT $70,000.

AND WE THINK THAT THAT IS NOT REASONABLE.

AND UNDER THE STATUTE, THE ATTORNEY IS ENTITLED TO A REASONABLE FEE AND SO WE FILE A MOTION OBJECTING TO WHAT THEY HAVE FILED WITH THE COURT AS THE FEES, THE REASONABLE FEES.

WE HIRE ANOTHER EMINENT DOMAIN ATTORNEY, AS OUR EXPERT, BECAUSE YOU HAVE TO HAVE THE EXPERT TESTIFY THAT THOSE FEES ARE NOT REASONABLE. WE CAN'T JUST SAY THEY'RE NOT REASONABLE. SO WE ARE DOING THAT.

WE ARE NOT, I DON'T THINK AT ALL UNNECESSARILY KEEPING THIS GOING. WE CERTAINLY KNOW WHAT YOU ALL WANT, BUT WE'RE NOT GOING TO TAKE TAXPAYER MONEY I DON'T THINK AND JUST PAY THE BILL IF IT SEEMS OUTRAGEOUS AND THAT'S WHAT WE THINK. AND ON ANOTHER NOTE, INTERESTINGLY, THE PROPERTY APPRAISER HERE ASKED FOR A COPY THAT YOU ALL KNOW IS PUBLIC RECORD OF THE APPRAISAL THE $2.3 MILLION FROM THE EMINENT DOMAIN CASE.

AND THE CITY AND THE COUNTY I THINK WERE SPLITTING ABOUT $16,000 EACH. SO THAT CAME ABOUT LAST WEDNESDAY AND WE'LL START THE PROCESS.

WE'LL PROBABLY HAVE TO GO OUT WITH ANOTHER RFP AND IT'S A VERY POSITIVE THING I THINK. I WOULD SAY IT'S THE MOST IMPORTANT ENVIRONMENTAL THING THAT WE'VE DONE IN HISTORY.
